8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law not to be
8383 codified in the Oklahoma Statutes reads as follows:
8484 A. This act shall be known and may be cited as the “Oklahoma
8585 Diesel Engine Freedom Act ”.
8686 B. The Legislature finds and declares that:
8787 1. Article I, Section 8, Clause 3 of the United States
8888 Constitution grants the United States Congress power to regulate
8989 commerce “among the several states ”, not intrastate commerce or
9090 activities solely within one state;

142142 2. The federal government’s mandate requiring the use of diesel
143143 exhaust fluid in diesel engines operating within this state exceed s
144144 the powers delegated to Congress under Article I, Section 8, and are
145145 therefore unconstitutional;
146146 3. Under the 10th Amendment to the United States Constitution,
147147 powers not delegated to the federal government nor prohibited to the
148148 states are reserved to the states or to the people, granting this
149149 state the authority to regulate emissions standards for vehicles
150150 used within its borders; and
151151 4. It is the duty of this state to protect its citizens from
152152 unconstitutional overreach and burdensome regulations that are
153153 outside the bounds of federal authority.
154154 SECTION 2. NEW LAW A new section of law to be codified
155155 in the Oklahoma Statutes as Section 12-429 of Title 47, unless there
156156 is created a duplication in numbering, reads as follows:
157157 A. Pursuant to the 10th Amendment of the United States
158158 Constitution, this state asserts its sovereign right to regulate
159159 emissions standards for vehicles operating within its borders when
160160 such vehicles are not engaged in interstate commerce.
161161 B. This state declares that any federal regulation, executive
162162 order, or mandate requiring the use of diesel exhaust fluid in
163163 diesel engines operating solely within this state is null and void,
164164 as it exceeds the constitutional authority granted to the United

218218 C. No state agency, political subdivision, or officer of this
219219 state shall enforce or attempt to enforce any federal law,
220220 regulation, or executive order requiring the use of diesel exhaust
221221 fluid for vehicles operating within this state.
222222 SECTION 3. NEW LAW A new section of law to be codified
223223 in the Oklahoma Statutes as Section 12-430 of Title 47, unless there
224224 is created a duplication in numbering, reads as follows:
225225 A. 1. The manufacture , sale, and installation of diesel
226226 engines and equipment that do not require diesel exhaust fluid shall
227227 be fully lawful within this state.
228228 2. No state agency, political subdivis ion, or officer of this
229229 state shall prohibit or restrict the production, sale, or use of
230230 non-diesel exhaust fluid engines within this state.
231231 B. 1. Non-diesel exhaust fluid engines manufactured and sold
232232 exclusively within this state are declared exempt fr om federal
233233 emissions standards, pursuant to this state ’s authority over
234234 intrastate commerce provided by the 10th Amendment to the United
235235 States Constitution.
236236 2. Such engines shall be clearly labeled for use within this
237237 state and may not be exported for us e in other states unless
238238 compliant with applicable federal laws.

290290 SECTION 4. NEW LAW A new section of law to be codified
291291 in the Oklahoma Statutes as Section 12-431 of Title 47, unless there
292292 is created a duplication in numbering, read s as follows:
293293 Any state agency, political subdivision, or individual found to
294294 be enforcing or attempting to enforce any federal diesel exhaust
295295 fluid mandate within this state shall be subject to the following:
296296 1. A civil fine up to Five Thousand Dollars ( $5,000.00) per
297297 violation;
298298 2. An immediate suspension of the authority to enforce state
299299 laws or regulations related to vehicle emissions for a period no
300300 less than twelve (12) months; and
301301 3. For state officers or employees, termination of employment
302302 and a prohibition on holding public office or state employment for a
303303 period of five (5) years.
304304 SECTION 5. REPEALER 47 O.S. 2021, Section 12 -423, is
305305 hereby repealed.
306306 SECTION 6. It being immediately necessary for the prese rvation
307307 of the public peace, health or safety, an emergency is hereby
308308 declared to exist, by reason whereof this act shall take effect and
309309 be in full force from and after its passage and approval.
