103101 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
104102 SECTION 1. NEW LAW A new section of law to be codified
105103 in the Oklahoma Statutes as Section 1501 of Title 60, unless there
106104 is created a duplication in numbering, reads as follows:
107105 This act shall be known and may be cited as the "Oklahoma
108106 Uniform Easement Relocation Act of 2025 ".
109107 SECTION 2. NEW LAW A new section of law to be codified
110108 in the Oklahoma Statutes as Section 1502 of Title 60, unless there
111109 is created a duplication in numbering, reads as follows:
112110 As used in this act:
113111 1. "Appurtenant easement " means an easement tied to or
114112 dependent on ownership or occupancy of a unit or a parcel of real
115113 property;
116114 2. "Conservation easement " means a nonpossessory prop erty
117115 interest created for one or more of the following conservation
118116 purposes:
119117 a. retaining or protecting the natural, scenic, wildlife,
120118 wildlife-habitat, biological, ecological, or open -
121119 space values of real property ,
122120 b. ensuring the availability of real pr operty for
123121 agricultural, forest, outdoor -recreational, or open -
124122 space uses,
125123 c. protecting natural resources, including wetlands,
126124 grasslands, and riparian areas ,

154151 d. maintaining or enhancing air or water quality , or
155152 e. preserving the historical, architectural ,
156153 archeological, paleontological, or cultural aspects of
157154 real property;
158155 3. "Dominant estate" means an estate or interest in real
159156 property benefitted by an appurtenant easement ;
160157 4. "Easement" means a nonpossessory property interest that:
161158 a. provides a right to enter, use, or enjoy real property
162159 owned by or in the possession of another , and
163160 b. imposes on the owner or possessor a duty not to
164161 interfere with the entry, use, or enjoyment permitted
165162 by the instrument creating the easement or, in the
166163 case of an easement not established by express grant
167164 or reservation, the entry, use, or enjoyment
168165 authorized by law;
169166 5. "Easement holder" means:
170167 a. in the case of an appurtenant easement, the dominant
171168 estate owner, or
172169 b. in the case of an easement in gross, public -utility
173170 easement, conservation easement, or negative easement,
174171 the grantee of the easement or a successor ;
175172 6. "Easement in gross" means an easement not tied to or
176173 dependent on ownership or occupancy of a unit or a parcel of real

205201 7. "Lessee of record" means a person holding a lessee 's
206202 interest under a recorded lease or memorandum of lease ;
207203 8. "Negative easement" means a nonpossessory property interest
208204 whose primary purpose is to impose on a servient estate owner a duty
209205 not to engage in a specified use of the estate;
210206 9. "Person" means an individual, estate, business or nonprofit
211207 entity, public corporation, government or governmental subdivision,
212208 agency, or instrumentality, or other legal entity ;
213209 10. "Public-utility easement" means a nonpossessory p roperty
214210 interest in which the easement holder is a publicly regulated or
215211 publicly owned utility under federal law or law of this state or a
216212 municipality. The term includes an easement benefiting an
217213 intrastate utility, an interstate utility, or a utility c ooperative;
218214 11. "Real property" means an estate or interest in, over, or
219215 under land, including structures, fixtures, and other things that by
220216 custom, usage, or law pass with a conveyance of land whether or not
221217 described or mentioned in the contract of sal e or instrument of
222218 conveyance. The term includes the interest of a lessor and lessee
223219 and, unless the interest is personal property under law of this
224220 state other than this act, an interest in a common -interest
225221 community;
226222 12. "Record", used as a noun, mean s information that is
227223 inscribed on a tangible medium or that is stored in an electronic or
228224 other medium and is retrievable in perceivable form ;

