8787 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
8888 SECTION 1. AMENDATORY 21 O.S. 2021, Section 843.5, is

9090 Section 843.5. A. Any person who shall willfully or

223223 E. Any person responsible for the health, safety or wel fare of
224224 a child who shall willfully or maliciously engage in child sexu al
225225 abuse, as defined in this section, shall, upon conviction, be
226226 punished by imprisonment in the custody of the Department of
227227 Corrections not exceeding life imprisonment, or by imprison ment in a
228228 county jail not exceeding one (1) year, or by a fine of not l ess
229229 than Five Hundred Dollars ($500.00) nor more than Five Thousand
230230 Dollars ($5,000.00), or both such fine and imprisonment, exc ept as
231231 provided in Section 51.1a of this title or as othe rwise provided in
232232 subsection F of this section for a child victim under twelve (12)
233233 years of age. Except for persons sentenced to life or life with out
234234 parole, any person sentenced to imprisonment fo r two (2) years or
235235 more for a violation of this subsectio n shall be required to serve a
236236 term of post-imprisonment supervision pu rsuant to subparagraph f of
237237 paragraph 1 of subsection A of Section 991a of Ti tle 22 of the
238238 Oklahoma Statutes under conditions de termined by the Department of
239239 Corrections. The jury shall be advised that the mandatory post -
240240 imprisonment supervision shall be in addition to the actual
241241 imprisonment.
242242 F. Any person responsible for the he alth, safety or welfare of

306306 fine of not less than Five Hundred Dollars ($500.00) no r more than
307307 Five Thousand Dollars ($5,000.00), or both such fine and
308308 imprisonment.
309309 H. Any person who shall willfully or maliciously engage in
310310 child sexual exploitation , as defined in this section, shall, upon
311311 conviction, be punished by imprisonment in the custody of the
312312 Department of Corrections not exceedi ng life imprisonment, or by
313313 imprisonment in a county jail not exceed ing one (1) year, or by a
314314 fine of not less than Five Hundred Dollars ($500.00) nor m ore than
315315 Five Thousand Dollars ($5,000.00), or both such fine and
316316 imprisonment except as provided in sub section I of this section for
317317 a child victim under twelve (12) years of age. Except for persons
318318 sentenced to life or life without parole, any person se ntenced to

371371 subsection shall be required t o serve a term of post-imprisonment
372372 supervision pursuant to subparag raph f of paragraph 1 of subsection
373373 A of Section 991a of Title 22 of the Oklahoma St atutes under
374374 conditions determined by the Departmen t of Corrections. The jury

377377 I. Any person who shall willfully or maliciously engage in
378378 child sexual exploitation, as defined in this section , of a child
379379 under twelve (12) years of age shall, upon conviction, be punished
380380 by imprisonment in the custody of the Department of Corrections for
381381 not less than twenty -five (25) years nor more than life
382382 imprisonment, and by a fine of not less than Five Hu ndred Dollars
383383 ($500.00) nor more than Five Thousand Dollars ($5,000.00).
384384 J. Any person responsible for the health, s afety or welfare of
385385 a child who shall willfully or maliciously engage in enabling child
386386 sexual exploitation, as defined in this section , shall, upon
387387 conviction, be punished by imprisonment i n the custody of the
388388 Department of Corrections not exceeding life imprisonment, or by
389389 imprisonment in a county jail not exceeding one (1) year, or by a
390390 fine of not less than Five Hundred Dollars ($500.00) nor more than
391391 Five Thousand Dollars ($5,000.00), or both such fine and
392392 imprisonment.

444444 K. Notwithstanding any other provision of law, an y person
445445 convicted of forcible anal or oral sodomy, rape, rape by
446446 instrumentation, or lewd molestation of a child under f ourteen (14)
447447 years of age subsequent to a previou s conviction for any offense of
448448 forcible anal or oral sodomy, rap e, rape by instrumentation, or lewd
449449 molestation of a child under fourteen (14) years of age shall be
450450 punished by death or by imprisonment for life without parole.
451451 L. Provided, however, that nothing contained in this section
452452 shall prohibit any parent or g uardian from using reasonable and
453453 ordinary force pursuant to Section 844 of this title.
454454 M. Consent shall not be a defense for any violation pr ovided
455455 for in this section.
456456 N. Notwithstanding the age requirements of other statutes
457457 referenced within this s ection, this section shall apply to any
458458 child under eighteen (18) years of age.
459459 O. A person who is charged with willfully or maliciously
460460 engaging in enabling child abuse, enabling child neglect, enabling
461461 child sexual abuse, or enabling child sexual exploitation pursuant
462462 to the provisions of this section shall be entitled to assert the
463463 affirmative defense of duress by abuse if the person had a
464464 reasonable apprehension that acting to stop or preve nt the child
465465 abuse, child neglect, child sexual abuse or child sexual
466466 exploitation would result in imminent intimate partner abuse to
467467 himself or herself in retaliation.

