7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 42 O.S. 2021, Section 91A, as last
8181 amended by Section 29, Chapter 452, O.S.L. 2024 (42 O.S. Supp. 2024,
8282 Section 91A), is amended to read as follows:
8383 Section 91A. A. 1. a. This section applies to all types of
8484 personal property other than:
8585 (1) farm equipment as defined in Section 91.2 of this
8686 title, and
8787 (2) “Section 91 Personal Property ” as defined in
8888 Section 91 of this title.

140140 b. This section applies to any vehicle, all -terrain
141141 vehicle, utility vehicle, manufactured home,
142142 motorcycle, boat, outboa rd motor, or trailer that is
143143 excluded from coverage under subsection A of Sect ion
144144 91 of this title because the personal property:
145145 (1) does not have a certificate of title,
146146 (2) has a certificate of title but does not have an
147147 active lien recorded on the cert ificate of title,
148148 (3) has a certificate of title that is not issued by
149149 Service Oklahoma or by a federally recognized
150150 Indian tribe in the State of Oklahoma, or
151151 (4) is otherwise excluded by subparagraph b of
152152 paragraph 1 of subsection A of Section 91 of this
153153 title or subsection D of Section 91 of this
154154 title.
155155 c. If personal property has a certificate of title, or
156156 would be required to have a certificate of title under
157157 Oklahoma law, and is apparently covered both by this
158158 section and by Sections 191 through 200 of this title,
159159 the procedures set out in this section shall apply
160160 instead of Sections 191 through 200 of this title. If
161161 personal property without a certificate of title and
162162 not required to be titled under Oklahoma law is
163163 covered both by this section and Sec tions 191 through

216216 191 through 200 of this title shall apply instead of
217217 this section.
218218 2. a. Any person who, while lawfully in possession of an
219219 article of personal property to which this section
220220 applies, renders any service to the owner thereof by
221221 furnishing storage, rental space, material, labor or
222222 skill for the protection, improvement, safekeeping,
223223 towing, right to occupy space, storage or carriage
224224 thereof, has a special lien thereon, dependent on
225225 possession, for the compensation, if any, which is due
226226 to such person from the owner for such service.
227227 Charges owed under a contract primarily for the
228228 purpose of storage or rental of space shall be accrued
229229 only at the regular periodic rate for storage or
230230 rental as provided in the contract, adjusted for
231231 partial periods of storage or rental.
232232 b. Except for Class AA licensed wrecker towing charges,
233233 the special lien shall be subordinate to any perfected
234234 security interest unless the claimant complies with
235235 the requirements of this section. Failure to comply
236236 with any requirements of this section shall result in
237237 denial of any title application and cause the special
238238 lien to be subordinate to any perfected lien . Upon

290290 such denial, the applicant shall be entitled to one
291291 resubmission of the title application within thirty
292292 (30) business days of receipt of the denial , and
293293 proceed to comply with the requirements of this
294294 section. In the event of a denial, the Notice of
295295 Possessory Lien and the Notice of Sale may be mailed
296296 on the same day in separate envelopes and storage
297297 charges shall only be charged from the date of
298298 resubmission; however, before a Notice of Sale is to
299299 be mailed, the personal property must have been
300300 possessed by the possessory lien claimant for at least
301301 twenty-one (21) days. Furthermore, if the denial was
302302 due to error by the party submitting the title
303303 application, then no additional fee for the
304304 resubmission shall be charged to the property owner.
305305 (1) “Failure to comply” includes, but is not limited
306306 to:
307307 (1) (a) failure to timely provide additional
308308 documentation supporting or verifying any
309309 entry on submitted forms as requested by
310310 Service Oklahoma,
311311 (2) (b) failure to provide the documentation
312312 supporting lawful possession as outlined in
313313 paragraph 3 of subsection H of t his section,

