3939 A Concurrent Resolution memorializing Congress to
4040 propose an amendment to the Constitution of the
4141 United States of America related to expenditure of
4242 funds in the political process; making findings; and
4343 providing for distribution .

4949 WHEREAS, the Constitution of the State of Oklahoma provides:
5050 "All political power is inherent in the people; and government is
5151 instituted for their protection, security, and benefit, and to
5252 promote their general welfare; and they have the right to alter or
5353 reform the same whenever the public good may require it: Provided,
5454 such change be not repugnant to the Constitution of the Unit ed
5555 States"; and
5656 WHEREAS, the People of Oklahoma believe that elected
5757 representatives should be responsive to the interests of their
5858 actual constituents, as evidenced by the Oklahoma legislature 's
5959 April 23, 2023, Joint Resolution No. 1032 in favor of a term limits
6060 amendment to the United States Constitution; and

8686 WHEREAS, the People of Oklahoma have a compelling sovereign
8787 interest in fostering robust political debate and self -government,
8888 protecting the free speech interests of all individuals, securing
8989 the liberty and political equality of our citizens, guarding against
9090 corruption, and advancing federalism and the interests of the
9191 several States; and
9292 WHEREAS, States may determine that reasonable regulation of how
9393 money is used to influence the outcomes of elec tions would (1)
9494 secure the interests of citizens of that State to be represented and
9595 participate in elections and self -government, and (2) protect the
9696 integrity of elections and government against out -of-state and
9797 foreign interests and undue influence of w ealthy special interests,
9898 whether of corporations, unions, or other artificial entities; and
9999 WHEREAS, over the past five decades, the Supreme Court has
100100 gradually come to equate unlimited election spending with "free
101101 speech". This unlimited spending — often hard to trace, and coming
102102 from out-of-state and even foreign interests — is drowning out the
103103 free speech interests of actual constituents, narrowing debate,
104104 weakening federalism and self-governance in the States, and
105105 increasing the risk of systemic corruption; and
106106 WHEREAS, the Framers wisely granted the States power to amend
107107 the Constitution when necessary to make it, and our Union, ever more
108108 perfect and to protect and preserve self -government and liberty.

134134 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF RE PRESENTATIVES
135135 OF THE 1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE, THE SENATE
136136 CONCURRING THEREIN:
137137 THAT, We the People of Oklahoma and the legislature of Oklahoma
138138 hereby call upon the United States Congress to propose and send to
139139 the States for ratification a Constitutional amendment to clarify
140140 that the States and Congress, within their respective jurisdictions,
141141 may reasonably regulate and limit the spending of money to influence
142142 campaigns, elections, or ballot measures .
143143 THAT, a suitable copy of this resolut ion be prepared and
144144 submitted to the Speaker of the United States House of
145145 Representatives, the Minority Leader of the House of
146146 Representatives, the Majority Leader of the United States Senate,
147147 the Minority Leader of the United States Senate, and to each m ember
148148 of the Oklahoma Congressional delegation .
