WHEREAS, the Constitution of the State of Oklahoma provides: "All political power is inherent in the people; and government is instituted for their protection, security, and benefit, and to promote their general welfare; and they have the right to alter or reform the same whenever the public good may require it: Provided, such change be not repugnant to the Constitution of the Unit ed States"; and WHEREAS, the People of Oklahoma believe that elected representatives should be responsive to the interests of their actual constituents, as evidenced by the Oklahoma legislature 's April 23, 2023, Joint Resolution No. 1032 in favor of a term limits amendment to the United States Constitution; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 WHEREAS, the People of Oklahoma have a compelling sovereign interest in fostering robust political debate and self -government, protecting the free speech interests of all individuals, securing the liberty and political equality of our citizens, guarding against corruption, and advancing federalism and the interests of the several States; and WHEREAS, States may determine that reasonable regulation of how money is used to influence the outcomes of elec tions would (1) secure the interests of citizens of that State to be represented and participate in elections and self -government, and (2) protect the integrity of elections and government against out -of-state and foreign interests and undue influence of w ealthy special interests, whether of corporations, unions, or other artificial entities; and WHEREAS, over the past five decades, the Supreme Court has gradually come to equate unlimited election spending with "free speech". This unlimited spending — often hard to trace, and coming from out-of-state and even foreign interests — is drowning out the free speech interests of actual constituents, narrowing debate, weakening federalism and self-governance in the States, and increasing the risk of systemic corruption; and WHEREAS, the Framers wisely granted the States power to amend the Constitution when necessary to make it, and our Union, ever more perfect and to protect and preserve self -government and liberty. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF RE PRESENTATIVES OF THE 1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE, THE SENATE CONCURRING THEREIN: THAT, We the People of Oklahoma and the legislature of Oklahoma hereby call upon the United States Congress to propose and send to the States for ratification a Constitutional amendment to clarify that the States and Congress, within their respective jurisdictions, may reasonably regulate and limit the spending of money to influence campaigns, elections, or ballot measures . THAT, a suitable copy of this resolut ion be prepared and submitted to the Speaker of the United States House of Representatives, the Minority Leader of the House of Representatives, the Majority Leader of the United States Senate, the Minority Leader of the United States Senate, and to each m ember of the Oklahoma Congressional delegation . 60-1-13065 MAH 03/03/25
