BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 1-706.6 of Title 63, unless there is created a duplication in numbering, reads as follows: A. As used in this section: 1. "Health care employer " means a hospital as defined in Section 1-701 of Title 63 of the Oklahoma Statutes, or an ambulatory surgical facility or outpatient surgical center; 2. "Smoke evacuation system " means equipment that effectively captures and filters surgical smoke at the site of origin before the smoke makes contact with the eyes or the respiratory tract of occupants in the room; and Req. "Surgical smoke" means the gaseous by -product produced by energy-generating devices includi ng surgical plume, smoke plume, bio-aerosols, laser-generated airborne contaminants, or long - damaging dust. B. A health care employer shall adopt and implement policies to prevent exposure to surgical smoke by requiring the use of a smoke evacuation system during any surgical procedure that is likely to generate surgical smoke. SECTION 2. This act shall become effective November 1, 2025. 60-1-11652 TJ 01/07/25