519519 P. Duress by abuse may be shown by dir ect or indirect evidence
520520 including, but not limited to, medical testimony or evidence, expert
521521 testimony by a psychologist, psychiatrist , other expert witness or
522522 any combination thereof.
523523 Q. A person who successfully asserts the affirmative defense of
524524 duress by abuse when charged with willfully or maliciously engaging
525525 in enabling child abuse, enabling child neglect, enabling child
526526 sexual abuse, or enabling child sexual exploitation shall be ordered
527527 by the court to participate and complete a needs assessment and
528528 recovery plan.
529529 R. A person found guilty of willfully or maliciously engaging
530530 in enabling child abuse, enabling child neglect, enabling child
531531 sexual abuse, or enabling child sexual exploitation, who a sserts the
532532 affirmative defense of duress by abuse may be ordered by the court
533533 to participate and c omplete a needs assessment and recovery plan in
534534 lieu of a conviction and punishment at the discretion of the court.
535535 Provided, the court shall not order the p erson to participate and
536536 complete the needs assessment and recovery plan if the person
537537 refuses to cooperate in the criminal proceedings or the court makes
538538 specific findings that having the person participate and complete
539539 the needs assessment and recovery p lan in lieu of a conviction and
540540 punishment would create an undue risk to public safety or the
541541 health, safety, and welfare of the victim.

593593 S. A recovery plan shall not exceed two (2) years in length and
594594 shall consist of medica l, social and psychologi cal services as may
595595 be deemed beneficial to aid the person in the cessation of
596596 victimization, recovery fr om mental or physical abuse trauma or
597597 other needs identified bearing connection with the alleged abuse
598598 suffered by the person.
599599 T. 1. If a needs assessment and recovery plan is ordered by
600600 the court for a person convicted of willfully or maliciously
601601 engaging in enabling child abuse, enabling child neglect, enabling
602602 child sexual abuse, or enabling child sexual exploitation , the
603603 person shall have two (2) years to complete the court-approved
604604 recovery plan under the deferred sentencing procedure provided for
605605 in Section 991c of Title 22 of the Oklahoma Statu tes. The court may
606606 extend this time if the court determines that it is reasonable and
607607 necessary for the person to successfully complete the recovery plan.
608608 2. Should the person fail to complete the recovery p lan within
609609 two (2) years or if the person commits or enables the commis sion of
610610 any subsequent crime of child abuse, child neglect, child sexual
611611 abuse or child sexual exploitation, the person shall be sentenced
612612 for the offense as provided for in the provisions of this section.
613613 3. The needs assessment and recovery plan program shall be
614614 created by a private facility or organization that has been
615615 certified by the Office of the Attorney General as a certified
616616 domestic violence program or certified s exual assault program

668668 pursuant to the provisions of Section 18p-6 of Title 74 of the
669669 Oklahoma Statutes and shall be filed with the court. In
670670 consultation with the Depart ment of Human Services, the recovery
671671 plan shall address the recovery needs of any child associated with
672672 or living in the home of the person including home visitations by
673673 personnel of the Department of Human Services.
674674 U. Any person convicted of a misdemean or or felony under the
675675 provisions of subsections B, D, G or J of this section who, prior to
676676 the effective date of this act , would have been authorized to assert
677677 the defense of abuse by duress may file a petition for post-
678678 conviction relief without regard t o the limitations of Section 1086
679679 of Title 22 of the Oklahoma Statutes so long as the petition for
680680 post-conviction relief is filed within five (5 ) years of the
681681 effective date of this act. Upon filing the petition for post-
682682 conviction relief, the court shall retroactively apply the
683683 provisions of subsections M, N, O, P and Q of this section .
684684 V. The person accused of abusing the individual charged un der
685685 the provisions of su bsection B, D, G or J of this section shall be
686686 required to cover all costs of the needs assessment and recovery
687687 plan of the individual charged.
688688 O. W. As used in this section:
689689 1. "Child abuse" means:
690690 a. the willful or malicious harm or threatened harm or
691691 failure to protect from harm or threat ened harm to the

