152 | 152 | | Guard and Militia Revitalization Act of 202 3”. |

153 | 153 | | SECTION 2. AMENDATORY 44 O.S. 2021, Section 41, is |
---|
154 | 154 | | amended to read as follows: |

155 | 155 | | Section 41. A. The Militia of the State of Oklahoma shall |
---|
156 | 156 | | consist of all able-bodied citizens of the United States and all |
---|
157 | 157 | | other able-bodied persons who are sound of mind, who shall be or |
---|
158 | 158 | | shall have declared their intentions to become citizens of the |
---|
159 | 159 | | United States, who shall be more than seventeen (17) are at least |
---|
160 | 160 | | sixteen (16) years of age and not more than seventy (70) years of |
---|
161 | 161 | | age, and said the militia shall be divided into three (3) classes: |

162 | 162 | | The National Guard, the Oklahoma State Guard, and th e Unorganized |

163 | 163 | | Militia; provided, that persons in the Unorganized Militia ov er the |

231 | 231 | | 1. Be capable of accepti ng a standard capaci ty magazine of |
---|
232 | 232 | | greater than ten round s; and |

233 | 233 | | 2. Contain ergonomic features including, but not limited to, |
---|
234 | 234 | | any or all of the following: |
---|
235 | 235 | | a. a pistol grip below the action , |
---|
236 | 236 | | b. an adjustable buttstock, |
---|
237 | 237 | | c. a threaded barrel capable of accept ing a muzzle device |
---|
238 | 238 | | designed to reduce or eliminate harmf ul noise or flash |
---|
239 | 239 | | signature, |
---|
240 | 240 | | d. a lug capable of accepting a bayonet or other |
---|
241 | 241 | | accessories, or |
---|
242 | 242 | | e. a protective shroud or handguard partially or fully |
---|
243 | 243 | | encircling the barrel to p revent barrel heat injury to |
---|
244 | 244 | | the user. |

245 | 245 | | D. Notwithstanding the requirements set forth in subsection C |
---|
246 | 246 | | of this section, the Adjutant General (TAG) shall promulgate an |

303 | 303 | | General (TAG), each county unit of the Oklahoma S tate Guard shall |

304 | 304 | | ensure the voluntary equipping, training, and readiness to the |
---|
305 | 305 | | extent permitted by local county volu nteer staffing and interest, |
---|
306 | 306 | | and for the training and readiness of volunteers drawn from the |
---|
307 | 307 | | Unorganized Militia of th is state. |
---|
308 | 308 | | F. This state shall fund the county OSG unit when activated for |
---|
309 | 309 | | state active duty, as defined in Section 801 of this title, by order |
---|
310 | 310 | | of the Governor, or when called to mandatory training. Counties and |
---|
311 | 311 | | citizen groups may voluntarily fund personnel, traini ng, equipment, |
---|
312 | 312 | | vehicles, and logistics for their respective county OSG units in |
---|
313 | 313 | | coordination with the Military Departme nt of the State of Oklahoma, |
---|
314 | 314 | | but such OSG units shall remain under the command of the Department |
---|
315 | 315 | | when ordered to service, and any such us e of voluntary funding shall |
---|
316 | 316 | | be consistent with orders and regulations of the Governor pursuant |
---|
317 | 317 | | to Section 243 of this title. |
---|
318 | 318 | | G. The Military Department of the State of Oklahoma shall |
---|
319 | 319 | | develop a plan of coordination with county sheriffs and the county’s |
---|
320 | 320 | | respective OSG unit for emergency man agement. |
---|
321 | 321 | | H. County OSG units shall adhere to the u niform and grooming |
---|
322 | 322 | | standards set forth in AR -670-1. |

463 | 463 | | B. 1. The Governor shall appoint a Commandant of the O klahoma |
