AS INTRODUCED 
 
An Act relating to the Oklahoma State Guard; am ending 
44 O.S. 2021, Section 242, wh ich relates to the 
distinction between the Oklahoma State Guard and the 
Oklahoma National Guard; updating statutory language; 
transferring certain p ositions and resources upon 
removal of recognition; and providing an eff ective 
date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY    44 O.S. 2021, Section 242, is 
amended to read as follows: 
Section 242. A. Such military forces shall be designated as 
the “Oklahoma State Guard” and shall be composed of officers 
commissioned or assign ed, and such able-bodied male citizens of the 
state as shall volunteer for service therein.  They shall be 
additional to and distin ct from the Oklahoma National Guard of the 
State of Oklahoma, as defined in Title 32 of the United States Code.  
They shall not be req uired to serve outside the boundaries of the 
State of Oklahoma this state.

B.  If, for any reason, t he Department of Defense removes 
national recognition from the Oklahoma National Guard, all 
resources, officers, employees, positions, and funds shall be 
transferred immediately to the Oklahoma State Guard. 
SECTION 2.  This act shall become effective November 1, 2023.
