77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 13001 of Title 74, unless there
80	80	is created a duplication in numb ering, reads as follows:
81	81	A. As used in this section, “environmental, social, and
82	82	governance (ESG) criteria” or “economically targeted investment
83	83	(ETI) requirements” means using a set of standards to screen
84	84	potential investments based on a perceived impact to the
85	85	environment, social-oriented relationships with and between
86	86	employees and the community, and how company leadership is
87	87	structured in support of these standards.

139	139	B. The use of environmental, social, and governance criteria or
140	140	economically targeted investment requirements in this state shall be
141	141	prohibited. No governmental entity including but not limited to
142	142	this state, any state agency, political subdivision, any trust,
143	143	committee, or commission of any poli tical subdivision of this state,
144	144	and business operating in t his state, or any citizen of this state
145	145	or individual within the boundaries of this sta te, shall use,
146	146	promote, enforce, provide data for use in, or otherwise participate
147	147	in the creation or use of ESG or ETI policies related to hiring,
148	148	firing, and evaluation of employees.
149	149	C. ESG, ETI, or related criteria shall not be considered in the
150	150	awarding of state contracts. Any comp any, organization, or e ntity
151	151	vying for a state contract must state that its employees will not be
152	152	subject to personal ESG, ETI, or related scoring as a basis of
153	153	hiring, firing, and evaluation.
154	154	SECTION 2. It being immediately necessary for the preservation
155	155	of the public peace, health or safety, an emergency is hereby
156	156	declared to exist, by reason whereof this act shall take e ffect and
157	157	be in full force from and after its passage and approval.
