HOUSE JOINT

AS INTRODUCED 
 
A Joint Resolution directing the Secretary of State 
to refer to the people for their approval or 
rejection a proposed amendme nt to Section 13 of 
Article VI of the Constitution of the State of 
Oklahoma; requiring Governor to make appointments to 
fill vacancies in statewide elected offices; 
requiring appointment to be confirmed by majority 
vote of those elected to and constituting the 
Oklahoma State Senate ; providing ballot title; and 
directing filing. 
 
 
 
BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE 
1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE: 
SECTION 1.  The Secretary of State shall refer to the people for 
their approval or rejection, as and in the manner provided by law, 
the following proposed amendment to Section 13 of Article VI of the 
Constitution of the State of Oklahoma to read as follows: 
Section 13. A. The Governor shall comm ission all officers not 
otherwise commissioned by law.  All commissions shall run in the 
name and by the authority of the "State of Oklahoma," be signed by 
the Governor, sealed with the Great Seal of the State of Oklahoma, 
and attested by the Secretary of State.

B. When any office shall become vacant, he shall, unless 
otherwise provided by law, appoint a person to fill such vacancy, 
who shall continue in office until a successor shall have been duly 
elected or appointed, and qualified according to law. 
C.  If there is a vacancy in any statewide elected office, the 
Governor shall appoint a perso n to fill the vacancy and such 
appointee shall be subject to confirmation by a majority vote of 
those elected to and constituting the State Senate. 
 
SECTION 2.  The Ballot Title for the proposed Constitutional 
amendment as set forth in SECTION 1 of this resolution shall be in 
the following form:

Legislative Referendum No. ____ State Question No. ____ 
THE GIST OF THE PROPOSITION IS AS FOLLOW S: 
This measure amends the Oklahoma Constitution. It amends Section 
13 of Article 6.  This measure would require the Governor to 
appoint a person to fill a vacancy in any statewide elected 
office.  The appointment would be subject to confirmation by a 
majority vote of the persons elected to and constituting the 
State Senate.

SECTION 3.  The Chief Clerk of the House of Representatives , 
immediately after the passage of this resolution, shall prepare and 
file one copy thereo f, including the Ballot Title set forth in 
SECTION 2 hereof, with the Secretary of State and one copy with the 
Attorney General.