366366 individual who provided the service giving
367367 rise to the special lien, as in subparagraph
368368 a of this paragraph,
369369 (4) (d) claimant not being in possession of
370370 the vehicle, or
371371 (5) (e) notification and proceedings not
372372 accomplished in accordance with subparagraph
373373 c of this paragraph, and par agraph 3 of this
374374 subsection, and
375375 (2) Failure to comply shall not include:
376376 (a) clerical errors that do not affect or
377377 reflect the true intent of the notice, or
378378 (b) events out of the control of the claimant.
379379 Such events may include, but not be limited
380380 to, changes in ownership of the property or
381381 interested party information while such
382382 property is in the possession of the
383383 claimant.
384384 c. Any person claiming a lien under this section shal l
385385 request, within five (5) business days of performing
386386 any service or work on the property, Service Oklahoma
387387 or other appropriate license agency to furnish the
388388 name and address of the current owner of and any

440440 lienholder upon the property. Service Oklahoma or an
441441 appropriate license agency shall respond in person or
442442 by mail to the lien claimant within ten (10) business
443443 days of the receipt of the request for information.
444444 Service Oklahoma shall render assistance to ascertain
445445 ownership, if needed. The lien cl aimant shall send,
446446 within seven (7) business days of receipt of the
447447 requested information from Service Oklahoma or other
448448 license agency, a notice of the location of the
449449 property by certified mail with return receipt
450450 requested, postage prepaid, to the owner and any
451451 lienholder of the vehicle at the addresses furnished.
452452 The lien claimant may charge not more than Fifty
453453 Dollars ($50.00) for processing plus the cost of
454454 postage if the notice is timely sent pursuant to the
455455 requirements of this subparagraph in addi tion to fees
456456 regulated by the Corporation Commission for licensed
457457 wreckers. If the lien claimant is unable to meet the
458458 time requirements due to a lack of or an altered
459459 vehicle identification number on the property, the
460460 lien claimant shall proceed diligent ly to obtain the
461461 proper vehicle identification number and shall meet
462462 the time requirements on the notice once the vehicle

516516 change of ownership or lienhol der after it has timely
517517 complied with the requirements of this subparagraph,
518518 the lien claimant shall remain in compliance if such
519519 additional notices are sent within the required time
520520 periods from the date of discovery of the new owners
521521 or lienholders. The notice shall be in writing and
522522 shall contain, but not be limited to, the following:
523523 (1) a statement that the notice is a Notice of
524524 Possessory Lien,
525525 (2) the complete legal name, physical and mailing
526526 address, and telephone number of the claimant,
527527 (3) the complete legal name, physical and mailing
528528 address of the person who requested th at the
529529 claimant render service to the owner by
530530 furnishing material, labor or skill, storage, or
531531 rental space, or the date the property was
532532 abandoned if the claimant did not rende r any
533533 other service,
534534 (4) a description of the article of personal
535535 property, and the complete physical and mailing
536536 address of the location of the article of
537537 personal property,

589589 (5) the nature of the work, labor or service
590590 performed, material furnished, or th e storage or
591591 rental arrangement, and the date thereof, and
592592 written proof of authority to perform the work,
593593 labor or service provided that, in the case of a
594594 law enforcement directed tow, the logbook entry
595595 prescribed in OAC 595:25 -5-5 or the tow ticket as
596596 defined by the Corporation Commission shall serve
597597 as written proof of authority,
598598 (6) the signature of the claimant which shall be
599599 notarized and, if applicable, the signature of
600600 the claimant’s attorney. If the claimant is a
601601 business, the name of the contact person
602602 representing the business shall be shown. In
603603 place of an original sign ature and notary seal, a
604604 digital or electronic signature or seal shall be
605605 accepted, and
606606 (7) an itemized statement describing the date or
607607 dates the labor or services were performe d and
608608 material furnished and the charges claimed for
609609 each item, the totals of which shall equal the
610610 total compensation claimed.
611611 The lien claimant shall not be required to send the
612612 notice required in this subparagraph if the property

