3263 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3464 SECTION 1. NEW LAW A new section of law to be codified
3565 in the Oklahoma Statutes as Section 1210.508-6 of Title 70, unless
3666 there is created a duplication in numb ering, reads as follows:

3867 A. Except as provided for in subsection B of this section,
3968 beginning with the 2024-2025 school year, in order to graduate from
4069 a public high school accredi ted by the State Board of Education,

4197 students shall complete and submit a Free Application for Federal
4298 Student Aid (FAFSA).

4499 B. A student shall not be required to comply with the
45100 provisions of subsection A of this section if:

49101 1. The student’s parent or legal guardian submits a signed form
50102 authorizing the student to opt out of the re quirement of subsection
51103 A of this section;

53104 2. A student age eighteen (18) or old er submits a signed form
54105 authorizing him or her to opt out of the requirement of subsection A
55106 of this section; or

57107 3. A school counselor authorizes a student to opt out of the
58108 requirement of subsection A of this sec tion.

60109 C. The State Depart ment of Education shall develop and publish :

62110 1. Materials for students, parents, and legal guardians
63111 explaining the requirements to complete the FAFSA , the benefits to
64112 completing the FAFSA , and the opt-out provisions described in
65113 subsection B of this section ; and

67114 2. An opt-out form to be used by school districts, charter
68115 schools, and virtual charter schools for t he purposes outlined in
69116 subsection B of this section.

71117 D. The superintendent of each school district in thi s state
72118 shall designate a school emp loyee to collect information regarding
73119 student compliance with subsection A or B of this section. The

74147 collection and storage of the information shall comply with the
75148 Family Educational Rights and Privacy Act of 1974 (FERPA ).

77149 E. The State Board of Education shall promulga te rules to
78150 implement the provis ions of this section, which shall address the
79151 method by which a student is to provide proof to a school district,
80152 public charter school, or vir tual charter school that the student
81153 has completed and submitted the FAFSA as req uired by subsection A of
82154 this section.

84155 SECTION 2. This act shall become eff ective July 1, 2023.

86156 SECTION 3. It being immediately necessary for the preservation
87157 of the public peace, h ealth, or safety, an emergency is hereby
88158 declared to exist, by reason whe reof this act shall take effect and
89159 be in full force from an d after its passage and approval.
