SENATE JOINT 
RESOLUTION 10 	By: Hamilton 
 
 
 
 
AS INTRODUCED 
 
A Joint Resolution directing the Secretary of State 
to refer to the peopl e for their approval or 
rejection a proposed amendme nt to Section 1 of 
Article XXII of the Oklahoma Constitution; 
prohibiting certain own ership of land through 
business entity or trust; decreasing allowable time 
period for dispositi on of certain property; modifying 
exception to certain ownership requirements; 
providing ballot title; and directing filing . 
 
 
 
 
 
BE IT RESOLVED BY THE SENAT E AND THE HOUSE OF REPRESENTATIVES OF THE 
1st SESSION OF THE 59TH OKLAHOMA LEGISLATURE: 
SECTION 1.  The Secretary of State shall refer to the people fo r 
their approval or rejection, as and in the manner provided by law, 
the following proposed amendment to S ection 1 of Article XXII of the 
Oklahoma Constitution to read as follows: 
Section 1.  No alien or person who is not a foreign citizen of 
the United States, shall acquire title to or own land in this state 
either directly or indirectly through a business entity or trust , 
and the Legislature shall enact laws whereby all persons not who are 
foreign citizens of the United States, and their heirs, who may

hereafter acquire real estate in this state by devise, descent, or 
otherwise, shall dispose of the same within five years one (1) year 
upon condition of escheat or forfeiture to the State:  Provided, 
This shall not apply to Indians born within the United Sta tes, nor 
to aliens or persons not citizens of the United States who may 
become bona fide residents of this State :  And Provided Further, 
That this section shall not apply to lands now owned by aliens in 
this State. 
SECTION 2.  The Ballot Title for the proposed Consti tutional 
amendment as set forth in SECTION 1 of this resolution shall be in 
the following form:

Legislative Referendum N o. ____ State Question No. ____ 
THE GIST OF THE PROPOSITION IS AS FOLLOWS : 
This measure will ame nd Section 1 of Article 22 of the Oklahoma 
Constitution.  The measure will pr ohibit ownership of land in 
Oklahoma by a foreign citizen or a business entity or trust 
owned by foreign citizens .  The measure will decrease to 1 year 
the time period for such land to be returned to the state.  The 
measure provides an exception to lawful resident foreign 
citizens. 
SHALL THE PROPOSAL BE APPROVED?

SECTION 3.  The President Pro Tempore of the Senate shall, 
immediately after the passage of this r esolution, prepare and file 
one copy thereof, including the Ballot Titl e set forth in SECTION 2 
hereof, with the Secretary of State and one copy with the Attorney 
General.
