AS INTRODUCED 
 
An Act relating to the Legislature; providing for 
temporary replacement of member of the Legislature 
who enters active duty in the Armed Forces of the 
United States; specifying selection procedure and 
qualifications; stipulating dates of services; 
granting certain powers, privileges, and duties to 
temporary acting member; precluding certain 
compensation; defining term; providing for 
codification; and providing an effective date . 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 450.3 of Title 74, unless there 
is created a duplication in numbering, reads as follows: 
A.  A member of the Legislature who enters active duty in the 
Armed Forces of the United States as a result of being called to 
duty, drafted, or activated does not vacate the office held, but a 
replacement may be selected to serve as temporary acting officer as 
provided by this section if the member will be on active duty for 
longer than thirty (30) days.

B.  The member of the Legislature shall select a person to serve 
as the temporary acting representat ive or senator, subject to 
approval of the selection by a majority vote of the appropriate 
house of the Legislature.  The temporary acting representative or 
senator must be: 
1.  A member of the same political party as the member being 
temporarily replaced; and 
2.  Qualified for office under Article V of the Oklahoma 
Constitution. 
C.  The temporary acting member of the Legislature shall begin 
service on the date specified in writing by the member being 
temporarily replaced as the date the member will enter a ctive 
military service. 
D.  A temporary acting member of the Legislature has all the 
powers, privileges, and duties of the office and is entitled to the 
same compensation, payable in the same manner and from the same 
source, as the member who is temporaril y replaced. The member who 
is temporarily replaced shall not receive compensat ion during the 
term of active military service. 
E.  A temporary acting member of the Legislature appointed under 
this section shall perform the duties of office for the shorter 
period of: 
1.  The term of the active military service of the member who is 
temporarily replaced; or

2.  The term of office of the member who is temporarily 
replaced. 
F.  As used in this section, “Armed Forces of the United States ” 
means the United States Army, the United States Navy, the United 
States Air Force, the United States Ma rine Corps, the United States 
Coast Guard, the United States Space Force, any reserve or auxiliary 
component of any of those services, or the National Guard. 
SECTION 2.  This act shall become effective November 1, 2025.
