AS INTRODUCED 
 
An Act relating to environmental, social, and 
governance; defining terms; prohibiting use of 
environmental, social, and governance investment 
criteria by governmental entities, political 
subdivisions, businesses, or persons; prohibiting 
certain contracts with certain businesses; providing 
for codification; and declaring an emergency . 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 13001 of Title 74, unless there 
is created a duplication in numb ering, reads as follows: 
A.  As used in this section, “environmental, social, and 
governance (ESG) criteria” or “economically targeted investment 
(ETI) requirements” means using a set of standards to screen 
potential investments based on a perceived impact to the 
environment, social-oriented relationships with and between 
employees and the community, and how company leadership is 
structured in support of these standards.

B.  The use of environmental, social, and governance criteria or 
economically targeted investment requirements in this state shall be 
prohibited. No governmental entity including but not limited to 
this state, any state agency, political subdivision, any trust, 
committee, or commission of any poli tical subdivision of this state, 
and business operating in t his state, or any citizen of this state 
or individual within the boundaries of this sta te, shall use, 
promote, enforce, provide data for use in, or otherwise participate 
in the creation or use of ESG or ETI policies related to hiring, 
firing, and evaluation of employees. 
C.  ESG, ETI, or related criteria shall not be considered in the 
awarding of state contracts.  Any comp any, organization, or e ntity 
vying for a state contract must state that its employees will not be 
subject to personal ESG, ETI, or related scoring as a basis of 
hiring, firing, and evaluation. 
SECTION 2.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take e ffect and 
be in full force from and after its passage and approval.