256251 13. "Security instrument" means a mortgage, deed of trust,
257252 security deed, contract for deed, lease, or other re cord that
258253 creates or provides for an interest in real property to secure
259254 payment or performance of an obligation, whether by acquisition or
260255 retention of a lien, a lessor 's interest under a lease, or title to
261256 the real property. The term includes:
262257 a. a security instrument that also creates or provides
263258 for a security interest in personal property ,
264259 b. a modification or amendment of a security instrument ,
265260 and
266261 c. a record creating a lien on real property to secure an
267262 obligation under a covenant running with the real
268263 property or owed by a unit owner to a common -interest
269264 community association ;
270265 14. "Security-interest holder of record " means a person holding
271266 an interest in real property created by a recorded security
272267 instrument;
273268 15. "Servient estate" means an estate or interest in real
274269 property that is burdened by an easement ;
275270 16. "Title evidence" means a title insurance policy,
276271 preliminary title report or binder, title insurance commitment,
277272 abstract of title, attorney 's opinion of title based on examination
278273 of public records or an abstract of title, or any other means of

307301 the locality;
308302 17. "Unit" means a physical portion of a common -interest
309303 community designated for separate ownership or occupancy with
310304 boundaries described in a declaration establishing the common -
311305 interest community; and
312306 18. "Utility cooperative" means a non-profit entity whose
313307 purpose is to deliver a utility service, such as electricity, oil,
314308 natural gas, water, sanitary sewer, sto rm water, or
315309 telecommunications, to its customers or members and includes an
316310 electric cooperative, rural electric cooperative, rural water
317311 district, and rural water association.
318312 SECTION 3. NEW LAW A new section of law to be codified
319313 in the Oklahoma Statutes as Section 1503 of Title 60, unless there
320314 is created a duplication in numbering, reads as follows:
321315 A. Except as otherwise provided in subsection B of this
322316 section, this act applies to an easement established by express
323317 grant or reservation or by prescription, implication, necessity,
324318 estoppel, or other method.
325319 B. This act may not be used to relocate:
326320 1. A public-utility easement, conservation easement, or
327321 negative easement; or
328322 2. An easement if the proposed location would e ncroach on an
329323 area of an estate burdened by a conservation easement or would

357350 interfere with the use or enjoyment of a public-utility easement or
358351 an easement appurtenant to a conservation easement.
359352 C. This act does not apply to relocation of an easement by
360353 consent.
361354 SECTION 4. NEW LAW A new section of law to be codified
362355 in the Oklahoma Statutes as Section 1504 of Title 60, unless there
363356 is created a duplication in numbering, reads as follows:
364357 A servient estate owner may relocate a n easement under this act
365358 only if the relocation does not materially:
366359 1. Lessen the utility of the easement;
367360 2. After the relocation, increase the burden on the easement
368361 holder in its reasonable use and enjoyment of the easement;
369362 3. Impair an affirmative, easement-related purpose for which
370363 the easement was created;
371364 4. During or after the relocation, impair the safety of the
372365 easement holder or another entitled to use and enjoy the easement;
373366 5. During the relocation, disrupt the use and enjoyment of the
374367 easement by the easement holder or another entitled to use and enjoy
375368 the easement, unless the servient estate owner substantially
376369 mitigates the duration and nature of the disruption;
377370 6. Impair the physical condition, use, or value of the dominant
378371 estate or improvements on the dominant estate; or
379372 7. Impair the value of the collateral of a security -interest
380373 holder of record in the servient estate or dominant estate, impair a

408400 real-property interest of a lessee of record in the dominant estate,
409401 or impair a recorded real-property interest of any other person in
410402 the servient estate or dominant estate.
411403 SECTION 5. NEW LAW A new section of law to be codified
412404 in the Oklahoma Statutes as Section 1505 of Title 60, unless there
413405 is created a duplication in numbering, reads as follows:
414406 A. To obtain an order to relocate an easement under this act, a
415407 servient estate owner must commence a civil action.
416408 B. A servient estate owner that commences a civil action under
417409 subsection A of this section:
418410 1. Shall serve a summons and petition on:
419411 a. the easement holder whose easement is the subject of
420412 the relocation,
421413 b. a security-interest holder of record of an interest in
422414 the servient estate or dominant estate ,
423415 c. a lessee of record of an interest in the domi nant
424416 estate, and
425417 d. except as otherwise provided in paragraph 2 of this
426418 subsection, any other owner of a recorded real -
427419 property interest if the relocation would encroach on
428420 an area of the servient estate or dominant estate
429421 burdened by the interest ; and
430422 2. Is not required to serve a summons and petition on the owner
431423 of a recorded real-property interest in oil, gas, or minerals unless

