4142 An Act relating to law enforcement officers; defining
4243 terms; directing prosecuting agencies that mainta in
4344 Brady-Giglio lists to adopt certain policies;
4445 directing prosecuting agencies to provide certain

4748 written notice after making certain determinations;
4849 requiring certain information within the written
4950 notice; authorizing officers to submit requests for
5051 reconsideration; providing procedures for requesting

5253 prosecuting agencies; allowing prosecuting agencies
5354 the ability to remove names; stating restriction for
5455 causes of action; providing for codification; and

6162 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6263 SECTION 1. NEW LAW A new section of law to be codified
6364 in the Oklahoma Statutes as Section 39.1 of Title 22, unless there
6465 is created a duplication i n numbering, reads as follows:
6566 A. As used in this section:
6667 1. “Brady-Giglio list” means a list compiled by a prosecuting
6768 individual that contains the names and details of officers who have

95+sustained incidents of untruthfulness, criminal convictions, candor
9696 issues, or some other type of issue which places the credibility of
9797 the officer into question;
9898 2. “Officer” means a certified law enforcement of ficer, peace
9999 officer, firefighter, emergency medical technician, corrections
100100 officer, detention officer, jai ler, probation or parole officer,
101101 communications officer, or any other law enforcement officer
102102 certified by the Council on Law Enforcement Education and Training
103103 and employed by a municipality, county, or state agency; and
104104 3. “Prosecuting individual ” means the Attorney General, a
105105 district attorney, a special prosecutor, a city attorney, or any
106106 other individual authorized to prosecute crimes in this s tate.
107107 B. A prosecuting individual that maintains a Brady -Giglio list
108108 shall adopt a policy that includes, bu t is not limited to, the
109109 following information:
110110 1. The criteria used by the prosecuting individual to place an
111111 officer on a Brady-Giglio list;
112112 2. The right of the officer to receive written notice before
113113 the prosecuting individual places the officer on a Brady-Giglio
114114 list;
115115 3. The right of the officer to provide input to the prosecuting
116116 individual before the prosecuting individual makes a final
117117 determination of whether the officer should be placed on a Brady-
118118 Giglio list;

146145 4. The duty of the prosecuting in dividual to provide notice of
147146 his or her decision regarding placement of the officer on a Brady-
148147 Giglio list;
149148 5. The right of the officer to make a requ est for
150149 reconsideration of the determination of the prosecuting individual
151150 to include the officer on a Brady-Giglio list and to submit
152151 supporting and corroborating documents and evidence in support of
153152 the request for reconsideration made by the officer; an d
154153 6. The applicable time frame and procedures for notifying the
155154 officer of the final decision of the pr osecuting individual on the
156155 request for reconsideration made by the officer.
157156 C. Before a prosecuting individual places an officer on a
158157 Brady-Giglio list, the prosecuting individual shall send a written
159158 notice by United States Postal Service mail or electronic mail to
160159 the current or last known employer of the officer. Upon receipt of
161160 the notice, and if the contact information of the officer is known,
162161 the current or last known employer of the officer shall provide the
163162 written notice to the officer. The wri tten notice shall include,
164163 but not be limited to, the following information:
165164 1. A statement that the officer may be placed on a Brady-Giglio
166165 list maintained by the prosecuting individual;
167166 2. The right of the officer to request documents, records, and
168167 any other evidence in the possession of the prosecuting individual

196194 relevant to the determination of placing the officer on a Brady-
197195 Giglio list maintained b y the prosecuting individual;
198196 3. The right of the officer to provide information to the
199197 prosecuting individual prior to the prosecuting individual making
200198 his or her final determination; and
201199 4. The procedural requirements for the officer to provide
202200 information to the prosecuting individual prior to the prosecuting
203201 individual’s final determination, including the method and time
204202 frame for submitting the request for reconsideration and any
205203 supporting and corroborating documents and evidence from any
206204 pertinent sources.
207205 D. If a prosecuting individual makes the determination to place
208206 an officer on a Brady -Giglio list, the prosecuting individual shall
209207 send a written notice by United States Postal Service or electronic
210208 mail to the current or last known employer of the officer. Upon
211209 receipt of the notice, and if the contact information of the officer
212210 is known, the current or last known employer of the officer shall
213211 provide the written notice to the officer. The written notice shall
214212 include, but not be limited to, the following information:
215213 1. The right of the officer to make a request to reconsider his
216214 or her placement on the Brady-Giglio list maintained by the
217215 prosecuting individual;
218216 2. The procedural requirements for an officer to prov ide
219217 information to the pro secuting individual prior to the prosecuting

247244 individual’s final determination, including the method and time
248245 frame for submitting the request for reconsideration and any
249246 supporting and corroborating documents and evidence from any
250247 pertinent sources; and
251248 3. A statement that, if the officer intends to make a request
252249 for reconsideration, the officer must submi t the written request for
253250 reconsideration to the prosecuting individual within thirty (30)
254251 days of the notice being sent to th e officer’s current or last known
255252 employer.
256253 E. If an officer submits a request for reconsideration pursuant
257254 to this subsection and the request for reconsideration made by the
258255 officer is approved by the prosecuting individual, the officer shall
259256 be removed from the Brady -Giglio list maintained by the prosecuting
260257 individual. If the request for reconsideration made by the officer
261258 is denied by the prosecuting individual, the name of the officer
262259 shall remain on the Brady -Giglio list maintained by the prosecutin g
263260 individual. If the offi cer does not submit a request for
264261 reconsideration or fails to comply with the requirements for
265262 submitting a request for reconsideration, the name of the officer
266263 shall remain on the Brady -Giglio list maintained by the prosecuting
267264 individual.
268265 F. An officer whose name was placed on the Brady -Giglio list
269266 maintained by the prosecuting individual prior to the eff ective date

297293 of this act shall have the right to request reconsideration as
298294 follows:
299295 1. A prosecuting individual who maintains a Brady-Giglio list
300296 prior to the effective date of this act shall notify all officers on
301297 the list within ninety (90) days of the effective date of this act,
302298 pursuant to provisions of subsection D of this section; and
303299 2. Upon receipt of a notification from a prosecuting individual
304300 pursuant to paragraph 1 of this subsection, the officer who intends
305301 to make a request for reconsiderati on must submit the written
306302 request to the prosecuting individual within thirty (30) days of the
307303 notice being sent to the offic er’s current or last known employer.
308304 G. The provisions of this section shall not be construed to
309305 limit the duty of a prosecuting individual to produce Brady -Giglio
310306 discovery evidence in all cases as required by the United States
311307 Constitution, the Oklahoma Constitution, and the rul es of criminal
312308 procedure, including after the initial placement of an officer on a
313309 Brady-Giglio list, while the decision or a request for
314310 reconsideration is still under consideration.
315311 H. The provisions of this section shall not b e construed to
316312 limit or restrict the ability of a prosecuting individual to remove
317313 an officer from a Brady -Giglio list if, upon receipt of additional
318314 supporting and corroborating information or a change in factual
319315 circumstances at any time, the prosecuting individual determines

347342 that the officer no longer requires placement on a Brady-Giglio
348343 list.
349344 I. The provisions of this section sh all not create a private
350345 cause of action against a prosecuting individual or an employee of a
351346 prosecuting individual for any damages caused by the inclu sion of an
352347 officer on a Brady-Giglio list maintained by a prosecuting
353348 individual.
354349 SECTION 2. This act shall become effective November 1, 2025.
