79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A new section of law to be codified
81	81	in the Oklahoma Statutes as Section 104 of Title 66, unless there is
82	82	created a duplication in numbering, reads as f ollows:
83	83	As used in this act:
84	84	1. “Branch line” means a secondary railroad track that branches
85	85	off from a main line;
86	86	2. “Main line” means a Class I railroad as documented in
87	87	current timetables filed by the Class I railroad with the Federal
88	88	Railroad Administration under 49 C.F.R. , Section 217.7 when the

140	140	railroad has five million (5,0 00,000) or more gross tons of railroad
141	141	traffic transported annually;
142	142	3. “Railroad” means any form of non -highway ground
143	143	transportation that runs on rails or electromagnetic guid eways;
144	144	4. “Train” means one or more locomotives, coupled with or
145	145	without cars, that require an air brake test in accordance with 49
146	146	C.F.R., Part 232 or 238; and
147	147	5. “Siding or passing track ” means a sidetrack with switches at
148	148	both ends.
149	149	SECTION 2. NEW LAW A new section of law to be codified
150	150	in the Oklahoma Statutes as Section 105 of Title 66, unless there is
151	151	created a duplication in numbering, reads as follows:
152	152	A. No railroad company operating in this state shall run or
153	153	permit to be run any train that exceeds eight thousand five hundred
154	154	(8,500) feet in length or exceeds the length of the shortest siding
155	155	or passing track on which it travels on any main line or branch
156	156	line, or that routinely or repeatedly blocks any intersection for
157	157	periods exceeding ten (10) minutes at one time.
158	158	B. Except as provided in subse ction C of this section, if any
159	159	railroad company has been determined by the Transportation
160	160	Commission as willfully violating subsection A of this section, the
161	161	company shall be liable for a civil penalty not less than Five
162	162	Hundred Dollars ($500.00) per foot nor more than One Thousand

214	214	Dollars ($1,000.00) per foot of the length of a train exceeding the
215	215	limitation set forth in subsection A of this section.
216	216	C. Any railroad company tha t commits a grossly negligent
217	217	violation or that has a pattern of repeated viol ations, which the
218	218	Transportation Commission has determined caused an imminent threat
219	219	of death or injury to another person or that caused death or injury
220	220	to another person, shall be subject to a fine not to exceed Two
221	221	Hundred Fifty Thousand Dollars ($250,000.00).
222	222	D. In determining the amount of a civil penalty under this
223	223	section, the Transportation Commission shall consider the:
224	224	1. Nature, circumstances, extent, and seriousness o f the
225	225	violation; and
226	226	2. Degree of culpability, history of violations, ability to
227	227	pay, and any effect on the violator ’s ability to continue to do
228	228	business.
229	229	E. At the request of the Transportation Commission, the
230	230	Attorney General may initiate a civil actio n in any court of
231	231	competent jurisdiction to collect any civil penalty imposed pursuant
232	232	to this section. A civil action under this section shall be
233	233	commenced within three (3) years of the date of the violation or
234	234	within three (3) years of the latest violat ion if a repeated offense
235	235	is alleged.

288	288	deposited in the State Transportation Fund created under Section
289	289	1501.1 of Title 69 of the Oklahoma Statutes.
290	290	SECTION 3. This act shall become effective November 1, 2025.
