149149 SECTION 1. NEW LAW A new section of law not to be
150150 codified in the Oklahoma Statutes reads as follows:
151151 This act shall be known and may be cited as the “Oklahoma State
152152 Guard and Militia Revitalization Act of 202 3”.
153153 SECTION 2. AMENDATORY 44 O.S. 2021, Section 41, is
154154 amended to read as follows:
155155 Section 41. A. The Militia of the State of Oklahoma shall
156156 consist of all able-bodied citizens of the United States and all
157157 other able-bodied persons who are sound of mind, who shall be or
158158 shall have declared their intentions to become citizens of the
159159 United States, who shall be more than seventeen (17) are at least
160160 sixteen (16) years of age and not more than seventy (70) years of
161161 age, and said the militia shall be divided into three (3) classes:
162162 The National Guard, the Oklahoma State Guard, and th e Unorganized
163163 Militia; provided, that persons in the Unorganized Militia ov er the
164164 age of seventy (70) years and under the age of seventeen (17) years
165165 shall be exempt from mandatory service .
166166 B. A unit of the Oklahoma State Guard (OSG) shall be
167167 established in each county of this state that shall operate under
168168 and report to a designee a t the Military Department of the State of
169169 Oklahoma. Members of each county unit of the Oklahoma State Guard
170170 and of the Unorganized Militia shall be able to immediately respond ,
171171 if called into service, fully equ ipped for infantry or other service
172172 within this state.

224224 C. Privately owned semia utomatic firearms may be required for
225225 service for the Oklahoma State Guard or the Unorganized Militia if
226226 such firearms are ordered or mustere d for service. Any such firearm
227227 shall be similar to firearms issued by the mil itary forces of the
228228 United States, the National Guard, or the military or police forces
229229 of this state, pursuant to regulation developed by the Military
230230 Department of the State o f Oklahoma. Such firearms shall:
231231 1. Be capable of accepti ng a standard capaci ty magazine of
232232 greater than ten round s; and
233233 2. Contain ergonomic features including, but not limited to,
234234 any or all of the following:
235235 a. a pistol grip below the action ,
236236 b. an adjustable buttstock,
237237 c. a threaded barrel capable of accept ing a muzzle device
238238 designed to reduce or eliminate harmf ul noise or flash
239239 signature,
240240 d. a lug capable of accepting a bayonet or other
241241 accessories, or
242242 e. a protective shroud or handguard partially or fully
243243 encircling the barrel to p revent barrel heat injury to
244244 the user.
245245 D. Notwithstanding the requirements set forth in subsection C
246246 of this section, the Adjutant General (TAG) shall promulgate an
247247 additional standard for emergency situations that sha ll authorize

299299 the use of any safe and operable semiautomatic or other rifle,
300300 pistol, or shotgun that is in common use by military or police
301301 forces.
302302 E. Under orders promulgated by the Gover nor and the Adjutant
303303 General (TAG), each county unit of the Oklahoma S tate Guard shall
304304 ensure the voluntary equipping, training, and readiness to the
305305 extent permitted by local county volu nteer staffing and interest,
306306 and for the training and readiness of volunteers drawn from the
307307 Unorganized Militia of th is state.
308308 F. This state shall fund the county OSG unit when activated for
309309 state active duty, as defined in Section 801 of this title, by order
310310 of the Governor, or when called to mandatory training. Counties and
311311 citizen groups may voluntarily fund personnel, traini ng, equipment,
312312 vehicles, and logistics for their respective county OSG units in
313313 coordination with the Military Departme nt of the State of Oklahoma,
314314 but such OSG units shall remain under the command of the Department
315315 when ordered to service, and any such us e of voluntary funding shall
316316 be consistent with orders and regulations of the Governor pursuant
317317 to Section 243 of this title.
318318 G. The Military Department of the State of Oklahoma shall
319319 develop a plan of coordination with county sheriffs and the county’s
320320 respective OSG unit for emergency man agement.
321321 H. County OSG units shall adhere to the u niform and grooming
322322 standards set forth in AR -670-1.

