1643 An Act relating to alcoholic beverages; amending 37A
1744 O.S. 2021, Section 6 -102, as last amended by Section
1845 8, Chapter 338, O.S.L. 2023 (37A O.S. Supp. 2024,
1946 Section 6-102), which relates to prohibited acts of

3053 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3254 SECTION 1. AMENDATORY 37A O.S. 2021, Section 6 -102, as
3355 last amended by Section 8, Chapter 338, O.S.L. 2023 (37A O.S. Supp.
3456 2024, Section 6-102), is amended to read as follows:

3657 Section 6-102. A. No licensee of the ABLE Commission shall:

3858 1. Receive Knowingly receive, possess or sell any alcoholic
3959 beverage except as authorized by the Oklahoma Alcoholic Beverage
4060 Control Act and by the license or permit which the licensee hold s;

4261 2. Employ any person under eighteen (18) years of age in the
4362 selling of beer or wine or employ any person under twenty -one (21)
4463 years of age in the selling of spirits. Provided:

4691 a. a mixed beverage, beer and wine, caterer, public
4792 event, special event, bottle club, retail wine or
4893 retail beer licensee may employ servers or sales
4994 clerks who are at least eighteen (18) years of age,
5095 except persons under twenty -one (21) years of age may
5196 not serve in designated bar or lounge areas, and

5397 b. a mixed beverage, be er and wine, caterer, public
5498 event, special event or bottle club licensee may
5599 employ or hire musical bands who have musicians who
56100 are under eighteen (18) years of age if each such
57101 musician is either accompanied by a parent or legal
58102 guardian or has on their person, to be made available
59103 for inspection upon demand by any employee of the ABLE
60104 Commission or law enforcement officer, a written,
61105 notarized affidavit from the parent or legal guardian
62106 giving the underage musician permission to perform in
63107 designated bar or lounge areas;

65108 3. Give any alcoholic beverage as a prize, premium or
66109 consideration for any lottery, game of chance or skill or any type
67110 of competition;

69111 4. Use any of the following means or inducements to stimulate
70112 the consumption of alcoholic beverages, including but not limited

73141 a. deliver more than two drinks to one person at one
74142 time, except:

76143 (1) as provided for serving tasting flights defined
77144 in Section 6-102.1 of this title, or
78-
79145 (2) up to six (6) bottles or cans of beer in the
80146 original packaging for on-premises consumption
81147 may be delivered to one person at one time in a
82148 reusable container, including but not limited to
83149 a bucket or insulated cooler which may be cooled
84150 by ice or another cooling method,
85-
86151 b. sell or offer to sell to any person or group of
87152 persons any drinks at a pr ice that is less than six
88153 percent (6%) below the markup of the cost to the mixed
89154 beverage licensee; provided, a mixed beverage licensee
90-shall be permitted to offer these drink specials on ENR. H. B. NO. 2804 Page 3
155+shall be permitted to offer these drink specials on
91156 any particular hour of any particular day and shall
92157 not be required to offer these drink specials for an
93158 entire calendar week or from open to close, and shall
94159 not be required to offer such drink specials at all
95160 venues operating under the same mixed beverage
96161 license; provided, a mixed beverage licensee selling
97162 wine, beer, or cocktails to-go shall be permitted to
98163 offer these to-go drinks at a different price than on -
99164 premises drinks,

101192 c. sell or offer to sell to any person an unlimited
102193 number of drinks during any set period of time for a
103194 fixed price, except at private functions not open to
104195 the public,
105-
106196 d. sell or offer to sell drinks to any person or group of
107197 persons on any one day or portion thereof at prices
108198 less than those charged the general public on that
109199 day, except at private functions not open to the
110200 public,
111-
112201 e. increase the volume of alcoholic beverages contained
113202 in a drink without increasing proportionately the
114203 price regularly charged for such drink during the same
115204 calendar week, or
116-
117205 f. encourage or permit, on the licensed premises, any
118206 game or contest which involves drink ing or the
119207 awarding of drinks as prizes.
120-
121208 Provided, that the provisions of this paragraph shall not
122209 prohibit the advertising or offering of food, entertainment or
123210 bottle service in licensed establishments;
124-
125211 5. Permit or allow any patron or person to exit th e licensed
126212 premises with an open container of any alcoholic beverage.
127213 Provided, this prohibition shall not be applicable to closed
128214 original containers of alcoholic beverages which are carried from
129215 the licensed premises of a bottle club by a patron, closed original

130243 wine containers removed from the premises of restaurants, hotels and
131244 motels, or to closed original containers of alcoholic beverages
132245 transported to and from the place of business of a licensed caterer
133246 by the caterer or an employee of the caterer;

