5152 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5253 SECTION 1. AMENDATORY 25 O.S. 2021, Section 311, as
5354 amended by Section 1, Chapter 60, O.S.L. 2024 (25 O.S. Supp. 2024,
5455 Section 311), is amended to read as follows:
5556 Section 311. A. Notwithstanding any other provisions of law,
5657 all regularly scheduled, continued or recon vened, special or
5758 emergency meetings of public bodies shall be preceded by public
5859 notice as follows:
5960 1. All public bodies shall give notice in writing by D ecember
6061 15 of each calendar year of the schedule showing the date, time and
6162 place of the regularly s cheduled meetings of such public bodies for
6263 the following calendar year;

9090 2. All state public bodies including, but not limited to,
9191 public trusts and other bodies with the state as beneficiary, shall
9292 give such notice to the Secretary of State;
9393 3. All county public bodies including, but not limited to,
9494 public trusts and any other bodies with the county as beneficiary,
9595 shall give such notice to the county cler k of the county wherein
9696 they are principally located;
9797 4. All municipal public bodies including, but not limited to,
9898 public trusts and any other bodies with the municipality as
9999 beneficiary, shall give such notice to the municipal clerk of the
100100 municipality wherein they are principally located;
101101 5. All multicounty, regional, areawide or district public
102102 bodies including, but not limited to, district boards of education,
103103 shall give such notice to the county clerk of the county wherein
104104 they are principally locat ed, or if no office exists, to the county
105105 clerk of the county or counties served by such public body ;
106106 6. All governing boards of state institutions of higher
107107 education, and committees and subcommittees thereof, shall give such
108108 notice to the Secretary of State. All other public bodies covered
109109 by the provisions of the Oklahoma Open Meeting Act which exis t under
110110 the auspices of a state institution of higher education, but a
111111 majority of whose members are not members of the institution 's
112112 governing board, shall give such notice to the county clerk of the
113113 county wherein the institution is principally located;

141140 7. The Secretary of State and each county clerk or municipal
142141 clerk shall keep a record of all notices received in a register open
143142 to the public for inspection during regular office hours, and, in
144143 addition, shall make known upon any request of any person t he
145144 contents of the register;
146145 8. If any change is to be made of the date, time or place of
147146 regularly scheduled meetings of public bodies, then notice in
148147 writing shall be given to the Secretary of State or county clerk or
149148 municipal clerk, as required herein , not less than ten (10) days
150149 prior to the implementation of any such change;
151150 9. a. In addition to the advance public notice in writing
152151 required to be filed for regularly scheduled meetings,
153152 described in paragraph 1 of this subsection, all
154153 public bodies shall, at least twenty -four (24) hours
155154 prior to such regularly scheduled meetings, display
156155 public notice of the meeting by at least one of the
157156 following methods:
158157 (1) by posting information that includes date, time,
159158 place and agenda for the meeting in promine nt
160159 public view at the principal office of the public
161160 body or at the location of the meeting if no
162161 office exists, or
163162 (2) by posting on the public body 's Internet website

192190 in accordance with Section 3106.2 of T itle 74 of
193191 the Oklahoma Statutes. Additionally, the public
194192 body shall offer and consistently maintain an
195193 email distribution system for distribution of
196194 such notice of a public meeting required by this
197195 subsection, and any person may request to be
198196 included without charge, and their request shall
199197 be accepted. The emailed notice of a public
200198 meeting required by this subsection shall include
201199 in the body of the email or as an attachment to
202200 the email the date, time, place and agenda for
203201 the meeting and it shall be sent no less than
204202 twenty-four (24) hours prior to the meeting.
205203 Additionally, the public body shall make the
206204 notice of a public meeting required by this
207205 subsection available to the public in the
208206 principal office of the public body or at the
209207 location of the meeting during normal business
210208 hours at least twenty –four (24) hours prior to
211209 the meeting. Public bodies may require persons
212210 participating in the email distribution system to
213211 annually confirm the request to be included in
214212 the email distribution system. If the person
215213 does not confirm the request, public bodies may

