54	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	56		SECTION 1. AMENDATORY 70 O.S. 2021, Section 18 -114.14,
56	57		is amended to read as follows:
57	58		Section 18-114.14. A. Beginning with the 2018 -2019 school
58	59		year, certified personnel, as defined in Secti on 26-103 of this
59	60		title, in the public schools of Oklahoma shall receive in salary
60	61		and/or fringe benefits not less than the amounts specified in the
61	62		following schedule:

199	203		B. 1. When determining the Minimum Salary Schedule, “fringe
200	204		benefits” shall mean all or part of retirement benefits, exc luding
201	205		the contributions made pursuant to subsection A of Section 17 -108.1
202	206		of this title and the flexible benefit allowance pursuant to Section
203	207		26-105 of this title from the flexible benefit allowance funds
204	208		disbursed by the State Board of Education and the State Board of
205	209		Career and Technology Education pursuant to Section 26 -104 of this
206	210		title.
207	211		2. If a school district intends to provid e retirement benefits
208	212		to a teacher such that the teacher ’s salary would be less than the
209	213		amounts set forth in the minimum sa lary schedule specified in
210	214		subsection A of this section, the district shall be required to
211	215		provide written notification to the teach er prior to his or her
212	216		employment or, if already employed by the district, no later than
213	217		thirty (30) days prior to the date the district elects to provide

240	245		retirement benefits such that the teacher ’s salary would be less
241	246		than the minimum salary schedule.
242	247		C. Any of the degrees referred to in this section shall be from
243	248		a college recognized by the State Board of Education. The Bo ard
244	249		shall accept teaching experience from out -of-state school districts
245	250		that are accredited by the state board of education or appro priate
246	251		state accrediting agency for the districts. The Board shall accept
247	252		teaching experience from out -of-country schools that are accredited
248	253		or otherwise endorsed by the appropriate national or regional
249	254		accrediting or endorsement authority. Out -of-country certification
250	255		documentation in a language other than English shall be analyzed by
251	256		an educational credential evaluation se rvice in accordance with
252	257		industry standards and guidelines and approved by the State
253	258		Department of Education. The person seeking to have credit granted
254	259		for out-of-country teaching experience shall be responsible for all
255	260		costs of the analysis by a credenti al evaluation service. The Board
256	261		shall accept teaching experience from primary and secondary schools
257	262		that are operated by the Unite d States Department of Defense or are
258	263		affiliated with the United States Department of State.
259	264		D. 1. For the purpose of state sa lary increments and
260	265		retirement, no teacher shall be granted credit for more than five
261	266		(5) years of active duty in the military s ervice or out-of-state or
262	267		out-of-country teaching experience as a certified teacher or its
263	268		equivalent.

290	296		2. For the purpose of state salary increments, no teacher shall
291	297		be granted credit for more than ten (10) years of active duty in the
292	298		military service. For the purposes of retirement, no teacher shall
293	299		be granted credit for more than five (5) years of active duty in the
294	300		military service.
295	301		Nothing in this section shall prohibit boards of education from
296	302		crediting more years of experience on district salary schedules than
297	303		those allowed for state purposes.
298	304		E. The State Board of Education shall recognize, for purposes
299	305		of certification and salary increments, all the ye ars of experience
300	306		of a:
301	307		1. Certified teacher who teaches in the educational program of
302	308		the Department of Corrections, beginning with fiscal year 1981;
303	309		2. Vocational rehabilitation counselor under the Department of
304	310		Human Services if the counselor was empl oyed as a certified teacher
305	311		by the State Department of Education when the Division of Vocation al
306	312		Rehabilitation was transferred from the State Board of Career and
307	313		Technology Education or the State Board of Education to the Oklahoma
308	314		Public Welfare Commissio n on July 1, 1968;
309	315		3. Vocational rehabilitation counselor which were completed
310	316		while employed by the Department of Human Services if such counselor
311	317		was certified as a teacher or was eligible for certification as a
312	318		teacher in Oklahoma;

339	346		4. Certified teache r which were completed while employed by the
340	347		Child Study Center located at University Hospital , if the teacher
341	348		was certified as a teacher in Oklahoma; and
342	349		5. Certified school psychologist or psychometrist which were
343	350		completed while employed as a doctoral intern, psychological
344	351		assistant, or psychologist with any agency of the State of Oklahoma
345	352		this state if the experience primarily involved work with persons of
346	353		school- or preschool-age and if the person was, at the time the
347	354		experience was acquired, certified as, or el igible for certification
348	355		as, a school psychologist or psychometrist.
349	356		F. The provisions of this section shall not apply to teachers
350	357		who have entered into postretirement employment with a public school
351	358		in Oklahoma and are still receiving a monthly retiremen t benefit.
352	359		G. If a person employed as certified personnel, as defined in
353	360		Section 26-103 of this title, by a school district during the 2017 -
354	361		2018 school year was receiving a salary above the step level
355	362		indicated by the State Minimum Salary Schedule for the 2017-2018
356	363		school year, the person shall receive a salary increase amount equal
357	364		to the amount indicated in subsection A for the step level indicated
358	365		for the person, provided they remain employed by the same district,
359	366		unless the hours or the duties of the c ertified personnel are
360	367		reduced proportionately.
361	368		SECTION 2. This act shall become effective July 1, 2023.
