57	46		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
58	47		SECTION 1. AMENDATORY Section 1, Chapter 372, O.S.L.
59	48		2023 (27A O.S. Supp. 2024, Section 3 -8-101), is amended to read as
60	49		follows:
61	50		Section 3-8-101. This act shall be known and may be cited as
62	51		the “Terry Peach North Canadian Watershed Water Restoration Act”.
63	52		SECTION 2. AMENDATORY Section 2, Chapter 372, O.S.L.
64	53		2023 (27A O.S. Supp. 2024, Section 3 -8-102), is amended to read as
65	54		follows:
	55	+	Section 3-8-102. A. As used in the Terry Peach North Canadian
	56	+	Watershed Water Restoration Act:
	57	+	1. “Commission” means the Oklahoma Conservation Commission;
	58	+	2. “Harmful woody species ” means a tree or shrub species that
	59	+	is rapidly encroaching into adjoining lands and is likely to cause
	60	+	harm to the environment or economy. Harmful woody species include,

93		-	Section 3-8-102. A. As used in the Terry Peach North Canadian
94		-	Watershed Water Restoration Act:
95		-	1. “Commission” means the Oklahoma Conservation Commission;
96		-	2. “Harmful woody species ” means a tree or shrub species that
97		-	is rapidly encroaching into adjoining lands and is likely to cause
98		-	harm to the environment or economy. Harmful woody species include,
99	87		but are not limited to, Juniperus virginiana (Eastern Redcedar),
100	88		Juniperus scopulorum (Rocky Mountain juniper), Juniperus monosperma
101	89		(oneseed juniper) and, Tamarix ramosissima (salt cedar), Juniperus
102	90		pinchotii (redberry juni per), Juniper ashei (ashe juniper ), and
103	91		Prosopis glandulosa (honey mesquite) ; and
104	92		3. “North Canadian Watershed” means the an area of land in
105	93		Oklahoma that drains or sheds water into the North Canadian River a
106	94		waterway or water basin .
107	95		B. There Subject to the availability of funds, there is hereby
108	96		created a statewide pilot program to remove or eradicate harmful
109	97		woody species in the North Canadian Watershed watersheds to be
110	98		administered by through the Oklahoma Conservation Commission. To
111	99		accomplish the goals listed in this section, the Commission is
112	100		authorized to use the funds available in the North Canadian
113	101		Watershed Water Restoration Revolving Fund established in Section 3
114	102		of this act 3-8-103 of this title. The purpose of the program is to
115	103		manage and eradicate, where possible, harmful woody species that
116	104		damage grazing lands, create significant wildfire risk, reduce
	105	+	wildlife habitat and reduce water flow into the North Canadian River
	106	+	waterways and water basins.
	107	+	C. In administering the pilot program, the Co mmission shall:
	108	+	1. Cooperate with landowners, state agencies, and other
	109	+	political subdivisions for removal of harmful woody species;

146		-	C. In administering the pilot program, the Commission shall:
147		-	1. Cooperate with landowners, state agencies, and other
148		-	political subdivisions for removal of harmful woody species;
149	136		2. Measure the density of harmful woody species and estimate
150	137		water used by those species;
151	138		3. Create a study using a para llel watershed with no control of
152	139		harmful woody species;
153	140		4. Utilize available funds to cost -share with landowners ,
154	141		recognized governmental entities , or not-for-profit organizations
155	142		for expenses incurre d in the eradication of harmful woody species by
156	143		prescribed burn, biological controls, mechanical removal, or
157	144		herbicide applications;
158	145		5. Develop grant programs with conservation districts, rural
159	146		fire departments, and prescribe burn associations for resources
160	147		needed for prescribed burns, mechanical removal, b iological control,
161	148		or herbicide applications on harmful woody species;
162	149		6. Bring attention to the problems posed by harmful woody
163	150		species to create awareness, demonstrate value to all stakeholders,
164	151		and encourage landowners to participate in the program; an d
165	152		7. Have at least two three active project areas in the program,
166	153		consisting either of one above the Canton Lake dam and one below ,
	154	+	above Lake Overholser, and the North Fork Red River into Lugert -
	155	+	Altus Reservoir.
	156	+	D. The Commission is authorized to promul gate any rules and
	157	+	procedures to effectuate the provisions of this section.

198	184		SECTION 3. AMENDATORY Section 3, Chapter 372, O.S.L.
199	185		2023 (27A O.S. Supp. 2024, Section 3 -8-103), is amended to read as
200	186		follows:
201	187		Section 3-8-103. There is hereby created in the State Treasury
202	188		a revolving fund for the Oklahoma Conservation Commission to be
203	189		designated the “North Canadian Watershed Water Restoration Revolving
204	190		Fund”. The fund shall be a continuing fund, not subject to fiscal
205	191		year limitations, and shall consist of all monies received by the
206	192		Conservation Commission from appropriations, federal grants or
207	193		funds, municipal contributions, private contributions, and any other
208	194		sources, including in terest earned from the income in the fund, that
209	195		are designated for deposit to such fund or designated for duties
210	196		associated with harmful woody species removal from the North
211	197		Canadian Watershed watersheds throughout the state . All monies
212	198		accruing to the credit of said the fund are hereby appropriated and
213	199		may be budgeted and expended by the Conservation Commission to
214	200		perform the duties imposed on the Commission by law. Expenditures
215	201		from said the fund shall be made upon warrants issued by the State
216	202		Treasurer against claims filed as prescribed by law with the
	203	+	Director of the Office of Management and Enterprise Services for
	204	+	approval and payment.
	205	+	SECTION 4. This act shall become effective November 1, 2025.
