3865 BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE
3966 2ND SESSION OF THE 59TH OKLAHOMA LEGISLATURE:

4167 SECTION 1. The Secretary of State shall refer to the people for
4268 their approval or rejection, as and in the manner provided by law,
4369 the following proposed amendment to the Oklahoma Constitution by
4470 adding a new Section 9E to Article X to read as follows:

4898 Section 9E. A. There are hereby cr eated public infrastructure

51100 B. Municipalities may approve the creation of public
52101 infrastructure districts, which may incur indebtedness and issue
53102 public infrastructure district bonds to pay for all or part of the
54103 cost of public improvements wit hin such districts. The cost of all
55104 indebtedness so incurred shall be levied and assessed by the board
56105 of trustees of a public infrastructure district on the property
57106 benefited by such improvements following the passage and approval of
58107 the organization of a public infrastructure district pursuant to
59108 subsection C of this section. The boar d shall collect the special
60109 assessments so levied and use the same to reimburse the public
61110 infrastructure district for the amount paid or to be paid by it on
62111 the bonds issued for such improvements not to exceed ten (10) mills
63112 for the purpose of providing funds for the purpose of support,
64113 organization, operation, and maintenance of such services.

66114 C. A public infrastructure district shall not be created unless
67115 a petition is filed with the municipality that contains the
68116 signatures of one hundred percent (100% ) of surface propert y owners
69117 within the applicable area consenting to the creation of the public
70118 infrastructure district.

72119 D. The municipality may impose limitations on th e powers of the
73120 public infrastructure district through the governing document
74121 presented by the public inf rastructure district applicant.

76149 E. The levy shall be in addition to all other levies authorized
77150 by this Constitution, and when approved, shall be made for the
78151 repayment of public infrastructure district bonds issued by the
79152 public infrastructure districts for the public improvements agreed
80153 upon by the voters of the district as provided by the governing

83155 F. The Legislature shall be authorized to enact such laws as
84156 may be necessary in order to implement public infrastructure
85157 districts in this state.

99164 This measure adds a new section of law to the Oklahoma
100165 Constitution. It adds Section 9E to Article 10. It allows for
101166 the creation of public infrastructure districts. It provides
102167 for the issuance of public infrastructure district bonds by the
103168 public infrastructure district to pay for all or part of all
104169 public improvements implemented by and for the public
105170 infrastructure district. It requires a one-hundred-percent
106171 approval of surface property owners in the district to become
107172 created.
