4242 An Act relating to public health and safety;

5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. NEW LAW A new section of law to be codified
5454 in the Oklahoma Statutes as Section 1-706.6 of Title 63, unless
5555 there is created a duplication in numbering, reads as follows:
5656 A. As used in this section:
5757 1. "Health care employer " means a hospital as defined in
5858 Section 1-701 of Title 63 of the Oklahoma Statutes, or an ambulatory
5959 surgical facility or outpatient surgical center;
6060 2. "Smoke evacuation system " means equipment that effectively
6161 captures and filters surgical smoke at the site of origin before the
6262 smoke makes contact with the eyes or the respiratory tract of
6363 occupants in the room; and

9090 3. "Surgical smoke" means the gaseous by -product produced by
9191 energy-generating devices includi ng surgical plume, smoke plume,
9292 bio-aerosols, laser-generated airborne contaminants, or long -
9393 damaging dust.
9494 B. A health care employer shall adopt and implement policies to
9595 prevent exposure to surgical smoke by requiring the use of a smoke
9696 evacuation system during any surgical procedure that is likely to
9797 generate surgical smoke.
9898 SECTION 2. This act shall become effective November 1, 2025.
