42	43		terms; directing prosecuting agencies that mainta in
43	44		Brady-Giglio lists to adopt certain policies;
44	45		directing prosecuting agencies to provide certain
45	46		notices; requiring certain information within the
46	47		notice; directing prosecuting agencies to provide
47	48		written notice after making certain determinations;
48	49		requiring certain information within the written
49	50		notice; authorizing officers to submit requests for
50	51		reconsideration; providing procedures for requesting
51	52		reconsideration; stating continuing duty of
52	53		prosecuting agencies; allowing prosecuting agencies
53	54		the ability to remove names; stating restriction for
54	55		causes of action; providing for codification; and
55	56		providing an effective date.

61	62		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
62	63		SECTION 1. NEW LAW A new section of law to be codified
63	64		in the Oklahoma Statutes as Section 39.1 of Title 22, unless there
64	65		is created a duplication i n numbering, reads as follows:
65	66		A. As used in this section:
66	67		1. “Brady-Giglio list” means a list compiled by a prosecuting
67	68		individual that contains the names and details of officers who have
68		-	sustained incidents of untruthfulness, criminal convictions, candor

	95	+	sustained incidents of untruthfulness, criminal convictions, candor
96	96		issues, or some other type of issue which places the credibility of
97	97		the officer into question;
98	98		2. “Officer” means a certified law enforcement of ficer, peace
99	99		officer, firefighter, emergency medical technician, corrections
100	100		officer, detention officer, jai ler, probation or parole officer,
101	101		communications officer, or any other law enforcement officer
102	102		certified by the Council on Law Enforcement Education and Training
103	103		and employed by a municipality, county, or state agency; and
104	104		3. “Prosecuting individual ” means the Attorney General, a
105	105		district attorney, a special prosecutor, a city attorney, or any
106	106		other individual authorized to prosecute crimes in this s tate.
107	107		B. A prosecuting individual that maintains a Brady -Giglio list
108	108		shall adopt a policy that includes, bu t is not limited to, the
109	109		following information:
110	110		1. The criteria used by the prosecuting individual to place an
111	111		officer on a Brady-Giglio list;
112	112		2. The right of the officer to receive written notice before
113	113		the prosecuting individual places the officer on a Brady-Giglio
114	114		list;
115	115		3. The right of the officer to provide input to the prosecuting
116	116		individual before the prosecuting individual makes a final
117	117		determination of whether the officer should be placed on a Brady-
118	118		Giglio list;

146	145		4. The duty of the prosecuting in dividual to provide notice of
147	146		his or her decision regarding placement of the officer on a Brady-
148	147		Giglio list;
149	148		5. The right of the officer to make a requ est for
150	149		reconsideration of the determination of the prosecuting individual
151	150		to include the officer on a Brady-Giglio list and to submit
152	151		supporting and corroborating documents and evidence in support of
153	152		the request for reconsideration made by the officer; an d
154	153		6. The applicable time frame and procedures for notifying the
155	154		officer of the final decision of the pr osecuting individual on the
156	155		request for reconsideration made by the officer.
157	156		C. Before a prosecuting individual places an officer on a
158	157		Brady-Giglio list, the prosecuting individual shall send a written
159	158		notice by United States Postal Service mail or electronic mail to
160	159		the current or last known employer of the officer. Upon receipt of
161	160		the notice, and if the contact information of the officer is known,
162	161		the current or last known employer of the officer shall provide the
163	162		written notice to the officer. The wri tten notice shall include,
164	163		but not be limited to, the following information:
165	164		1. A statement that the officer may be placed on a Brady-Giglio
166	165		list maintained by the prosecuting individual;
167	166		2. The right of the officer to request documents, records, and
168	167		any other evidence in the possession of the prosecuting individual