459450 the interest includes an easement to facilitate oil, gas, or mineral
460451 development.
461452 C. A petition under this section must stat e:
462453 1. The intent of the servient estate owner to seek the
463454 relocation;
464455 2. The nature, extent, and anticipated dates of commencement
465456 and completion of the proposed relocation;
466457 3. The current and proposed locations of the easement;
467458 4. The reason the easement is eligible for relocation under
468459 Section 3 of this act;
469460 5. The reason the proposed relocation satisfies the conditions
470461 for relocation under Section 4 of this act; and
471462 6. That the servient estate owner has made a reasonable attempt
472463 to notify the holders of any public-utility easement, conservation
473464 easement, or negative easement on the servient estate or dominant
474465 estate of the proposed relocation.
475466 D. At any time before the court renders a final order in an
476467 action under subsection A of this section, a person served under
477468 subparagraph b, c, or d of subsection B of this section may file a
478469 document, in recordable form, that waives its rights to contest or
479470 obtain relief in connection with the relocation or subordinates its
480471 interests to the relocation. On filing of the document, the court
481472 may order that the person is not required to answer or participate
482473 further in the action.

510500 SECTION 6. NEW LAW A new section of law to be codified
511501 in the Oklahoma Statutes as Section 1506 of Title 60, unless there
512502 is created a duplication in numbering, reads as follows:
513503 A. The court may not approve relocation of an easement under
514504 this act unless the servient estate owner:
515505 1. Establishes that the easement is eligible for relocation
516506 under Section 3 of th is act; and
517507 2. Satisfies the conditions for relocation under Section 4 of
518508 this act.
519509 B. An order under this act approving relocation of an easement
520510 must:
521511 1. State that the order is issued in accordance with this act;
522512 2. Recite the recording data of the instrument creating the
523513 easement, if any, and any amendments, and any notice as described by
524514 Section 71 of Title 16 of the Oklahoma Statutes;
525515 3. Identify the immediately preceding location of the easement;
526516 4. Describe in a legally sufficient manner the n ew location of
527517 the easement;
528518 5. Describe mitigation required of the servient estate owner
529519 during relocation;
530520 6. Refer in detail to the plans and specifications of
531521 improvements necessary for the easement holder to enter, use, and
532522 enjoy the easement in the new location;

560549 7. Specify conditions to be satisfied by the servient estate
561550 owner to relocate the easement and construct improvements necessary
562551 for the easement holder to enter, use, and enjoy the easement in the
563552 new location;
564553 8. Include a provision for payment by the servient estate owner
565554 of expenses under Section 7 of this act;
566555 9. Include a provision for compliance by the parties with the
567556 obligation of good faith under Section 8 of this act; and
568557 10. Instruct the servient estate owner to record an affi davit,
569558 if required under subsection A of Section 9 of this act, when the
570559 servient estate owner substantially completes relocation.
571560 C. An order under subsection B of this section may include any
572561 other provision consistent with this act for the fair and equ itable
573562 relocation of the easement.
574563 D. Before a servient estate owner proceeds with relocation of
575564 an easement under this act, the owner must record, in the county
576565 records of each jurisdiction where the servient estate is located, a
577566 certified copy of the or der under subsection B of this section.
578567 SECTION 7. NEW LAW A new section of law to be codified
579568 in the Oklahoma Statutes as Section 1507 of Title 60, unless there
580569 is created a duplication in numbering, reads as follows:
581570 A servient estate owner is responsible for reasonable expenses
582571 of relocation of an easement under this act, including the expense
583572 of:

