65	65	An Act relating to the Oklahoma State Guard; am ending
66	66	44 O.S. 2021, Section 242, wh ich relates to the
67	67	distinction between the Oklahoma State Guard and the
68	68	Oklahoma National Guard; updating statutory language;
69	69	transferring certain p ositions and resources upon
70	70	removal of recognition; and providing an eff ective

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 44 O.S. 2021, Section 242, is
79	79	amended to read as follows:
80	80	Section 242. A. Such military forces shall be designated as
81	81	the “Oklahoma State Guard” and shall be composed of officers
82	82	commissioned or assign ed, and such able-bodied male citizens of the
83	83	state as shall volunteer for service therein. They shall be
84	84	additional to and distin ct from the Oklahoma National Guard of the
85	85	State of Oklahoma, as defined in Title 32 of the United States Code.
86	86	They shall not be req uired to serve outside the boundaries of the
87	87	State of Oklahoma this state.

139	139	B. If, for any reason, t he Department of Defense removes
140	140	national recognition from the Oklahoma National Guard, all
141	141	resources, officers, employees, positions, and funds shall be
142	142	transferred immediately to the Oklahoma State Guard.
143	143	SECTION 2. This act shall become effective November 1, 2023.
