5069 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5170 SECTION 1. NEW LAW A new section of law to be codified
5271 in the Oklahoma Statutes as Section 421.21 of Title 21, unless there
5372 is created a duplicat ion in numbering, reads as follows:
54-A. Contingent upon the availability of funds, the District
55-Attorneys Council shall develop and implement a five -year Domestic
56-Violence Forensic Exam Pilot Program. The purpose of the Domestic
57-Violence Forensic Exam Pilot Program shall be to provide counties
58-with qualified licensed health care professionals who shall conduct
59-domestic violence forensic exams for victims of domestic violence

86-assault. In conjunction with the Domestic Violence Forensic Exam
87-Pilot Program, a Domestic Violence Examination Fund shall be
88-established in each participating county for the purpose of
89-providing to a victim of domestic violence assault, a forensic
90-medical examination by a qualified licensed health care
91-professional.
100+A. Contingent upon the availability of funds, the D istrict

106+assault. Counties with a population of more than one hundred
107+thousand (100,000) a ccording to the latest Federal Decennial Census
108+may participate in the pilot program. I n conjunction with the
109+Domestic Violence Forensic Exam Pilot Program, a Domestic Violence
110+Examination Fund shall be established in each participating county
111+for the purpose of providing to a victim of domestic violence
112+assault, a forensic medical examinati on by a qualified licensed
113+health care professional.
92114 B. As used in this secti on:
93115 1. "Domestic violence" means any act of physical harm or the
94116 threat of imminent physi cal harm which is committed by an adult,
95117 emancipated minor, or minor child thirteen (13) years of age or
96118 older against another adult, emancipated minor, or minor child who
97119 is currently or was previously an intimate partner or family or
98120 household member;
99121 2. "Intimate partner" means:
100122 a. current or former spouses,
101123 b. persons who are in a dating relationship,
102-c. persons who are the biological parents of the same
103-child, regardless of marital status or whether they
104-have lived together at any time, and
105-d. persons who currently or formerly lived together in an
106-intimate way, primarily characteriz ed by affectionate
107-or sexual involvement. A sexual relationship may be
108-an indicator that a person is an intimate partner, but
109-is never a necessary condition;

136-3. "Household member" means:
151+c. persons who are the biological parents of the same
152+child, regardless of marital status or whether they
153+have lived together at any time, and
154+d. persons who currently or formerly lived together in an
155+intimate way, primarily characterized by affectionate
156+or sexual involvement. A sexual relationship may be
157+an indicator that a person is an intimate partner, but
158+is never a necessary condition;
159+3. "Living in the same household" means:
137160 a. persons who regularly reside in the same single -
138161 dwelling unit,
139162 b. persons who resided in the same single -dwelling unit
140163 within the past year, or
141164 c. persons who have individual lease agreements whereby
142165 each person has his or he r own private bedroom and
143166 shares common areas; and
144167 4. "Qualified licensed health care p rofessional" means a
145168 physician, registered nurse, or other licensed health care
146169 professional qualified by completion of a forty -hour didactic
147170 domestic violence examiner s course, as well as successful completion
148171 of clinical competence.
149172 C. The Crime Victims Compensation Board shall establish the
150173 procedures for disbursement of the Dom estic Violence Examination
151174 Fund, but in no event shall the Crime Victims Compensation Boar d pay
152-an amount to exceed Two Hundred Dollars ($200.00) for a domestic
153-violence forensic exam. Such payments shall not exceed the amounts
154-specified by this subsection regardless of the amount of any
155-individual bills comprising the claim. Payments shall be made only
156-upon claims signed by the victim or guardian and qualified licensed
157-health care professional.
158-D. The District Attorneys Council is hereby authorized to
159-transfer funds, as specified in the appropriations bill annually,

208+D. The District Attorneys Council is hereby authorized to

187211 Examination Fund for the payment of domestic vi olence forensic
188212 exams, pursuant to this section.
189213 E. The District Attorneys Council shall have the authority to
190214 make any contract, execute any document, or perform any act in order
191215 to carry out the Domestic Violence Forensic Exam Pilot Program.
192216 F. Nothing in this section shall prevent the Legislature from
193217 appropriating funds to the Domestic Violence Examination Fund for
194218 the payment of domestic violence forensic examinat ions.
195-G. Counties with a population of more than three hundred
196-thousand (300,000) according to the latest Federal Decennial Census
197-may participate in the pilot program. Subject to available funding,
198-the Crime Victims Compensation Board is authorized to allow counties
199-with a population of less than three hundred thousand (300,000)
200-according to the latest Federal Decennial Census to participate in
201-the pilot program.
202219 SECTION 2. This act shall become effective November 1, 2025.
