149	149	SECTION 1. NEW LAW A new section of law not to be
150	150	codified in the Oklahoma Statutes reads as follows:
151	151	This act shall be known and may be cited as the “Oklahoma State
152	152	Guard and Militia Revitalization Act of 202 3”.
153	153	SECTION 2. AMENDATORY 44 O.S. 2021, Section 41, is
154	154	amended to read as follows:
155	155	Section 41. A. The Militia of the State of Oklahoma shall
156	156	consist of all able-bodied citizens of the United States and all
157	157	other able-bodied persons who are sound of mind, who shall be or
158	158	shall have declared their intentions to become citizens of the
159	159	United States, who shall be more than seventeen (17) are at least
160	160	sixteen (16) years of age and not more than seventy (70) years of
161	161	age, and said the militia shall be divided into three (3) classes:
162	162	The National Guard, the Oklahoma State Guard, and th e Unorganized
163	163	Militia; provided, that persons in the Unorganized Militia ov er the
164	164	age of seventy (70) years and under the age of seventeen (17) years
165	165	shall be exempt from mandatory service .
166	166	B. A unit of the Oklahoma State Guard (OSG) shall be
167	167	established in each county of this state that shall operate under
168	168	and report to a designee a t the Military Department of the State of
169	169	Oklahoma. Members of each county unit of the Oklahoma State Guard
170	170	and of the Unorganized Militia shall be able to immediately respond ,
171	171	if called into service, fully equ ipped for infantry or other service
172	172	within this state.

224	224	C. Privately owned semia utomatic firearms may be required for
225	225	service for the Oklahoma State Guard or the Unorganized Militia if
226	226	such firearms are ordered or mustere d for service. Any such firearm
227	227	shall be similar to firearms issued by the mil itary forces of the
228	228	United States, the National Guard, or the military or police forces
229	229	of this state, pursuant to regulation developed by the Military
230	230	Department of the State o f Oklahoma. Such firearms shall:
231	231	1. Be capable of accepti ng a standard capaci ty magazine of
232	232	greater than ten round s; and
233	233	2. Contain ergonomic features including, but not limited to,
234	234	any or all of the following:
235	235	a. a pistol grip below the action ,
236	236	b. an adjustable buttstock,
237	237	c. a threaded barrel capable of accept ing a muzzle device
238	238	designed to reduce or eliminate harmf ul noise or flash
239	239	signature,
240	240	d. a lug capable of accepting a bayonet or other
241	241	accessories, or
242	242	e. a protective shroud or handguard partially or fully
243	243	encircling the barrel to p revent barrel heat injury to
244	244	the user.
245	245	D. Notwithstanding the requirements set forth in subsection C
246	246	of this section, the Adjutant General (TAG) shall promulgate an
247	247	additional standard for emergency situations that sha ll authorize

299	299	the use of any safe and operable semiautomatic or other rifle,
300	300	pistol, or shotgun that is in common use by military or police
301	301	forces.
302	302	E. Under orders promulgated by the Gover nor and the Adjutant
303	303	General (TAG), each county unit of the Oklahoma S tate Guard shall
304	304	ensure the voluntary equipping, training, and readiness to the
305	305	extent permitted by local county volu nteer staffing and interest,
306	306	and for the training and readiness of volunteers drawn from the
307	307	Unorganized Militia of th is state.
308	308	F. This state shall fund the county OSG unit when activated for
309	309	state active duty, as defined in Section 801 of this title, by order
310	310	of the Governor, or when called to mandatory training. Counties and
311	311	citizen groups may voluntarily fund personnel, traini ng, equipment,
312	312	vehicles, and logistics for their respective county OSG units in
313	313	coordination with the Military Departme nt of the State of Oklahoma,
314	314	but such OSG units shall remain under the command of the Department
315	315	when ordered to service, and any such us e of voluntary funding shall
316	316	be consistent with orders and regulations of the Governor pursuant
317	317	to Section 243 of this title.
318	318	G. The Military Department of the State of Oklahoma shall
319	319	develop a plan of coordination with county sheriffs and the county’s
320	320	respective OSG unit for emergency man agement.
321	321	H. County OSG units shall adhere to the u niform and grooming
322	322	standards set forth in AR -670-1.

