7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 13001 of Title 74, unless there
8080 is created a duplication in numb ering, reads as follows:
8181 A. As used in this section, “environmental, social, and
8282 governance (ESG) criteria” or “economically targeted investment
8383 (ETI) requirements” means using a set of standards to screen
8484 potential investments based on a perceived impact to the
8585 environment, social-oriented relationships with and between
8686 employees and the community, and how company leadership is
8787 structured in support of these standards.

139139 B. The use of environmental, social, and governance criteria or
140140 economically targeted investment requirements in this state shall be
141141 prohibited. No governmental entity including but not limited to
142142 this state, any state agency, political subdivision, any trust,
143143 committee, or commission of any poli tical subdivision of this state,
144144 and business operating in t his state, or any citizen of this state
145145 or individual within the boundaries of this sta te, shall use,
146146 promote, enforce, provide data for use in, or otherwise participate
147147 in the creation or use of ESG or ETI policies related to hiring,
148148 firing, and evaluation of employees.
149149 C. ESG, ETI, or related criteria shall not be considered in the
150150 awarding of state contracts. Any comp any, organization, or e ntity
151151 vying for a state contract must state that its employees will not be
152152 subject to personal ESG, ETI, or related scoring as a basis of
153153 hiring, firing, and evaluation.
154154 SECTION 2. It being immediately necessary for the preservation
155155 of the public peace, health or safety, an emergency is hereby
156156 declared to exist, by reason whereof this act shall take e ffect and
157157 be in full force from and after its passage and approval.