665665 is mailed and no additional charges or fees cont inue
666666 to accrue. If a law enforcement agency has the
667667 property towed to a law enforcement facility, the
668668 person claiming a lien under this section shall not be
669669 required to send not ice until the property is released
670670 by law enforcement to the claimant or the date which
671671 claimant starts charging storage, whichever is
672672 earlier. A lien claimant shall have an extension of
673673 ten (10) business days to send the notice required in
674674 this subparagraph if a state of emergency has been
675675 declared in the county in which the prope rty is
676676 located.
677677 d. Subparagraphs b and c of this paragraph shall not
678678 apply to salvage pools as defined in Section 591.2 of
679679 Title 47 of the Oklahoma Statutes.
680680 3. The lien may be foreclosed by a sale of such personal
681681 property upon the notice and in the manner following: The notice
682682 shall be in writing and shall contain, but not be limited to:
683683 a. the names of the owner and any other known party or
684684 parties who may claim any interest in the property,
685685 b. a description of the property to be sold, including a
686686 visual inspection or a photograph if the property is a

739739 property,
740740 c. the nature of the work, labor or service performed,
741741 material furnished, or the storage or rental
742742 arrangement, and the date thereof, and written proof
743743 of authority to perform the work, labor or service
744744 provided. In the case of a law enforcement directed
745745 tow, the logbook entry prescribed in OAC 595:25 -5-5 or
746746 the tow ticket as defined by the Corporation
747747 Commission, shall serve as written proof of au thority,
748748 d. the time and place of sale,
749749 e. the name, telephone number, physical address and
750750 mailing address of the claimant, and agent or
751751 attorney, if any, foreclosing such lien. If the
752752 claimant is a business, then the name of the contact
753753 person representing the business must be shown. In

814814 shall be mailed to the owner and any other party
815815 claiming any interest in the property, if known, at
816816 their last-known post office address, by certified
817817 mail, return receipt requested, at least ten (10) days
818818 before the time therein specified for such sale. If
819819 the item of personal property is a manufactured home,
820820 notice shall also be sent by certified mail to the
821821 county treasurer and to the county assessor of the
822822 county where the manufactured home is located.
823823 b. In the case of any item of personal property without a
824824 certificate of title and not required to be titled
825825 under Oklahoma law, a party who claims any interest in
826826 the property shall include all owners of the property;
827827 any secured party who has an active financing
828828 statement on file with the county clerk of Oklah oma
829829 County listing one or more owners of the property by
830830 legal name as debtors and indicating a collateral
831831 description that would include the property; and any
832832 other person having any interest in the personal
833833 property, of whom the claimant has actual notic e.
834834 c. In the case of personal property subject to this
835835 section for which a certificate of title has been
836836 issued by any jurisdiction, a party who claims any

889889 the article of personal property as indicated b y the
890890 certificate of title; lien debtors, if any, other than
891891 the owners; any lienholder whose lien is noted on the
892892 face of the certificate of title; and any other person
893893 having any interest in the article of personal
894894 property, of whom the claimant has actu al notice.
895895 d. When the jurisdiction of titling for a vehicle, all -
896896 terrain vehicle, motorcycle, boat, outboard motor, or
897897 trailer that is five (5) model years old or newer, or
898898 a manufactured home that is fifteen (15) model years
899899 old or newer, cannot be deter mined by ordinary means,
900900 the claimant, the agent of the claimant, or the
901901 attorney of the claimant, shall request, in writing,
902902 that Service Oklahoma ascertain the jurisdiction where
903903 the vehicle or manufactured home is titled. Service
904904 Oklahoma shall, within fourteen (14) days from the
905905 date the request is received, provide information as
906906 to the jurisdiction where the personal property is
907907 titled. If Service Oklahoma is unable to provide the
908908 information, it shall provide notice that the record
909909 is not available.
910910 e. When personal property is of a type that Oklahoma law
911911 requires to be titled, the owner of record of that

963963 property is unknown, and the jurisdiction of titling
964964 and owner of record cannot be determined by ordinary
965965 means and also, if applicable, cannot be determined in
966966 accordance with the preceding subparagraph, then the
967967 special lien may be foreclosed by publication of a
968968 legal notice in a legal newspaper in the county where
969969 the personal property is located, as defined in
970970 Section 106 of Title 25 of the Okla homa Statutes.
971971 Such notice shall include the description of the
972972 property by year, make, vehicle identification number
973973 if available from the property, the name of the
974974 individual who may be contacted for information, and
975975 the telephone number of that person or the address
976976 where the vehicle is located. The legal notice shall
977977 be published once per week for three (3) consecutive
978978 weeks. As soon as circumstances exist as described in
979979 the first sentence of this subparagraph, the first
980980 date of publication may occu r even if the special lien
981981 has not accrued for over thirty (30) days. The fir st
982982 date available for public sale of the vehicle is the
983983 day following publication of the final notice, but no
984984 fewer than thirty (30) days after the lien has
985985 accrued. When the ow ner of record is unknown, the
986986 Notice of Sale nevertheless must be completed and