374	374	I. Beginning December 1, 2023, the registrar of each county
375	375	shall provide every registered voter with notice of the opportunity
376	376	for service in and cont act information for the county OSG unit, and
377	377	thereafter, upon first-time voter registration.
378	378	J. Nothing in this section shall be construed to require or
379	379	permit any scheme of licensing, registration , or list of specific
380	380	firearms.
381	381	SECTION 3. AMENDATORY 44 O.S. 2021, Section 242, is
382	382	amended to read as follows:
383	383	Section 242. Such military forces shall be designated as the
384	384	“Oklahoma State Guard” and shall be composed of officer s
385	385	commissioned or assigned, and such able-bodied male citizens of the
386	386	state as shall volunteer for service therein . They shall be
387	387	additional to and distinct from the Oklahoma National Guard of the
388	388	State of Oklahoma, as defined in Title 32 of the United States Code.
389	389	They shall not be required to serve outside the boundaries of the
390	390	State of Oklahoma this state.
391	391	SECTION 4. AMENDATORY 44 O.S. 2021, Section 243, is
392	392	amended to read as fo llows:
393	393	Section 243. A. The Governor is hereby authorized to shall
394	394	prescribe rules and regulations governing t he enlistment,
395	395	organization, administration, equip ment, discipline and discharge of
396	396	the personnel of such military forces; to requisition from the
397	397	Secretary of Defense such arms and equipment as may be in the

449	449	possession of and can be spared by the Departme nt of Defense and to
450	450	extend thereto the facilities of state armories, Armed Forces
451	451	Reserve Centers, readiness centers, logistics, aviation, and
452	452	training facilities, warehouses and their equipment and such other
453	453	state premises and p roperty as may be availab le for the purpose of
454	454	drill and instruction. Insofar as applicable the procedure for the
455	455	enlistment, organization, pay, maintenance, equipment and
456	456	disciplining of such forces shall be in conformity with the law and
457	457	the rules and regulations governing and p ertaining to the National
458	458	Guard; provided, that t he officers and enlisted personnel in the
459	459	Oklahoma State Guard shall not receive any compensation or monetary
460	460	allowances from the state except when activated for state active
461	461	duty, as defined in Section 801 of this title, by order of the
462	462	Governor.
463	463	B. 1. The Governor shall appoint a Commandant of the O klahoma
464	464	State Guard and Unorganized Militia (OSGUM Commandant or
465	465	“Commandant”) to serve within the Military Department of the State
466	466	of Oklahoma and to report to the Adjutant General (TAG).
467	467	2. Each board of county commissioners shall solicit nominees
468	468	with prior honorable service in the Armed Forces of the United
469	469	States or National Guard and who reside within the county, to serve
470	470	as the interim County Unit Liaison of the Oklahoma State Guard and
471	471	Unorganized Militia. Any person desiring to serve shall provide to
472	472	the Board for the county of desired service his or her form DD-214

525	525	expiration of his or her term of s ervice. The County Unit Liaison
526	526	will report to the OSGUM Commandant and to TAG, and such
527	527	intermediary officers as TAG shall appoint, for ensuring the
528	528	readiness of the OSG county unit and training opportunities for the
529	529	Unorganized Militia within the county.
530	530	3. No later than November 30, 2023, the board of county
531	531	commissioners shall appoint an interim County Unit Liaison to
532	532	initiate the administration of the County Unit of the Oklahoma State
533	533	Guard and Unorganized Militia.
534	534	4. No later than January 30, 2024, and by March 1 of every year
535	535	thereafter, the Oklahoma National Guard shall provide to County Unit
536	536	Liaisons a list of persons retired or honorably discharged from the
537	537	service of the United States or from the National Guar d within the
538	538	last forty-eight (48) months, who reside within the county.
539	539	5. TAG shall authorize at least four voluntary Multiple Unit
540	540	Training Assemblies (MUTA) of Inactive Duty for Training (IDT ) per
541	541	month and fifteen (15) days of annual training.
542	542	C. Members of the Oklahoma State Guard s hall be considered part
543	543	of state military forces as defined in Section 801 of this title and
544	544	shall be subject to the Oklahoma Uniform Code of Mili tary Justice.
545	545	C. D. When prescribing the rules and regulations governing
546	546	enlistment, organization, administra tion, equipment, discipline and
547	547	discharge of the personnel of the Oklahoma State Gu ard, the Governor

605	605	SECTION 5. This act shall become e ffective November 1, 2023.
