6758 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6859 SECTION 1. AMENDATORY 26 O.S. 2021, Section 3 -130, is
6960 amended to read as follows:
7061 Section 3-130. A. The Secretar y of the State Election Board
7162 shall have the authority to direct the secretary of a county
63+election board to conduct a post -election audit of election results
64+for any election, for the purpose of maintaining the security of the
65+election system by ensuring that voting devices and software used in
66+a particular election correctly tabulated votes. The Secretary

99-election board to conduct a post -election audit of election results
100-for any election, for the purpose of ma intaining the security of the
101-election system by ensuring that voting devices and software used in
102-a particular election correctly tabulated votes. The Secretary
10393 shall direct the secretary of the county election board in each
10494 county to conduct a post -election audit following elections held on
10595 dates set forth in Sections 1-101, 1-102, 1-103, and 20-101 of this
10696 title.
10797 B. The method, timing , and procedures for conducting a post -
10898 election audit shall be determined by the Secretary of the State
10999 Election Board.
110100 C. The secretary of a county election board shall report the
111101 findings of a post-election audit to the Secretary of the State
112102 Election Board, and such report shall be available to the public.
113103 D. The Secretary of the State Election Board may promulgate
114104 policies, rules, and procedures to implement the requirements of
115105 this section.
116106 E. For the purposes of this title, a “post -election audit” is
117107 defined as means a manual or electronic examination of a limited
118108 number of ballots by a secretary of a county election board or other
119109 authorized election officials following a n election. A post-
120110 election audit shall be conducted only at the direction of the
121111 Secretary of the State Election Board and only subject to the
112+Secretary’s previously promulgated prescribed policies, rules, or
113+procedures.
114+SECTION 2. This act shall become effective November 1, 2025.
