52 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

53 | 53 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
54 | 54 | | in the Oklahoma Statutes as Section 1-706.6 of Title 63, unless |

55 | 55 | | there is created a duplication in numbering, reads as follows: |

56 | 56 | | A. As used in this section: |
---|
57 | 57 | | 1. "Health care employer " means a hospital as defined in |
---|
58 | 58 | | Section 1-701 of Title 63 of the Oklahoma Statutes, or an ambulatory |
---|
59 | 59 | | surgical facility or outpatient surgical center; |
---|
60 | 60 | | 2. "Smoke evacuation system " means equipment that effectively |
---|
61 | 61 | | captures and filters surgical smoke at the site of origin before the |
---|
62 | 62 | | smoke makes contact with the eyes or the respiratory tract of |
---|
63 | 63 | | occupants in the room; and |

94 | 94 | | B. A health care employer shall adopt and implement policies to |
---|
95 | 95 | | prevent exposure to surgical smoke by requiring the use of a smoke |
---|
96 | 96 | | evacuation system during any surgical procedure that is likely to |
---|
97 | 97 | | generate surgical smoke. |
---|
98 | 98 | | SECTION 2. This act shall become effective November 1, 2025. |