196	194		relevant to the determination of placing the officer on a Brady-
197	195		Giglio list maintained b y the prosecuting individual;
198	196		3. The right of the officer to provide information to the
199	197		prosecuting individual prior to the prosecuting individual making
200	198		his or her final determination; and
201	199		4. The procedural requirements for the officer to provide
202	200		information to the prosecuting individual prior to the prosecuting
203	201		individual’s final determination, including the method and time
204	202		frame for submitting the request for reconsideration and any
205	203		supporting and corroborating documents and evidence from any
206	204		pertinent sources.
207	205		D. If a prosecuting individual makes the determination to place
208	206		an officer on a Brady -Giglio list, the prosecuting individual shall
209	207		send a written notice by United States Postal Service or electronic
210	208		mail to the current or last known employer of the officer. Upon
211	209		receipt of the notice, and if the contact information of the officer
212	210		is known, the current or last known employer of the officer shall
213	211		provide the written notice to the officer. The written notice shall
214	212		include, but not be limited to, the following information:
215	213		1. The right of the officer to make a request to reconsider his
216	214		or her placement on the Brady-Giglio list maintained by the
217	215		prosecuting individual;
218	216		2. The procedural requirements for an officer to prov ide
219	217		information to the pro secuting individual prior to the prosecuting

248	245		frame for submitting the request for reconsideration and any
249	246		supporting and corroborating documents and evidence from any
250	247		pertinent sources; and
251	248		3. A statement that, if the officer intends to make a request
252	249		for reconsideration, the officer must submi t the written request for
253	250		reconsideration to the prosecuting individual within thirty (30)
254	251		days of the notice being sent to th e officer’s current or last known
255	252		employer.
256	253		E. If an officer submits a request for reconsideration pursuant
257	254		to this subsection and the request for reconsideration made by the
258	255		officer is approved by the prosecuting individual, the officer shall
259	256		be removed from the Brady -Giglio list maintained by the prosecuting
260	257		individual. If the request for reconsideration made by the officer
261	258		is denied by the prosecuting individual, the name of the officer
262	259		shall remain on the Brady -Giglio list maintained by the prosecutin g
263	260		individual. If the offi cer does not submit a request for
264	261		reconsideration or fails to comply with the requirements for
265	262		submitting a request for reconsideration, the name of the officer
266	263		shall remain on the Brady -Giglio list maintained by the prosecuting
267	264		individual.
268	265		F. An officer whose name was placed on the Brady -Giglio list
269	266		maintained by the prosecuting individual prior to the eff ective date

297	293		of this act shall have the right to request reconsideration as
298	294		follows:
299	295		1. A prosecuting individual who maintains a Brady-Giglio list
300	296		prior to the effective date of this act shall notify all officers on
301	297		the list within ninety (90) days of the effective date of this act,
302	298		pursuant to provisions of subsection D of this section; and
303	299		2. Upon receipt of a notification from a prosecuting individual
304	300		pursuant to paragraph 1 of this subsection, the officer who intends
305	301		to make a request for reconsiderati on must submit the written
306	302		request to the prosecuting individual within thirty (30) days of the
307	303		notice being sent to the offic er’s current or last known employer.
308	304		G. The provisions of this section shall not be construed to
309	305		limit the duty of a prosecuting individual to produce Brady -Giglio
310	306		discovery evidence in all cases as required by the United States
311	307		Constitution, the Oklahoma Constitution, and the rul es of criminal
312	308		procedure, including after the initial placement of an officer on a
313	309		Brady-Giglio list, while the decision or a request for
314	310		reconsideration is still under consideration.
315	311		H. The provisions of this section shall not b e construed to
316	312		limit or restrict the ability of a prosecuting individual to remove
317	313		an officer from a Brady -Giglio list if, upon receipt of additional
318	314		supporting and corroborating information or a change in factual
319	315		circumstances at any time, the prosecuting individual determines

347	342		that the officer no longer requires placement on a Brady-Giglio
348	343		list.
349	344		I. The provisions of this section sh all not create a private
350	345		cause of action against a prosecuting individual or an employee of a
351	346		prosecuting individual for any damages caused by the inclu sion of an
352	347		officer on a Brady-Giglio list maintained by a prosecuting
353	348		individual.
354	349		SECTION 2. This act shall become effective November 1, 2025.