10401040 parties shall include all persons described in
10411041 subparagraph b or subparagrap h c of this paragraph,
10421042 whichever is applicable, with the exception of any
10431043 owner who is unknown. Except in circumstances
10441044 described in paragraph 7 of this subsection that
10451045 provide for a shorter time period, the Notice of Sale
10461046 shall be posted in two public pl aces in the county
10471047 where the property is to be sold at least ten (10)
10481048 days before the time therein specified for such sale,
10491049 and the Notice of Sale shall not be mailed until at
10501050 least thirty (30) days after the lien has accrued.
10511051 5. The lienor or any other p erson may in good faith become a
10521052 purchaser of the property sold.
10531053 6. Proceedings for foreclosure under this act shall commence in
10541054 twenty (20) days after the lien has accrued, except as provided
10551055 elsewhere in Oklahoma law.
10561056 7. Notwithstanding any other provi sion of law, proceedings for
10571057 foreclosures for the storage of junk vehicles towed and stored
10581058 pursuant to Section 955 of Title 47 of the Oklahoma Statutes by
10591059 Class AA wreckers listed with the Motor Vehicle Division of the
10601060 Department of Public Safety, may be commenced five (5) days after
10611061 the lien has accrued. For purposes of this para graph, “junk

11181118 guidebook, adjusting to the condition of the vehicle.
11191119 B. 1. a. Any person who is induced by mea ns of a check or other
11201120 form of written order for immediate payment of money
11211121 to deliver up possession of an article of personal
11221122 property on which the person has a special lien
11231123 created by subsection A of this section, which check
11241124 or other written order is di shonored, or is not paid
11251125 when presented, shall have a lien for the amount
11261126 thereof upon the personal property.
11271127 b. The person claiming such lien shall, within thirty
11281128 (30) days from the date of dishonor of the check or
11291129 other written order for payment of money , file in the
11301130 office of the county clerk of the county in which the
11311131 property is situated a sworn statement that:
11321132 (1) the check or other written order for immediate
11331133 payment of money, copy thereof being attached,
11341134 was received for labor, material or supplies for
11351135 producing or repairing an article of personal

11971197 2. a. Any person who renders service to the owner of an
11981198 article of personal property by furnishing storage,
11991199 rental space, material, labor, or skill for the
12001200 protection, improvement, safekeeping, towing, right to
12011201 occupy space, storage, or carriage thereof shall have
12021202 a special lien on such property pursuant to th is
12031203 section if such property is removed from the person ’s
12041204 possession, without s uch person’s written consent or
12051205 without payment for such service.
12061206 b. The person claiming such lien shall, within five (5)
12071207 days of such nonauthorized removal, file in the office
12081208 of the county clerk of the county in which the
12091209 property is located, a sworn statement including:

12681268 personal property on or in relation to which the
12691269 service was rendered, and
12701270 (4) that the debt for the serv ices rendered on or in
12711271 relation to the article of personal property was
12721272 not paid. Provided, if the unpaid total amount
12731273 of the debt for services rendered on or in
12741274 relation to the article of personal property is
12751275 unknown, an approximated amount of the debt d ue
12761276 and owing shall be included in the sworn
12771277 statement but such approximated de bt may be
12781278 amended within thirty (30) days of such filing to
12791279 reflect the actual amount of the debt due and
12801280 owing.
12811281 3. The enforcement of the lien shall be within sixty (60) days
12821282 after filing the lien in the manner provided by law for enforcing
12831283 the lien of a security agreement and provided that the lien shall