744744 (18) years of age by a person re sponsible for a
745745 child's health, safety or welfare, or
746746 b. the act of willfully or maliciously injuring,
747747 torturing or maiming a child under eighteen (18) years
748748 of age by any person ;
749749 2. "Child neglect" means the willful or malicious neglect, as
750750 defined by Section 1-1-105 of Title 10A of the Oklahom a Statutes, of
751751 a child under eighteen (18) years of age by a person responsible for
752752 a child's health, safety or welfare;
753753 3. "Child sexual abuse" means the willful or malicious sexual
754754 abuse of a child under eighteen (18) years of age by a person
755755 responsible for a child's health, safety or welfare and includes,
756756 but is not limited to:
757757 a. sexual intercourse,
758758 b. penetration of the vagin a or anus, however slight, by
759759 an inanimate object or any part of the human body not
760760 amounting to sexual intercourse,
761761 c. sodomy,
762762 d. incest, or
763763 e. a lewd act or proposal, as defined in this section;
764764 4. "Child sexual exploitation " means the willful or malicious
765765 sexual exploitation of a child under eighteen (18) years of age by
766766 another and includes, but is not limited to:

819819 this title, if the offense involved child trafficking
820820 for commercial sex,
821821 b. trafficking in children, as provided for in Section
822822 866 of this title, if the offense was com mitted for
823823 the sexual gratification of any person,
824824 c. procuring or causing the participation of a minor in
825825 child pornography, as provided for in Section 1021.2
826826 of this title,
827827 d. purchase, procurement or possession of child
828828 pornography, as provided for in S ection 1024.2 of this
829829 title,
830830 e. engaging in or soliciting prostitution, a s provided
831831 for in Section 1029 of this title, if the offense
832832 involved child prostitution,
833833 f. publication, distribution or participa tion in the
834834 preparation of obscene material, as prov ided for in
835835 Section 1040.8 of this title, if the offense involved
836836 child pornography,
837837 g. aggravated possession of child pornography, as
838838 provided for in Section 1040.1 2a of this title,
839839 h. sale or distribution of obscene material, as provided
840840 for in Section 1040.13 of this title,

892892 i. soliciting sexual conduct or communication with a
893893 minor by use of technology, as provided for in Section
894894 1043.13a of this title,
895895 j. offering or transporting a child for purposes o f
896896 prostitution, as provided for in Section 1087 of this
897897 title, and
898898 k. child prostitution, as provided for in Section 1088 of
899899 this title;
900900 5. "Enabling child abuse " means the causing, procuring or
901901 permitting of child abuse by a person responsible for a child's
902902 health, safety or welfare;
903903 6. "Enabling child neglect" means the causing, procuring or
904904 permitting of child neglect by a person responsible for a child's
905905 health, safety or welfare;
906906 7. "Enabling child sexua l abuse" means the causing, procuring
907907 or permitting of child sexual abuse by a person responsible for a
908908 child's health, safety or welfare;
909909 8. "Enabling child sexual explo itation" means the causing,
910910 procuring or permitting of child sexual exploitation by a person
911911 responsible for a child's health, safety or welfare;
912912 9. "Incest" means marrying, committi ng adultery or fornicating
913913 with a child by a person responsible for the health, safety or
914914 welfare of a child;

966966 10. "Intimate partner abuse" means a pattern or series of
967967 actions or omissions and verbal or nonverbal communication that are
968968 used to harm another person physically or mentally or to exert po wer
969969 and control over another pe rson. Intimate partner abuse may include
970970 one or more of the following acts:
971971 a. Physical violence,
972972 b. Sexual violence,
973973 c. Stalking,
974974 d. Psychological aggression , or
975975 e. Use of coercive tactics.
976976 Intimate partner abuse may be co mmitted by a current or former

978978 10. 11. "Lewd act or proposal" means:
979979 a. making any oral, written or electronic or computer-

983983 b. looking upon, touching, mauling or feeling the body or
984984 private parts of a child in a lewd or la scivious
985985 manner or for the purpose of sexual gratific ation,
986986 c. asking, inviting, enticing or persuading any child to

11971197 responsible for a child's health, safety or welfare,
11981198 by the mouth of a child,
11991199 c. penetration, however slight, of the mouth o f the
12001200 person responsible for a child's health, safety or
12011201 welfare by the penis of the child , or
12021202 d. penetration, however s light, of the vagina of the
12031203 child by the mouth of the person responsible for a
12041204 child's health, safety or welfare.
12051205 SECTION 2. This act shall become effective November 1, 2023.
