25-BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

27-SECTION 1. AMENDATORY 15 O.S. 2021, Sec tion 753, is
28-amended to read as follows:

30-Section 753. A person engages in a practice which is declared
31-to be unlawful under the Oklahoma Consumer Protection Act when, in
32-the course of the person's business, the person:
33-
34-1. Represents, knowingly or with re ason to know, that the
35-subject of a consumer transaction is of a particular make or brand,
36-when it is of another;
37-
38-2. Makes a false or misleading representation, knowingl y or
39-with reason to know, as to the source, sponsorship, approval, or
40-certification of the subject of a consum er transaction;
41-
42-3. Makes a false or misleading representation, knowingly or
43-with reason to know, a s to affiliation, connection, association
44-with, or certification by another;

48-4. Makes a false or misleading representation or design ation,
49-knowingly or with reason to know, of the geographic origin of the
50-subject of a consumer transaction;

52-5. Makes a false representation, knowingly or with reason to
53-know, as to the char acteristics, ingredients, uses, benefits,
54-alterations, or quantiti es of the subject of a c onsumer transaction
55-or a false representation as to the sponsorship, approval, status,
56-affiliation or connection of a person therewith;

58-6. Knowingly or with reason to know, makes a false or
59-misleading representation or gives the false or misleading
60-impression of being affiliated with a state agency or an affiliate
61-of a state agency through advertisement or publicati on;

63-7. Represents, knowingly or with reason to know, that the
64-subject of a consumer transaction is original or new if the p erson
65-knows that it is recondition ed, reclaimed, used, or secondhand;

67-7. 8. Represents, knowingly or with reason to know, that the
68-subject of a consumer transaction is of a particular standard, style
69-or model, if it is of another;

71-8. 9. Advertises, knowingly o r with reason to know, the subject
72-of a consumer transaction with intent not to sell it as advertis ed;

74-9. 10. Advertises, knowingly or with reason to know, th e
75-subject of a consumer transaction with intent not to supply
76-reasonably expected public demand, unle ss the advertisement
77-discloses a limitation of quantity;

79-10. 11. Advertises under the guise of ob taining sales personnel
80-when in fact the purpose is to se ll the subject of a consumer
81-transaction to the sales personnel ap plicants;

83-11. 12. Makes false or misleadin g statements of fact, knowingly
84-or with reason to know, concerning the price of the subje ct of a
85-consumer transaction or the reason for, existence of, or amounts of
86-price reduction;

88-12. 13. Employs "bait and switch" advertising, which consists
89-of an offer to sell the subject of a consumer transaction which the

92-seller does not intend to sell, which advertising is accompanied by
93-one or more of the fol lowing practices:

95-a. refusal to show the subject of a consumer tra nsaction
96-advertised,

98-b. disparagement of the ad vertised subject of a consumer
99-transaction or the terms of sale,
100-
101-c. requiring undisclosed tie-in sales or other
102-undisclosed conditions to be met prior to selling the
103-advertised subject of a consumer transactio n,
104-
105-d. refusal to take orders for the subject of a consumer
106-transaction advertised for delivery within a
107-reasonable time,
108-
109-e. showing or demonstrating defective subject of a
110-consumer transaction which the seller knows is
111-unusable or impracticable for the pur pose set forth in
112-the advertisement,
113-
114-f. accepting a deposit for the subject of a consumer
115-transaction and subsequently chargi ng the buyer for a
116-higher priced item, or
117-
118-g. willful failure to m ake deliveries of the subject of a
119-consumer transaction within a r easonable time or to
120-make a refund therefor up on the request of the
121-purchaser;

123-13. 14. Conducts a closing out sale without having first
124-obtained a license as required in the Oklahoma Consumer Protection
125-Act;

127-14. 15. Resumes the business for which the clo sing out sale was
128-conducted within thirty -six (36) months from the expiration date of
129-the closing out sale license;

131-15. 16. Falsely states, knowingly or with reason to know, that
132-services, replacements or repairs are needed;

163-other merchandise offered by a person in a consumer transaction
164-executed prior to the closing of the busines s of the person without
165-providing a purchaser a means of redeeming su ch merchandise or
166-ensuring the warranties offered will be honored by another person;

168-25. 26. Knowingly causes a cha rge to be made by any billing
169-method to a consumer for services which t he person knows was not
170-authorized in advance by the consumer;
