4141 A Joint Resolution directing the Secretary of State
4242 to refer to the people for their approval or
4343 rejection a proposed amendme nt to Section 13 of
4444 Article VI of the Constitution of the State of
4545 Oklahoma; requiring Governor to make appointments to
4646 fill vacancies in statewide elected offices;
4747 requiring appointment to be confirmed by majority
4848 vote of those elected to and constituting the
4949 Oklahoma State Senate ; providing ballot title; and

5454 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE
5555 1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
5656 SECTION 1. The Secretary of State shall refer to the people for
5757 their approval or rejection, as and in the manner provided by law,
5858 the following proposed amendment to Section 13 of Article VI of the
5959 Constitution of the State of Oklahoma to read as follows:
6060 Section 13. A. The Governor shall comm ission all officers not
6161 otherwise commissioned by law. All commissions shall run in the
6262 name and by the authority of the "State of Oklahoma," be signed by
6363 the Governor, sealed with the Great Seal of the State of Oklahoma,
6464 and attested by the Secretary of State.

9191 B. When any office shall become vacant, he shall, unless
9292 otherwise provided by law, appoint a person to fill such vacancy,
9393 who shall continue in office until a successor shall have been duly
9494 elected or appointed, and qualified according to law.
9595 C. If there is a vacancy in any statewide elected office, the
9696 Governor shall appoint a perso n to fill the vacancy and such
9797 appointee shall be subject to confirmation by a majority vote of
9898 those elected to and constituting the State Senate.

105105 THE GIST OF THE PROPOSITION IS AS FOLLOW S:
106106 This measure amends the Oklahoma Constitution. It amends Section
107107 13 of Article 6. This measure would require the Governor to
108108 appoint a person to fill a vacancy in any statewide elected
109109 office. The appointment would be subject to confirmation by a
110110 majority vote of the persons elected to and constituting the
111111 State Senate.
