5455 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5556 SECTION 1. AMENDATORY 70 O.S. 2021, Section 18 -114.14,
5657 is amended to read as follows:
5758 Section 18-114.14. A. Beginning with the 2018 -2019 school
5859 year, certified personnel, as defined in Secti on 26-103 of this
5960 title, in the public schools of Oklahoma shall receive in salary
6061 and/or fringe benefits not less than the amounts specified in the
6162 following schedule:

199203 B. 1. When determining the Minimum Salary Schedule, “fringe
200204 benefits” shall mean all or part of retirement benefits, exc luding
201205 the contributions made pursuant to subsection A of Section 17 -108.1
202206 of this title and the flexible benefit allowance pursuant to Section
203207 26-105 of this title from the flexible benefit allowance funds
204208 disbursed by the State Board of Education and the State Board of
205209 Career and Technology Education pursuant to Section 26 -104 of this
206210 title.
207211 2. If a school district intends to provid e retirement benefits
208212 to a teacher such that the teacher ’s salary would be less than the
209213 amounts set forth in the minimum sa lary schedule specified in
210214 subsection A of this section, the district shall be required to
211215 provide written notification to the teach er prior to his or her
212216 employment or, if already employed by the district, no later than
213217 thirty (30) days prior to the date the district elects to provide

240245 retirement benefits such that the teacher ’s salary would be less
241246 than the minimum salary schedule.
242247 C. Any of the degrees referred to in this section shall be from
243248 a college recognized by the State Board of Education. The Bo ard
244249 shall accept teaching experience from out -of-state school districts
245250 that are accredited by the state board of education or appro priate
246251 state accrediting agency for the districts. The Board shall accept
247252 teaching experience from out -of-country schools that are accredited
248253 or otherwise endorsed by the appropriate national or regional
249254 accrediting or endorsement authority. Out -of-country certification
250255 documentation in a language other than English shall be analyzed by
251256 an educational credential evaluation se rvice in accordance with
252257 industry standards and guidelines and approved by the State
253258 Department of Education. The person seeking to have credit granted
254259 for out-of-country teaching experience shall be responsible for all
255260 costs of the analysis by a credenti al evaluation service. The Board
256261 shall accept teaching experience from primary and secondary schools
257262 that are operated by the Unite d States Department of Defense or are
258263 affiliated with the United States Department of State.
259264 D. 1. For the purpose of state sa lary increments and
260265 retirement, no teacher shall be granted credit for more than five
261266 (5) years of active duty in the military s ervice or out-of-state or
262267 out-of-country teaching experience as a certified teacher or its
263268 equivalent.

290296 2. For the purpose of state salary increments, no teacher shall
291297 be granted credit for more than ten (10) years of active duty in the
292298 military service. For the purposes of retirement, no teacher shall
293299 be granted credit for more than five (5) years of active duty in the
294300 military service.
295301 Nothing in this section shall prohibit boards of education from
296302 crediting more years of experience on district salary schedules than
297303 those allowed for state purposes.
298304 E. The State Board of Education shall recognize, for purposes
299305 of certification and salary increments, all the ye ars of experience
300306 of a:
301307 1. Certified teacher who teaches in the educational program of
302308 the Department of Corrections, beginning with fiscal year 1981;
303309 2. Vocational rehabilitation counselor under the Department of
304310 Human Services if the counselor was empl oyed as a certified teacher
305311 by the State Department of Education when the Division of Vocation al
306312 Rehabilitation was transferred from the State Board of Career and
307313 Technology Education or the State Board of Education to the Oklahoma
308314 Public Welfare Commissio n on July 1, 1968;
309315 3. Vocational rehabilitation counselor which were completed
310316 while employed by the Department of Human Services if such counselor
311317 was certified as a teacher or was eligible for certification as a
312318 teacher in Oklahoma;

339346 4. Certified teache r which were completed while employed by the
340347 Child Study Center located at University Hospital , if the teacher
341348 was certified as a teacher in Oklahoma; and
342349 5. Certified school psychologist or psychometrist which were
343350 completed while employed as a doctoral intern, psychological
344351 assistant, or psychologist with any agency of the State of Oklahoma
345352 this state if the experience primarily involved work with persons of
346353 school- or preschool-age and if the person was, at the time the
347354 experience was acquired, certified as, or el igible for certification
348355 as, a school psychologist or psychometrist.
349356 F. The provisions of this section shall not apply to teachers
350357 who have entered into postretirement employment with a public school
351358 in Oklahoma and are still receiving a monthly retiremen t benefit.
352359 G. If a person employed as certified personnel, as defined in
353360 Section 26-103 of this title, by a school district during the 2017 -
354361 2018 school year was receiving a salary above the step level
355362 indicated by the State Minimum Salary Schedule for the 2017-2018
356363 school year, the person shall receive a salary increase amount equal
357364 to the amount indicated in subsection A for the step level indicated
358365 for the person, provided they remain employed by the same district,
359366 unless the hours or the duties of the c ertified personnel are
360367 reduced proportionately.
361368 SECTION 2. This act shall become effective July 1, 2023.

388396 SECTION 3. It being immediately necessary for the preservation

390398 declared to exist, by reason whereof thi s act shall take effect and
