5746 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
5847 SECTION 1. AMENDATORY Section 1, Chapter 372, O.S.L.
5948 2023 (27A O.S. Supp. 2024, Section 3 -8-101), is amended to read as
6049 follows:
6150 Section 3-8-101. This act shall be known and may be cited as
6251 the “Terry Peach North Canadian Watershed Water Restoration Act”.
6352 SECTION 2. AMENDATORY Section 2, Chapter 372, O.S.L.
6453 2023 (27A O.S. Supp. 2024, Section 3 -8-102), is amended to read as
6554 follows:
55+Section 3-8-102. A. As used in the Terry Peach North Canadian
56+Watershed Water Restoration Act:
57+1. “Commission” means the Oklahoma Conservation Commission;
58+2. “Harmful woody species ” means a tree or shrub species that
59+is rapidly encroaching into adjoining lands and is likely to cause
60+harm to the environment or economy. Harmful woody species include,

93-Section 3-8-102. A. As used in the Terry Peach North Canadian
94-Watershed Water Restoration Act:
95-1. “Commission” means the Oklahoma Conservation Commission;
96-2. “Harmful woody species ” means a tree or shrub species that
97-is rapidly encroaching into adjoining lands and is likely to cause
98-harm to the environment or economy. Harmful woody species include,
9987 but are not limited to, Juniperus virginiana (Eastern Redcedar),
10088 Juniperus scopulorum (Rocky Mountain juniper), Juniperus monosperma
10189 (oneseed juniper) and, Tamarix ramosissima (salt cedar), Juniperus
10290 pinchotii (redberry juni per), Juniper ashei (ashe juniper ), and
10391 Prosopis glandulosa (honey mesquite) ; and
10492 3. “North Canadian Watershed” means the an area of land in
10593 Oklahoma that drains or sheds water into the North Canadian River a
10694 waterway or water basin .
10795 B. There Subject to the availability of funds, there is hereby
10896 created a statewide pilot program to remove or eradicate harmful
10997 woody species in the North Canadian Watershed watersheds to be
11098 administered by through the Oklahoma Conservation Commission. To
11199 accomplish the goals listed in this section, the Commission is
112100 authorized to use the funds available in the North Canadian
113101 Watershed Water Restoration Revolving Fund established in Section 3
114102 of this act 3-8-103 of this title. The purpose of the program is to
115103 manage and eradicate, where possible, harmful woody species that
116104 damage grazing lands, create significant wildfire risk, reduce
105+wildlife habitat and reduce water flow into the North Canadian River
106+waterways and water basins.
107+C. In administering the pilot program, the Co mmission shall:
108+1. Cooperate with landowners, state agencies, and other
109+political subdivisions for removal of harmful woody species;

146-C. In administering the pilot program, the Commission shall:
147-1. Cooperate with landowners, state agencies, and other
148-political subdivisions for removal of harmful woody species;
149136 2. Measure the density of harmful woody species and estimate
150137 water used by those species;
151138 3. Create a study using a para llel watershed with no control of
152139 harmful woody species;
153140 4. Utilize available funds to cost -share with landowners ,
154141 recognized governmental entities , or not-for-profit organizations
155142 for expenses incurre d in the eradication of harmful woody species by
156143 prescribed burn, biological controls, mechanical removal, or
157144 herbicide applications;
158145 5. Develop grant programs with conservation districts, rural
159146 fire departments, and prescribe burn associations for resources
160147 needed for prescribed burns, mechanical removal, b iological control,
161148 or herbicide applications on harmful woody species;
162149 6. Bring attention to the problems posed by harmful woody
163150 species to create awareness, demonstrate value to all stakeholders,
164151 and encourage landowners to participate in the program; an d
165152 7. Have at least two three active project areas in the program,
166153 consisting either of one above the Canton Lake dam and one below ,
154+above Lake Overholser, and the North Fork Red River into Lugert -
155+Altus Reservoir.
156+D. The Commission is authorized to promul gate any rules and
157+procedures to effectuate the provisions of this section.

196-D. The Commission is authorized to promulgate any rules and
197-procedures to effectuate the provisions of this section.
198184 SECTION 3. AMENDATORY Section 3, Chapter 372, O.S.L.
199185 2023 (27A O.S. Supp. 2024, Section 3 -8-103), is amended to read as
200186 follows:
201187 Section 3-8-103. There is hereby created in the State Treasury
202188 a revolving fund for the Oklahoma Conservation Commission to be
203189 designated the “North Canadian Watershed Water Restoration Revolving
204190 Fund”. The fund shall be a continuing fund, not subject to fiscal
205191 year limitations, and shall consist of all monies received by the
206192 Conservation Commission from appropriations, federal grants or
207193 funds, municipal contributions, private contributions, and any other
208194 sources, including in terest earned from the income in the fund, that
209195 are designated for deposit to such fund or designated for duties
210196 associated with harmful woody species removal from the North
211197 Canadian Watershed watersheds throughout the state . All monies
212198 accruing to the credit of said the fund are hereby appropriated and
213199 may be budgeted and expended by the Conservation Commission to
214200 perform the duties imposed on the Commission by law. Expenditures
215201 from said the fund shall be made upon warrants issued by the State
216202 Treasurer against claims filed as prescribed by law with the
203+Director of the Office of Management and Enterprise Services for
204+approval and payment.
205+SECTION 4. This act shall become effective November 1, 2025.