13371337 C. If the person who renders service to the owner of an article
13381338 of personal property to which this section applies relinquishes or
13391339 loses possession of the article due to circumstances described in
13401340 subparagraph a of paragraph 1 or subparagraph a of paragraph 2 of
13411341 subsection B of this section, the person cl aiming the lien shall be
13421342 entitled to possession of the article until the amount due is paid,
13431343 unless the article is possessed by a person who became a bona fide
13441344 purchaser. Entitlement to possession shall be in accordance with
13451345 the following:
13461346 1. The claimant may take possession of an article pursuant to
13471347 this subsection only if the pe rson obligated under the contract for
13481348 services has signed an acknowledgment of receipt of a notice that
13491349 the article may be subject to repossession. The notice and
13501350 acknowledgment pursuant to this subsection shall be:
13511351 a. in writing and separate from the written contract for
13521352 services, or
13531353 b. printed on the written contract for services, credit
13541354 agreement or other document which displays the notice
13551355 in bold-faced, capitalized and underl ined type, or is
13561356 separated from surrounding written material so as to
13571357 be conspicuous with a separate signature line;

14091409 2. The claimant may require the person obligated under the
14101410 contract for services to pay the costs of repossession as a
14111411 condition for reclaiming the article only to the extent of the
14121412 reasonable fair market value of the services required to take
14131413 possession of the article;
14141414 3. The claimant shall not transfer to a third party or to a
14151415 person who performs repossession services, a check, money orde r, or
14161416 credit card transaction that is received as payment for services
14171417 with respect to an article and that is returned to the claimant
14181418 because of insufficient funds or no funds, because the person
14191419 writing the check, issuing the money order, or credit cardh older has
14201420 no account or because the check, money order, or credit card account
14211421 has been closed. A person violating this paragraph shall be guilty
14221422 of a misdemeanor; and
14231423 4. An article that is repossessed pursuant to this subsection
14241424 shall be promptly delive red to the location where the services were
14251425 performed. The article shall rema in at the services location at all
14261426 times until the article is lawfully returned to the record owner or
14271427 a lienholder or is disposed of pursuant to this section.
14281428 D. 1. This section applies if a vehicle, all -terrain vehicle,
14291429 manufactured home, motorcycle, boat, outboard motor, or trailer has
14301430 a certificate of title issued by Service Oklahoma or by a federally
14311431 recognized Indian tribe in Oklahoma, but there is no active lien
14321432 recorded on the certificate of title.

14841484 2. This section applies if a vehicle, all -terrain vehicle,
14851485 utility vehicle, motorcycle, boat, outboard motor or trailer has a
14861486 certificate of title issued by Service Oklahoma or by a federally
14871487 recognized Indian tribe in Oklahom a, and there is an active lien
14881488 recorded on the certificate of title, but the lien is over fifteen
14891489 (15) years old.
14901490 3. This section applies if personal property to which Section
14911491 91 of this title otherwise would apply has been registered by
14921492 Service Oklahoma or by a federally recognized Indian tribe in the
14931493 State of Oklahoma, and there is a lien of record but no certificate
14941494 of title has been issued.
14951495 4. This section applies if personal property to which Section
14961496 91 of this title otherwise would apply has not bee n registered by
14971497 either Service Oklahoma or a federally recognized Indian tribe in
14981498 the State of Oklahoma, and no certificate of title has been issued,
14991499 but there is a lien of record.
15001500 5. This section applies to personal property that otherwise
15011501 would be covered by Section 91 of this title, except that the
15021502 services were rendered or the property was abandoned prior to
15031503 November 1, 2005.
15041504 6. This section applies to a vehicle, all -terrain vehicle,
15051505 utility vehicle, manufactured home, motorcycle, boat, outboard
15061506 motor, or trailer for which ownership cannot be determined by
15071507 ordinary means or by Service Oklahoma Motor Vehicle Division, as

