50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 70 O.S. 2021, Section 2604,
52	52	is amended to read as follows:
53	53	Section 2604. A. Subject to the availability of funds, an
54	54	amount equivalent to the nonguaranteed resident tuition for which an
55	55	eligible Oklahoma Higher Learning Access Program student is
56	56	obligated at an institution of The Okl ahoma State System of Higher
57	57	Education shall be awarded by allocation from the Oklahoma Higher
58	58	Learning Access Trust Fund.
59	59	B. Subject to the availability of funds, for each eligible
60	60	Oklahoma Higher Learning Access Program student enrolled at a
61	61	private institution of higher learning located within this state and
62	62	accredited pursuant to Section 4103 of this title, the Oklahoma

89	89	State Regents for Higher Education shall award from the Oklahoma
90	90	Higher Learning Access Trust Fund an amount equivalent to the amount
91	91	of resident tuition for which the student would be eligible if the
92	92	student were enrolled in a comparable program at a comparable
93	93	institution of The Oklahoma State System of Higher Education.
94	94	Comparability shall be determined by the State Regents.
95	95	C. Subject to the availability of funds, an amount equivalent
96	96	to the tuition for any eligible Oklahoma Higher Learning Access
97	97	Program student enrolled in a public postsecondary vocational -
98	98	technical program or course for the purpose set forth in Section
99	99	2602 of this title shall be awarded by allocation from the Oklahoma
100	100	Higher Learning Access Trust Fund. Provided, such allocation shall
101	101	not exceed the amount a student would have received for comparable
102	102	enrollment at a two-year institution within The Oklahoma State
103	103	System of Higher Education.
104	104	D. 1. An award allowed by this section shall not be allowed
105	105	for courses or other postsecondary units taken in excess of the
106	106	requirements for completion of a baccalaureate program or taken more
107	107	than five (5) years after the stu dent's first semester of
108	108	postsecondary enrollment. The Oklahoma State Regents for Higher
109	109	Education may award the Oklahoma Higher Learning Access Program
110	110	benefits for courses of postsecondary units taken more than five (5)
111	111	years after the student 's first semester of postsecondary enrollment
112	112	only in hardship circumstances; provided, however, no Oklahoma

139	139	Higher Learning Access Program participant may receive benefits
140	140	beyond a cumulative time period of five (5) years.
141	141	2. The Oklahoma State Regents for Higher Education may award
142	142	the Oklahoma Higher Learning Access Program benefits for a student 's
143	143	first semester or other academic unit of postsecondary enrollment
144	144	taken more than three (3) years after the student graduates from
145	145	high school or completes an educatio nal program equivalent to high
146	146	school graduation as authorized in subsection A of Section 2603 of
147	147	this title or after the student turns twenty -one (21) years of age
148	148	as authorized in subsection B of Section 2603 of this title if the
149	149	student is a member of t he Armed Forces of the United States, the
150	150	Reserve Corps of the Armed Forces of the United States, or the
151	151	Oklahoma National Guard, and is ordered to active duty or active
152	152	duty for special work or training and due to the duty commitment the
153	153	student is unable to enroll prior to the end of the three -year
154	154	period or before the student rea ches twenty-one (21) years of age.
155	155	The period shall be extended by the length of the term of duty.
156	156	3. The Oklahoma State Regents for Higher Education shall
157	157	establish a maximum limit on the number of courses or other
158	158	postsecondary units to which Oklahoma Higher Learning Access Program
159	159	benefits will apply.
160	160	E. Benefits awarded under the Oklahoma Higher Learning Access
161	161	Program shall be awarded to all eligible applicants without any
162	162	limitation on the number of awards in any year other than the amount

190	190	applicants. Subject to the provisions of subsection F of this
191	191	section, if funds are not sufficient to provide awards for al l
192	192	eligible applicants, the Oklahoma State Regents for Higher Education
193	193	shall make awards on the basis of need. Provided, the Oklahoma
194	194	State Regents for Higher Education shall take into consideration
195	195	other grants and scholarships received by an eligible ap plicant when
196	196	making awards.
197	197	F. The Oklahoma State Regents for Higher Educatio n may, at the
198	198	time an award is made on behalf of an Oklahoma Higher Learning
199	199	Access Program student, set aside in the Oklahoma Higher Learning
200	200	Access Trust Fund funds for the ful l commitment made to such Higher
201	201	Learning Access Program student. For all academic years, students
202	202	who have previously received awards under the provisions of the
203	203	Oklahoma Higher Learning Access Act, Section 2601 et seq. of this
204	204	title, and who have contin ued at all times to fulfill the
205	205	requirements for eligibility to receive awards provided pursuant to
206	206	this program shall be given an absolute priority for continued
207	207	financial support by the Oklahoma Higher Learning Access Program
208	208	superior to any students who are applying for such benefits for the
209	209	first time.
210	210	G. 1. Beginning with the 2018 -2019 academic year, an award
211	211	allowed by this section shall not include an amount for payment of

240	240	2. Beginning with the 2025 -2026 academic year, a n award allowed
241	241	by this section shall not include an amount for payment of the
242	242	reenrollment in courses previously paid for by an award allowed by
243	243	this section and failed by the e ligible Oklahoma Higher Learning
244	244	Access Program student.
245	245	SECTION 2. This act shall become effective July 1, 2025.
246	246	SECTION 3. It being immediately necessary for the preservation
247	247	of the public peace, health or safety, an eme rgency is hereby
248	248	declared to exist, by reason whereof this act shall take effe ct and
249	249	be in full force from and after its passage and approval.