374374 I. Beginning December 1, 2023, the registrar of each county
375375 shall provide every registered voter with notice of the opportunity
376376 for service in and cont act information for the county OSG unit, and
377377 thereafter, upon first-time voter registration.
378378 J. Nothing in this section shall be construed to require or
379379 permit any scheme of licensing, registration , or list of specific
380380 firearms.
381381 SECTION 3. AMENDATORY 44 O.S. 2021, Section 242, is
382382 amended to read as follows:
383383 Section 242. Such military forces shall be designated as the
384384 “Oklahoma State Guard” and shall be composed of officer s
385385 commissioned or assigned, and such able-bodied male citizens of the
386386 state as shall volunteer for service therein . They shall be
387387 additional to and distinct from the Oklahoma National Guard of the
388388 State of Oklahoma, as defined in Title 32 of the United States Code.
389389 They shall not be required to serve outside the boundaries of the
390390 State of Oklahoma this state.
391391 SECTION 4. AMENDATORY 44 O.S. 2021, Section 243, is
392392 amended to read as fo llows:
393393 Section 243. A. The Governor is hereby authorized to shall
394394 prescribe rules and regulations governing t he enlistment,
395395 organization, administration, equip ment, discipline and discharge of
396396 the personnel of such military forces; to requisition from the
397397 Secretary of Defense such arms and equipment as may be in the

449449 possession of and can be spared by the Departme nt of Defense and to
450450 extend thereto the facilities of state armories, Armed Forces
451451 Reserve Centers, readiness centers, logistics, aviation, and
452452 training facilities, warehouses and their equipment and such other
453453 state premises and p roperty as may be availab le for the purpose of
454454 drill and instruction. Insofar as applicable the procedure for the
455455 enlistment, organization, pay, maintenance, equipment and
456456 disciplining of such forces shall be in conformity with the law and
457457 the rules and regulations governing and p ertaining to the National
458458 Guard; provided, that t he officers and enlisted personnel in the
459459 Oklahoma State Guard shall not receive any compensation or monetary
460460 allowances from the state except when activated for state active
461461 duty, as defined in Section 801 of this title, by order of the
462462 Governor.
463463 B. 1. The Governor shall appoint a Commandant of the O klahoma
464464 State Guard and Unorganized Militia (OSGUM Commandant or
465465 “Commandant”) to serve within the Military Department of the State
466466 of Oklahoma and to report to the Adjutant General (TAG).
467467 2. Each board of county commissioners shall solicit nominees
468468 with prior honorable service in the Armed Forces of the United
469469 States or National Guard and who reside within the county, to serve
470470 as the interim County Unit Liaison of the Oklahoma State Guard and
471471 Unorganized Militia. Any person desiring to serve shall provide to
472472 the Board for the county of desired service his or her form DD-214

525525 expiration of his or her term of s ervice. The County Unit Liaison
526526 will report to the OSGUM Commandant and to TAG, and such
527527 intermediary officers as TAG shall appoint, for ensuring the
528528 readiness of the OSG county unit and training opportunities for the
529529 Unorganized Militia within the county.
530530 3. No later than November 30, 2023, the board of county
531531 commissioners shall appoint an interim County Unit Liaison to
532532 initiate the administration of the County Unit of the Oklahoma State
533533 Guard and Unorganized Militia.
534534 4. No later than January 30, 2024, and by March 1 of every year
535535 thereafter, the Oklahoma National Guard shall provide to County Unit
536536 Liaisons a list of persons retired or honorably discharged from the
537537 service of the United States or from the National Guar d within the
538538 last forty-eight (48) months, who reside within the county.
539539 5. TAG shall authorize at least four voluntary Multiple Unit
540540 Training Assemblies (MUTA) of Inactive Duty for Training (IDT ) per
541541 month and fifteen (15) days of annual training.
542542 C. Members of the Oklahoma State Guard s hall be considered part
543543 of state military forces as defined in Section 801 of this title and
544544 shall be subject to the Oklahoma Uniform Code of Mili tary Justice.
545545 C. D. When prescribing the rules and regulations governing
546546 enlistment, organization, administra tion, equipment, discipline and
547547 discharge of the personnel of the Oklahoma State Gu ard, the Governor

600600 order or in a series of such orders. An executive order or a series
601601 of such orders prescribing the rules and regulations gov erning
602602 enlistment, organization, administratio n, equipment, discipline and
603603 discharge of the personnel of the Oklahom a State Guard shall also be
604604 published by the Adjutant General as a mi litary publication.
605605 SECTION 5. This act shall become e ffective November 1, 2023.
