5552 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5653 SECTION 1. NEW LAW A new section of law to be codified
5754 in the Oklahoma Statutes as Section 365 of Title 40, unless there is
5855 created a duplication in numbering, reads as follows:
5956 A. There is hereby created until November 1, 2027, the
6057 Rethinking Paying Subminimal Wage t o Persons with Disabilities Task
6158 Force.
6259 B. The Task Force shall study and develop a plan to phase out
6360 the practice of paying workers with disabilities submin imum wages
6461 under 14(c) certificate programs in Oklahoma. The Task Force shall
6562 study, review, and make recommendations on the following, with a
63+focus on transitioning workers with disabilities currently being

93-focus on transitioning workers with disabilities currently being
9490 paid subminimum wages under 14(c) certificates to competitive,
9591 integrated employment at or above minimum wage, and when
9692 appropriate, alternative meaningful day programs for those not able
9793 or wanting to move to competitive, integrated employment:
9894 1. Identify potential obstacles and negative impacts of phasing
9995 out subminimum wages and 14(c) use in Oklahoma; and
10096 2. Develop a plan for phasing out sub minimum wages and 14(c)
10197 use in Oklahoma that:
10298 a. reduces potential negative impacts and maximizes the
10399 potential for successful transition to competitive,
104100 integrated employment,
105101 b. includes alternative meaningful day programs for those
106102 individuals who do no t wish to transition to
107103 competitive, integrated employment or for those for
108104 whom it is not appropriate, and
109105 c. establishes an appropriate timeline for phasing out
110106 subminimum wages.
111107 C. The Task Force shall consist of eleven (11) members as
112108 follows:
113109 1. The Secretary of Commerce and Workforce Development;
114110 2. A member of the Oklahoma House of Representatives, appointed
115111 by the Speaker of the House;
112+3. A member of the Oklahoma State Senate, appointed by the

143-3. A member of the Oklahoma State Senate, appointed by the
144-President Pro Tempore;
145140 4. A representative from the Oklahoma Disability Law Center,
146141 appointed by the President Pro Tempore of the Oklahoma State Senate;
147142 5. A representative from the Oklahoma state chapter of the
148143 Association of People Supporting Employment First, appointed by the
149144 Speaker of the House;
150145 6. A self-advocate who is currently enrolled or previously
151146 employed at subminimum wage, appointed by the Board of the Oklahoma
152147 Developmental Disabilities Council;
153148 7. A parent or family member of a person with a disability who
154149 has successfully transitioned fr om subminimum wage to competitive,
155150 integrated employment, appointed by the Board of the Oklahoma
156151 Developmental Disabilities Council;
157152 8. A director of a progr am who previously held a 14(c)
158153 certificate and successfully transitioned to community integrated
159154 employment, appointed by the Governor;
160155 9. A private employer who employs individuals with
161156 disabilities, appointed by the Governor;
162157 10. The Director of the Department of Human Services
163158 Developmental Disabilities Services or his or her designee; and
164159 11. The Director of the Oklahoma Department of Rehabilitation
165160 Services or his or her designee.
161+D. The member of the Oklahoma House of Representatives and the
162+member of the Oklahoma State Senate shall serve as co -chairs of the
163+Task Force. Appointments to the T ask Force shall be made within

193-D. The member of the Oklahoma House of Representatives and the
194-member of the Oklahoma State Senate shall serve as co -chairs of the
195-Task Force. Appointments to the Task Force shall be made within
196190 thirty (30) days after the effective date of this act. Meetings of
197191 the Task Force shall be held at the call of either co -chair of the
198192 Task Force. Members shall serve at the pleasure of their appointing
199193 authorities. A major ity of the members of the Task Force shall
200194 constitute a quorum to transact business, but no vacancy shall
201195 impair the right of the remaining members to exercis e all of the
202196 powers of the Task Force. Except as otherwise provided, a vacancy
203197 on the Task Force shall be filled by the original appointing
204198 authority. If the original appointing authority fails to make an
205199 appointment within thirty (30) days after the effective date of this
206200 act, a majority of the members of the Task Force who have been
207201 appointed may fill the vacancy to the open position. Staff support
208202 for the Task Force shall be provided by the staff of the Oklahoma
209203 House of Representatives and the Oklaho ma State Senate. The
210204 Oklahoma Department of Career and Technology Education, Oklahoma
211205 State Regents for Higher Education, Office of Disability Concerns,
212206 Oklahoma Department of Rehabilitation Services, Oklahoma Health Care
213207 Authority, Department of Human Services, and the State Use Committee
214208 of the Office of Management and Enterprise Services shall prov ide
215209 support and information as requested by the Task Force.
210+E. Members of the Task Force shall receive no compensation for
211+serving on the Task Force, but may receive travel reimbursement,
212+contingent on the availability of private funds for this purpose.

243-E. Members of the Task Force shall receive no compensation for
244-serving on the Task Force, but may r eceive travel reimbursement,
245-contingent on the availability o f private funds for this purpose.
246239 F. The Task Force may seek the assistance of the Legislative
247240 Service Bureau or the State Board of Education to contract with an
248241 independent consultant as necessary to fulfill the duties specified
249242 in this section, contingent on the availability of funds.
250243 G. The Task Force shall submit a final report by January 1,
251244 2028, to the Governor, the President Pro Tempore of the Oklahoma
252245 State Senate, and the Speaker of t he Oklahoma House of
253246 Representatives.
254247 SECTION 2. This act shall become effective November 1, 2025.