135247 6. Serve or sell alcoholic beverages with an expired license
136248 issued by the ABLE Commission;

138249 7. Permit any person to be drunk or intoxicated on the
139250 licensee's licensed premises; or

141251 8. Permit or allow any patron to serve or pour himself or
142252 herself any alcoholic beverage, except a licensee may offer a patron
143253 self-pour service of beer or wine, or both, from automated devices
144254 on licensed premises so long as:

146255 a. the licensee monitors and has the ability to control
147256 the dispensing of such beer or wine, or both, from the
148257 automated devices. "Automated device" shall mean any
149258 mechanized device capable of dispensing wine or beer,
150259 or both, directly to a patron in exchange for
151260 compensation that a licensee has received directly
152261 from the patron, and
153-
154262 b. each licensee offering a patron self-pour service of
155263 wine or beer, or both, from any automated device shall
156264 provide constant video monitoring of the automated
157265 device at all times during which the licensee is open
158266 to the public. The licensee shall keep recorded

160295 (60) days, and shall provide the footage, upon
161296 request, to any agent of the Director of the ABLE
162297 Commission or other authorized law enforcement agent.

164298 B. 1. The compensation require d by subparagraph a of paragrap h
165299 8 of subsection A of this section shall be in the form of a radio
166300 frequency identification (RFID) device, mobile application or any
167301 other technology approved by the ABLE Commission containing a fixed
168302 amount of volume of thirty -two (32) ounces for beer an d ten (10)
169303 ounces for wine that may be directly exchanged for beer or wine
170304 dispensed from the automated device:

172305 a. RFID devices may be assigned, used or reactivated only
173306 during a business day,
174-
175307 b. each RFID device shall be obt ained from the licensee
176308 by a patron,

178309 c. a licensee shall not issue more than one active RFID

310+device to a patron, and
181311 d. an RFID device shall be deemed active if the RFID
182312 device contains volume credit or has not yet been used
183313 to dispense ten (10) ounces of wine or thirty -two (32)
184314 ounces of beer.

186315 2. In order to obtain an RFID device from a licensee, each
187316 patron shall produce a valid driver license, identification card or
188317 other government-issued document that contains a photograph of the

189345 individual and demons trates that the individual is a t least twenty-
190346 one (21) years of age. Each RFID device shall be programmed to
191347 require the production of the patron 's valid identification before
192348 the RFID device can be used for the first time during any business
193349 day or for any subsequent reactivation.

195350 3. Each RFID device shall become inactive at the end of each
196351 business day.

198352 4. Each RFID device shall be programmed to allow the dispensing
199353 of no more than ten (10) ounces of wine or thirty -two (32) ounces of
200354 beer to a patron:

202355 a. once an RFID device has been used to dispense ten (10)
203356 ounces of wine or thirty -two (32) ounces of beer to a
204357 patron, the RFID device shall become inactive, and
205-
206358 b. any patron in possession of an inactive RFID device
207359 may, upon production of the patron 's valid
208360 identification to the lice nsee or licensee's employee,
209361 have the RFID device reactivated to allow the
210362 dispensing of an additional ten (10) ounces of wine or
211363 thirty-two (32) ounces of beer from an automated
212364 device.

214365 Paragraphs 1, 2, 3 and 4 of this subse ction shall not apply to wine
215366 or beer that is dispensed directly to the licensee or the licensee 's
216367 agent or employee.

218395 C. A mixed beverage or beer and wine licensee shall not be
219396 deemed to have violated the provisions of paragraph 5 of subsection
220397 A of this section if it allowed a patron to leave the licensed
221398 premises with an open container of beer or wine only and:

223399 1. The otherwise prohibited act was committed during the hours
224-of 8 a.m. to midnight on the day of a scheduled home football game ENR. H. B. NO. 2804 Page 6
400+of 8 a.m. to midnight on the day of a scheduled home football game
225401 of institutions within The Oklahoma State Sys tem of Higher
226402 Education, and the establishment is located within two thousand
227403 (2,000) feet of the institution;
228-
229404 2. The licensee is participating by invitation in a municipally
230405 sanctioned art, music or sporting event within city limits when the
231406 municipality has provided written notice of the event and a list of
232407 invited licensees to the ABLE Commission at least five (5) days
233408 prior to the event; or
234-
235409 3. The patron remains on the connected, physical property of
236410 the licensee or in a public area adjacent to the ph ysical property
237411 of the licensee with prior municipal approval; provided, that
238412 written notice of the use of the connected, physical property of the
239413 licensee or public area shall be provided to the ABLE Commission at
240414 least five (5) days prior to such use.

242415 SECTION 2. This act shall become effective November 1, 2025.
