41	41	A Joint Resolution directing the Secretary of State
42	42	to refer to the people for their approval or
43	43	rejection a proposed amendme nt to Section 13 of
44	44	Article VI of the Constitution of the State of
45	45	Oklahoma; requiring Governor to make appointments to
46	46	fill vacancies in statewide elected offices;
47	47	requiring appointment to be confirmed by majority
48	48	vote of those elected to and constituting the
49	49	Oklahoma State Senate ; providing ballot title; and

54	54	BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE
55	55	1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
56	56	SECTION 1. The Secretary of State shall refer to the people for
57	57	their approval or rejection, as and in the manner provided by law,
58	58	the following proposed amendment to Section 13 of Article VI of the
59	59	Constitution of the State of Oklahoma to read as follows:
60	60	Section 13. A. The Governor shall comm ission all officers not
61	61	otherwise commissioned by law. All commissions shall run in the
62	62	name and by the authority of the "State of Oklahoma," be signed by
63	63	the Governor, sealed with the Great Seal of the State of Oklahoma,
64	64	and attested by the Secretary of State.

91	91	B. When any office shall become vacant, he shall, unless
92	92	otherwise provided by law, appoint a person to fill such vacancy,
93	93	who shall continue in office until a successor shall have been duly
94	94	elected or appointed, and qualified according to law.
95	95	C. If there is a vacancy in any statewide elected office, the
96	96	Governor shall appoint a perso n to fill the vacancy and such
97	97	appointee shall be subject to confirmation by a majority vote of
98	98	those elected to and constituting the State Senate.

100	100	SECTION 2. The Ballot Title for the proposed Constitutional
101	101	amendment as set forth in SECTION 1 of this resolution shall be in

105	105	THE GIST OF THE PROPOSITION IS AS FOLLOW S:
106	106	This measure amends the Oklahoma Constitution. It amends Section
107	107	13 of Article 6. This measure would require the Governor to
108	108	appoint a person to fill a vacancy in any statewide elected
109	109	office. The appointment would be subject to confirmation by a
110	110	majority vote of the persons elected to and constituting the
111	111	State Senate.

141	141	SECTION 3. The Chief Clerk of the House of Representatives ,
142	142	immediately after the passage of this resolution, shall prepare and
143	143	file one copy thereo f, including the Ballot Title set forth in
144	144	SECTION 2 hereof, with the Secretary of State and one copy with the
145	145	Attorney General.
