AS INTRODUCED
An Act relating to the state Medicaid program;
directing certain program delivery model; requiring
certain transition, contracts, and re imbursement;
directing termination of specified contracts;
providing certain construction; requiring the
Oklahoma Health Care Authority to seek certain
federal approval; directing promulgation of rules;
repealing 56 O.S. 2021, Section 4002.1, which relates
to the state Medicaid program; repealing 56 O.S.
2021, Sections 4002.2, 4002.4, 4002.6, 4002.7, and
4002.12, as last amended by Sections 1, 4, 5, 6, and
7, Chapter 448, O.S.L. 2024 (56 O.S. Supp. 2024,
Sections 4002.2, 4002.4, 4002.6, 4002.7, and
4002.12), which relate to the state Medicaid program;
repealing 56 O.S. 2021, Section 4002.2, as last
amended by Section 1, Chapter 206, O.S.L. 2024 (56
O.S. Supp. 2024, Section 4002.2), which relates to
the state Medicaid program; repealing 56 O.S. 2021,
Section 4002.5, as last amended by Section 1, Chapter
243, O.S.L. 2023 (56 O.S. Supp. 2024, Section
4002.5), which relates to the state Medicaid program;
repealing 56 O.S. 2021, Sections 4002.8, 4002.10,
4002.11, and 4002.13, as amended by Sections 12, 13,
14, and 18, Chapter 395, O.S.L. 2022 (56 O.S. Supp.
2024, Sections 4002.8, 4002.10, 4002.11, and
4002.13), which relate to the state Medicaid program;
repealing 56 O.S. 2021, Section 4002.15, as amended
by Section 20, Chapter 395, O.S.L. 2022, and as
renumbered by Section 24, Chapter 395, O.S.L. 2022
(56 O.S. Supp. 2024, Section 4002.15), which relates
to the state Medicaid program; repealing Sections 1,
5, 6, 8, 16, 17, and 19, Chapter 395, O.S.L. 2022 (56
O.S. Supp. 2024, Sections 4002.1a, 4002.3c, 4002.3d,
4002.4a, 4002.12a, 4002.12b, and 4002.14), which
relate to the state Medicaid program; repealing

Sections 3 and 4, Chapter 395, O.S.L. 2022, as
amended by Sections 2 and 3, Chapter 448, O.S.L. 2024
(56 O.S. Supp. 2024, Sections 4002.3a and 4002.3b),
which relate to the state Medicaid program; providing
for codification; and providing an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 4002 of Title 56, unless there
is created a duplication in numbering, reads as follows:
A. Upon receipt of federal approval as described in subsection
C of this section, the state Medicaid program shall return to a fee -
for-service delivery model. The Oklahoma Health Care Authority
shall transition all Medicaid members covered by a contracted entity
to direct coverage by the Authority , shall enter into such contracts
with health care providers as are necessary to ensure network
adequacy as required by federal regulation , and shall directly
reimburse such providers . Upon completion of such transition and
execution of contracts , the Authority shall terminate its contracts
with all contracted entities .
B. Nothing in this section shall be construed to prohibit the
Authority from implementing value -based payment arrangements with
Medicaid providers through direct contractual agreements.
C. The Authority shall seek any federal approval necessary to
implement the provisions of this section.

D. The Oklahoma Health Care Authority Board shall promulgate
rules to implement the provisions of this section.
SECTION 2. REPEALER 56 O.S. 2021, Section 4002.1, is
hereby repealed.
SECTION 3. REPEALER 56 O. S. 2021, Sections 4002.2,
4002.4, 4002.6, 4002.7, and 4002.12, as last amended by Sections 1,
4, 5, 6, and 7, Chapter 448, O.S.L. 2024 (56 O.S. Supp. 2024,
Sections 4002.2, 4002.4, 4002.6, 4002.7, and 4002.12), are hereby
repealed.
SECTION 4. REPEALER 56 O.S. 2021, Section 4002.2, as
last amended by Section 1, Chapter 206, O.S.L. 2024 (56 O.S. Supp.
2024, Section 4002.2), is hereby repealed.
SECTION 5. REPEALER 56 O.S. 2021, Section 4002.5, as
last amended by Section 1, Chapter 243, O.S.L. 2023 (56 O.S. Supp.
2024, Section 4002.5), is h ereby repealed.
SECTION 6. REPEALER 56 O.S. 2021, Sections 4002.8,
4002.10, 4002.11, and 4002.13, as amended by Sections 12, 13, 14,
and 18, Chapter 395, O.S.L. 2022 (56 O.S. Supp. 2024, Sections
4002.8, 4002.10, 4002.11, and 4002.13), are hereby repealed.
SECTION 7. REPEALER 56 O.S. 2021, Section 4002.15, as
amended by Section 20, Chapter 395, O.S.L. 2022, and as renumbered
by Section 24, Chapter 395, O.S.L. 2022 (56 O.S. Supp. 2024, Section
4002.15), is hereby repealed.

SECTION 8. REPEALER Sections 1, 5, 6, 8, 16, 17, and 19,
Chapter 395, O.S.L. 2022 (56 O.S. Supp. 2024, Section s 4002.1a,
4002.3c, 4002.3d, 4002.4a, 4002.12a, 4002.12b, and 4002.14), are
hereby repealed.
SECTION 9. REPEALER Sections 3 and 4, Chapter 395,
O.S.L. 2022, as amended by Sections 2 and 3, Chapter 448, O.S.L.
2024 (56 O.S. Supp. 2024, Sections 4002.3a and 4002.3b), are hereby
repealed.
SECTION 10. This act shall become effe ctive November 1, 2025.