244241 system. Nothing herein prohibits an individua l
245242 from participating in an email distribution
246243 system from which that individual was previously
247244 removed.
248245 b. In addition to the notice requirements of this
249246 section, all state public bodies, as defined in
250247 paragraph 2 of this subsection, shall, at least
251248 twenty-four (24) hours prior to regularly scheduled
252249 meetings, display public notice of the meeting by:
253250 (1) posting information that includes date, time,
254251 place and agenda for the meeting in prominent
255252 public view at the principal office of the public
256253 body or at the location of the meeting if no
257254 office exists, and
258255 (2) posting on the public body 's Internet website the
259256 date, time, place and agenda for the meeting in
260257 accordance with Section 3106.2 of Title 74 of the
261258 Oklahoma Statutes;
262259 10. The twenty-four (24) hours required in paragraph 9 of this
263260 subsection shall exclude Saturdays, Sundays and holidays legally
264261 declared by the State of Oklahoma. The posting or distribution of a
265262 notice of a public meeting as described in paragraph 9 of this
266263 subsection shall not preclude a public body from considering at its

294290 regularly scheduled meeting any new business. "New business", as
295291 used herein, shall mean any matter not known about or which could
296292 not have been reasonably foreseen prior to the time of the posting;
297293 11. In the event any meeting is to be continued or reconvened,
298294 public notice of such action including date, time and place of the
299295 continued meeting, shall be given by announcement at the original
300296 meeting. Only matters appearing on the agenda of the meeting which
301297 is continued may be discussed at the continued or reconvened
302298 meeting;
303299 12. Special meetings of public bodies shall not be held without
304300 public notice being given at least forty -eight (48) hours prior to
305301 the meetings. Such public notice of date, time and place shall be
306302 given in writing, in person or by telephonic means to the Secretary
307303 of State or to the county c lerk or to the municipal clerk by public
308304 bodies in the manner set forth in paragraphs 2, 3, 4, 5 and 6 of
309305 this subsection. The public body also shall cause written notice of
310306 the date, time and place of the meeting to be mailed or delivered to
311307 each person, newspaper, wire service, radio station and television
312308 station that has filed a written request for notice of meetings of
313309 the public body with the clerk or secretary of the public body or
314310 with some other person designated by the public body. Such written
315311 notice shall be mailed or delivered at least forty -eight (48) hours
316312 prior to the special meeting. The public body may charge a fee of
317313 up to Eighteen Dollar s ($18.00) per year to persons or entities

346341 such persons or entities to renew the request for notice annually.
347342 In addition, all public bodies shall, at least twenty -four (24)
348343 hours prior to such special meetings, display public notice of the
349344 meeting, setting forth thereon the date, time, pl ace and agenda for
350345 the meeting. Only matters appearing on the posted agenda may be
351346 considered at the special meeting. Such public notice shall be
352347 posted in prominent public view at the principal office of the
353348 public body or at the location of the meeting if no office exists.
354349 Twenty-four (24) hours prior public posting shall exclude Saturdays,
355350 Sundays and holidays legally declared by the State of Oklahoma. In
356351 lieu of the public posting requirements of this paragraph, a public
357352 body may elect to follow the requirements found in division (2) of
358353 subparagraph a of paragraph 9 of this subsection, provided that
359354 forty-eight-hour notice is required for special meeti ngs and that
360355 the forty-eight-hour requirement shall exclude Saturdays, Sundays
361356 and holidays legally declared by the State of Oklahoma;
362357 13. In the event of an emergency, an emergency meeting of a
363358 public body may be held without the public notice heretofore
364359 required. Should an emergency meeting of a public body be
365360 necessary, the person calling such a mee ting shall give as much
366361 advance public notice as is reasonable and possible under the
367362 circumstances existing, in person or by telephonic or electronic
368363 means; and

396390 14. A public body that gives public notice of a meeting for
397391 which there will be a videoconfer ence option in accordance with
398392 Section 307.1 of this title shall not modify the method of meeting
399393 described in the notice prior to the meeting and shall conduct the
400394 meeting according to the methods described in the notice. If a code
401395 or password is require d to access the videoconference meeting, the
402396 code or password shall be included in the public notice.
403397 B. 1. All agendas required pursuant to the provision s of this
404398 section shall identify all items of business to be transacted by a
405399 public body at a meetin g including, but not limited to, any proposed
406400 executive session for the purpose of engaging in deliberations or
407401 rendering a final or intermediate decision in an individual
408402 proceeding prescribed by the Administrative Procedures Act.
409403 2. If a public body pro poses to conduct an executive session,
410404 the agenda shall:
411405 a. contain sufficient information for the public to
412406 ascertain that an executive session will be pro posed,
413407 b. identify the items of business and purposes of the
414408 executive session, and
415409 c. state specifically the provision of Section 307 of
416410 this title authorizing the executive session.
417411 SECTION 2. This act shall become effective November 1, 2025.