612600 estate in accordance with an order under Section 6 of this act;
613601 2. During the relocation, mitigating disruption in the use and
614602 enjoyment of the easement by the easement holder or another person
615603 entitled to use and enjoy the easement;
616604 3. Obtaining a governmental approval or permit to relocate the
617605 easement and construct nece ssary improvements;
618606 4. Preparing and recording the certified copy required by
619607 subsection D of Section 6 of this act and any other document
620608 required to be recorded;
621609 5. Any title work required to complete the relocation or
622610 required by a party to the civil action as a result of the
623611 relocation;
624612 6. Applicable premiums for title insurance related to the
625613 relocation;
626614 7. Any expert necessary to review plans and specifications for
627615 an improvement to be constructed in the relocated easement or on the
628616 dominant estate and to confirm compliance with the plans and
629617 specifications referred to in the order under paragraph 6 of
630618 subsection B of Section 6 of this act;
631619 8. Payment of any maintenance cost associated with the
632620 relocated easement which is greater than the maintena nce cost
633621 associated with the easement before relocation; and

663650 SECTION 8. NEW LAW A new section of law to be codified
664651 in the Oklahoma Statutes as Section 1508 of Title 60, unless there
665652 is created a duplication in numbering, reads as follows:
666653 After the court, under Section 6 of this act, approves
667654 relocation of an easement and the servient estate owner commences
668655 the relocation, the servient estate owner, the easemen t holder, and
669656 other parties in the civil action shall act in good faith to
670657 facilitate the relocation in compliance with this act.
671658 SECTION 9. NEW LAW A new section of law to be codified
672659 in the Oklahoma Statutes as Section 1509 of Title 60, unless there
673660 is created a duplication in numbering, reads as follows:
674661 A. If an order under Section 6 of this act requires the
675662 construction of an improvement as a condition for relocation of an
676663 easement, relocation is substantially complete, and th e easement
677664 holder is able to enter, use, and enjoy the easement in the new
678665 location, the servient estate owner shall:
679666 1. Record, in the land records of each jurisdiction where the
680667 servient estate is located, an affidavit certifying that the
681668 easement has been relocated; and
682669 2. Send, by certified mail, a copy of the recorded affidavit to
683670 the easement holder and parties to the civil action.

712698 recorded and sent, the easement holder may enter, use, and enjoy the
713699 easement in the current location, subject to the court's order under
714700 Section 6 of this act approving relocation.
715701 C. If an order under Section 6 of this act does not require an
716702 improvement to be constructed as a condition of the relocation,
717703 recording the order under subsection D of Section 6 of this act
718704 constitutes relocation.
719705 SECTION 10. NEW LAW A new section of law to be codified
720706 in the Oklahoma Statutes as Section 1510 of Title 60, unless there
721707 is created a duplication in numbering, reads as follows:
722708 A. Relocation of an easement under this act:
723709 1. Is not a new transfer or a n ew grant of an interest in the
724710 servient estate or the dominant estate;
725711 2. Is not a breach or default of, and does not trigger, a due -
726712 on-sale clause or other transfer -restriction clause under a security
727713 instrument, except as otherwise determined by a court under law
728714 other than this act;
729715 3. Is not a breach or default of a lease, except as otherwise
730716 determined by a court under law other than this act;
731717 4. Is not a breach or default by the servient estate owner of a
732718 recorded document affected by the relocatio n, except as otherwise
733719 determined by a court under law other than this act;

762747 other recorded real-property interests burdening the area of the
763748 servient estate where the easement was located before the
764749 relocation; and
765750 6. Is not a fraudulent conveyance or voidable transactio n under
766751 law.
767752 B. This act does not affect any other method of relocating an
768753 easement permitted under law of this state other than this act.
769754 SECTION 11. NEW LAW A new section of law to be codified
770755 in the Oklahoma Statutes as Section 1511 of Title 60, unless there
771756 is created a duplication in numbering, reads as follows:
772757 The right of a servient estate owner to relocate an easement
773758 under this act may not be waived, excluded, or restricted by
774759 agreement even if:
775760 1. The instrument creati ng the easement prohibits relocation or
776761 contains a waiver, exclusion, or restriction of this act;
777762 2. The instrument creating the easement requires consent of the
