57 | 50 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

58 | 51 | | SECTION 1. NEW LAW A new section of law not to be |
---|
59 | 52 | | codified in the Oklahoma Statutes reads as follows: |

60 | 53 | | This act shall be known and may be cited as the "Maddix Bias |
---|
61 | 54 | | Act". |
---|
62 | 55 | | SECTION 2. NEW LAW A new section of law to be codified |
---|
63 | 56 | | in the Oklahoma Statutes as Section 465.22 of Title 63, unless there |
---|
64 | 57 | | is created a duplication in numbering, reads as follows: |

65 | 58 | | As used in this section: |
---|
96 | 88 | | B. 1. This act prohibits any person to inhale, ingest, or |
---|
97 | 89 | | possess with intent to breathe, inhale, or drink any compound, |
---|
98 | 90 | | liquid, or chemical containing nitrous oxide, or any similar |
---|
99 | 91 | | substance for the purpose of inducing a con dition of intoxication or |
---|
100 | 92 | | which distorts or disturbs the auditory, visual, or mental |
---|
101 | 93 | | processes; and |
---|
102 | 94 | | 2. It is unlawful for any person to inhale, ingest, possess, |
---|
103 | 95 | | buy, sell, or otherwise transfer any chemical substance defined in |
---|
104 | 96 | | subsection A of this section for the purpose of inducing or aiding |
---|
105 | 97 | | any other person to violate the provisions of paragraph 1 of this |
---|
106 | 98 | | subsection. |
---|
107 | 99 | | C. On and after the effective date of this act, violation of |
---|
108 | 100 | | subsection B of this section is a misdemeanor with imprisonment up |
---|
109 | 101 | | to ninety (90) days or a fine of Five Thousand Dollars ($5,000.00), |
---|
110 | 102 | | or both. The court may require any person to participate in an |
---|
111 | 103 | | approved drug rehabilitation program as a condition of probation. |
---|
112 | 104 | | D. Any person who knowingly distributes, sells, purchases, |
---|
113 | 105 | | transfers, or possesses more than sixteen (16) grams of nitrous |
---|
114 | 106 | | oxide commits a misdemeanor with imprisonment up to ninety (90) days |
---|
115 | 107 | | or a fine of Five Thousand Dollars ($5,000.00), or both. Knowingly |
---|
116 | 108 | | distributing, selling, purchasing, transferring, or possessing more |
---|
147 | 138 | | knowingly possessed, distributed, sold, purchased, o r transferred, |
---|
148 | 139 | | proof that any person discharged, or aided another in discharging |
---|
149 | 140 | | nitrous oxide to inflate a balloon or any other object suitable for |
---|
150 | 141 | | subsequent inhalation creates an inference of the person's knowledge |
---|
151 | 142 | | that the nitrous oxide's use was for a n unlawful purpose. |

152 | 143 | | E. Additionally, any person twenty -one (21) years of age or |
---|
153 | 144 | | older who sells or offers to sell drug paraphernalia to a person |
---|
154 | 145 | | less than eighteen (18) years o f age is guilty of a misdemeanor |
---|
155 | 146 | | punishable by imprisonment for up to one (1) y ear or a fine of up to |
---|
156 | 147 | | Seven Thousand Five Hundred Dollars ($7,500.00), or both. These |
---|
157 | 148 | | provisions would only apply to the selling or offering of an object |
---|
158 | 149 | | specifically designed for inhaling nitrous oxide for recreational |
---|
159 | 150 | | purposes. |
---|
160 | 151 | | F. Pursuant to this act , the court shall order the suspension |
---|
161 | 152 | | of the business license, for a period of up to one (1) year of a |
---|
162 | 153 | | person who knowingly violates this subsection after having been |
---|
163 | 154 | | previously convicted of a violation of this subsection, unless the |
---|
164 | 155 | | owner of the business license can demonstrate a good faith attempt |
---|
165 | 156 | | to prevent illegal sales or deliveries by the owner's employees. |
---|
166 | 157 | | G. This act shall not apply to any person who administers |
---|
167 | 158 | | nitrous oxide for the purpose of providing medical or dental care, |
---|
198 | 188 | | H. This act does not apply to the sale of nitrous oxide |
---|
199 | 189 | | contained in food products for use as a propellant. |
---|
200 | 190 | | I. This act does not apply to the sale, use, or possession of |
---|
201 | 191 | | nitrous oxide containing sulfur dioxide used for automotive |
---|
202 | 192 | | purposes. |
---|
203 | 193 | | J. This act does not apply to the sale, use, or possession of |
---|
204 | 194 | | nitrous oxide used in manufacturing or use in an industrial |
---|
205 | 195 | | application. |
---|
206 | 196 | | K. This act does not apply to nitrous oxide cartridges or |
---|
207 | 197 | | whipped cream "chargers" purchased exclusively from commercial |
---|
208 | 198 | | restaurant supply companies or vendors exclusi vely to commercial |
---|
209 | 199 | | restaurants or bakery businesses that use nitrous oxide cart ridges |
---|
210 | 200 | | for the sole purpose of producing whipped cream or other culinary |
---|
211 | 201 | | uses. |
---|
212 | 202 | | SECTION 3. This act shall become effective November 1, 2025. |
