69	69	qualifications; stipulating dates of services;

78	78	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
79	79	SECTION 1. NEW LAW A new section of law to be codified
80	80	in the Oklahoma Statutes as Section 450.3 of Title 74, unless there
81	81	is created a duplication in numbering, reads as follows:
82	82	A. A member of the Legislature who enters active duty in the
83	83	Armed Forces of the United States as a result of being called to
84	84	duty, drafted, or activated does not vacate the office held, but a
85	85	replacement may be selected to serve as temporary acting officer as
86	86	provided by this section if the member will be on active duty for
87	87	longer than thirty (30) days.

139	139	B. The member of the Legislature shall select a person to serve
140	140	as the temporary acting representat ive or senator, subject to
141	141	approval of the selection by a majority vote of the appropriate
142	142	house of the Legislature. The temporary acting representative or
143	143	senator must be:
144	144	1. A member of the same political party as the member being
145	145	temporarily replaced; and
146	146	2. Qualified for office under Article V of the Oklahoma
147	147	Constitution.
148	148	C. The temporary acting member of the Legislature shall begin
149	149	service on the date specified in writing by the member being
150	150	temporarily replaced as the date the member will enter a ctive
151	151	military service.
152	152	D. A temporary acting member of the Legislature has all the
153	153	powers, privileges, and duties of the office and is entitled to the
154	154	same compensation, payable in the same manner and from the same
155	155	source, as the member who is temporaril y replaced. The member who
156	156	is temporarily replaced shall not receive compensat ion during the
157	157	term of active military service.
158	158	E. A temporary acting member of the Legislature appointed under
159	159	this section shall perform the duties of office for the shorter
160	160	period of:
161	161	1. The term of the active military service of the member who is
162	162	temporarily replaced; or

216	216	F. As used in this section, “Armed Forces of the United States ”
217	217	means the United States Army, the United States Navy, the United
218	218	States Air Force, the United States Ma rine Corps, the United States
219	219	Coast Guard, the United States Space Force, any reserve or auxiliary
220	220	component of any of those services, or the National Guard.
221	221	SECTION 2. This act shall become effective November 1, 2025.
