55 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

56 | 53 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
57 | 54 | | in the Oklahoma Statutes as Section 365 of Title 40, unless there is |
---|
58 | 55 | | created a duplication in numbering, reads as follows: |

59 | 56 | | A. There is hereby created until November 1, 2027, the |
---|
60 | 57 | | Rethinking Paying Subminimal Wage t o Persons with Disabilities Task |
---|
61 | 58 | | Force. |
---|
62 | 59 | | B. The Task Force shall study and develop a plan to phase out |
---|
63 | 60 | | the practice of paying workers with disabilities submin imum wages |
---|
64 | 61 | | under 14(c) certificate programs in Oklahoma. The Task Force shall |
---|
65 | 62 | | study, review, and make recommendations on the following, with a |
---|
94 | 90 | | paid subminimum wages under 14(c) certificates to competitive, |
---|
95 | 91 | | integrated employment at or above minimum wage, and when |
---|
96 | 92 | | appropriate, alternative meaningful day programs for those not able |
---|
97 | 93 | | or wanting to move to competitive, integrated employment: |
---|
98 | 94 | | 1. Identify potential obstacles and negative impacts of phasing |
---|
99 | 95 | | out subminimum wages and 14(c) use in Oklahoma; and |
---|
100 | 96 | | 2. Develop a plan for phasing out sub minimum wages and 14(c) |
---|
101 | 97 | | use in Oklahoma that: |
---|
102 | 98 | | a. reduces potential negative impacts and maximizes the |
---|
103 | 99 | | potential for successful transition to competitive, |
---|
104 | 100 | | integrated employment, |
---|
105 | 101 | | b. includes alternative meaningful day programs for those |
---|
106 | 102 | | individuals who do no t wish to transition to |
---|
107 | 103 | | competitive, integrated employment or for those for |
---|
108 | 104 | | whom it is not appropriate, and |
---|
109 | 105 | | c. establishes an appropriate timeline for phasing out |
---|
110 | 106 | | subminimum wages. |

111 | 107 | | C. The Task Force shall consist of eleven (11) members as |
---|
112 | 108 | | follows: |

113 | 109 | | 1. The Secretary of Commerce and Workforce Development; |
---|
114 | 110 | | 2. A member of the Oklahoma House of Representatives, appointed |
---|
115 | 111 | | by the Speaker of the House; |
---|
145 | 140 | | 4. A representative from the Oklahoma Disability Law Center, |
---|
146 | 141 | | appointed by the President Pro Tempore of the Oklahoma State Senate; |

147 | 142 | | 5. A representative from the Oklahoma state chapter of the |

148 | 143 | | Association of People Supporting Employment First, appointed by the |
---|
149 | 144 | | Speaker of the House; |
---|
150 | 145 | | 6. A self-advocate who is currently enrolled or previously |
---|
151 | 146 | | employed at subminimum wage, appointed by the Board of the Oklahoma |
---|
152 | 147 | | Developmental Disabilities Council; |

153 | 148 | | 7. A parent or family member of a person with a disability who |
---|
154 | 149 | | has successfully transitioned fr om subminimum wage to competitive, |
---|
155 | 150 | | integrated employment, appointed by the Board of the Oklahoma |
---|
156 | 151 | | Developmental Disabilities Council; |
---|
157 | 152 | | 8. A director of a progr am who previously held a 14(c) |
---|
158 | 153 | | certificate and successfully transitioned to community integrated |
---|
159 | 154 | | employment, appointed by the Governor; |
---|
160 | 155 | | 9. A private employer who employs individuals with |
---|
161 | 156 | | disabilities, appointed by the Governor; |
---|
162 | 157 | | 10. The Director of the Department of Human Services |
---|
163 | 158 | | Developmental Disabilities Services or his or her designee; and |
---|
164 | 159 | | 11. The Director of the Oklahoma Department of Rehabilitation |
---|
165 | 160 | | Services or his or her designee. |

196 | 190 | | thirty (30) days after the effective date of this act. Meetings of |
---|
197 | 191 | | the Task Force shall be held at the call of either co -chair of the |
---|
198 | 192 | | Task Force. Members shall serve at the pleasure of their appointing |
---|
199 | 193 | | authorities. A major ity of the members of the Task Force shall |
---|
200 | 194 | | constitute a quorum to transact business, but no vacancy shall |
---|
201 | 195 | | impair the right of the remaining members to exercis e all of the |
---|
202 | 196 | | powers of the Task Force. Except as otherwise provided, a vacancy |
---|
203 | 197 | | on the Task Force shall be filled by the original appointing |
---|
204 | 198 | | authority. If the original appointing authority fails to make an |
---|
205 | 199 | | appointment within thirty (30) days after the effective date of this |
---|
206 | 200 | | act, a majority of the members of the Task Force who have been |
---|
207 | 201 | | appointed may fill the vacancy to the open position. Staff support |
---|
208 | 202 | | for the Task Force shall be provided by the staff of the Oklahoma |
---|
209 | 203 | | House of Representatives and the Oklaho ma State Senate. The |
---|
210 | 204 | | Oklahoma Department of Career and Technology Education, Oklahoma |
---|
211 | 205 | | State Regents for Higher Education, Office of Disability Concerns, |
---|
212 | 206 | | Oklahoma Department of Rehabilitation Services, Oklahoma Health Care |
---|
213 | 207 | | Authority, Department of Human Services, and the State Use Committee |
---|
214 | 208 | | of the Office of Management and Enterprise Services shall prov ide |
---|
215 | 209 | | support and information as requested by the Task Force. |
---|
246 | 239 | | F. The Task Force may seek the assistance of the Legislative |
---|
247 | 240 | | Service Bureau or the State Board of Education to contract with an |
---|
248 | 241 | | independent consultant as necessary to fulfill the duties specified |
---|
249 | 242 | | in this section, contingent on the availability of funds. |

250 | 243 | | G. The Task Force shall submit a final report by January 1, |

251 | 244 | | 2028, to the Governor, the President Pro Tempore of the Oklahoma |
---|
252 | 245 | | State Senate, and the Speaker of t he Oklahoma House of |