15641564 8. This section applies to salvage pools as defined in Section
15651565 591.2 of Title 47 of the Oklahoma Statutes.
15661566 9. This section applies to class AA licensed wrecker services
15671567 taking possession of a vehicle pursuant to an agreement with, or at
15681568 the direction of, or dispatched by a state or local law enforcement
15691569 or government agency, or pursuant to the abandoned vehicle removal
15701570 provisions of Section 9 54A of Title 47 of the Oklahoma Statutes with
15711571 respect to all types of personal property, regardless of whether
15721572 that personal property has a certificate of title.
15731573 10. For a vehicle abandoned at a salvage pool, if the cost of
15741574 repairing the vehicle for safe operation on the highway does not
15751575 exceed sixty percent (60%) of the fair market value of the vehicle
15761576 as defined in Section 1111 of Title 47 of the Oklahoma Statutes, a
15771577 salvage title shall not be required.
15781578 E. A person who knowingly makes a false statement of a material
15791579 fact regarding the furnishing of storage, rental space, material ,
15801580 labor or skill for the protection, improvement, safekeeping, towing,
15811581 right to occupy space, storage or carriage thereof in a proceeding
15821582 under this section, or attempts to use o r uses the provisions of

16361636 are false, upon conviction, shall be guilty of a felony.
16371637 F. Upon receipt of notice of legal proceed ings, Service
16381638 Oklahoma shall cause the sale process to be put on hold until no tice
16391639 of resolution of court proceedings is received from the court. If
16401640 such notice of commencement of court proceedings is not filed with
16411641 Service Oklahoma, the possessory lien s ale process may continue.
16421642 G. No possessory lien sale shall be held on a Sunday.
16431643 H. For purposes of this section:
16441644 1. “Possession” includes actual possession and constructive
16451645 possession;
16461646 2. “Constructive possession ” means possession by a person who,
16471647 although not in actual possession, does not have an intention to
16481648 abandon property, knowingly has both power and the intention at a
16491649 given time to exercise dominion or control over the property, and
16501650 who holds claim to such thing by virtue of some legal right;
16511651 3. “Lawfully in possession ” means a person has documentation
16521652 from the owner or the owner ’s authorized agent, or an insurance
16531653 company or its authorized agent, authorizing the furnishing of
16541654 material, labor or storage, or that the property was authorized to
16551655 be towed to a repair facility.
16561656 Class AA wrecker services taking possession of a vehicle
16571657 pursuant to an agreement with, or at the direction of, or dispatched

17151715 4. “Itemized charges” means total parts, total labor, total
17161716 towing fees, total storage fees, total pr ocessing fees and totals of
17171717 any other fee groups, the sum total of which shall equal the
17181718 compensation claimed.
17191719 I. For purposes of this section, the United States Postal
17201720 Service approved electronic equivalent of proof of return receipt
17211721 requested Form 3811 shall satisfy return receipt requested
17221722 documentation requirements.
17231723 J. If a person claiming a special lien pursuant to this section
17241724 fails to comply with any of the requirements o f this section, any
17251725 interested party may proceed against the person claiming s uch lien
17261726 for all damages arising therefrom, including conversion, if the
17271727 article of personal property has been sold. If the notice or
17281728 notices required by this section shall be s hown to be knowingly
17291729 false or fraudulent, the interested party shall be entitled to
17301730 treble damages. The prevailing party shall be entitled to all
17311731 costs, including reasonable attorney fees.

17831783 K. Any interested party shall be permitted to visually inspect
17841784 and verify the services rendered by the claimant prior to the sale
17851785 of the article of property during normal business hours. If the
17861786 claimant fails to allow any interested party to inspect the
17871787 property, the interested party shall mail a request for inspection
17881788 by certified mail, return receipt requested, to the claimant.
17891789 Within three (3) business days of receipt of the request for
17901790 inspection, the claimant shall mail a photograph of the property, by
17911791 certified mail, return receipt requested, and a date of inspec tion
17921792 within five (5) business days from the date of the notice to
17931793 inspect. The lienholder shall be allowed to retrieve the property
17941794 without being required to bring the title into the lienholder ’s
17951795 name, if the lienholder provides proof it is a lienholder a nd any
17961796 payment due the claimant for lawful charges where the claimant has
17971797 complied with this section. Upon the release of personal property
17981798 to an insurer or representative of the insurer, wrecker operators
17991799 shall be exempt from all liability and shall be h eld harmless for
18001800 any losses or claims of loss. In the event any law enforceme nt
18011801 agency places a hold on the property, the party wanting to inspect
18021802 or photograph the property shall obtain permission from the law
18031803 enforcement agency that placed the hold on t he property before
18041804 inspecting or photographing.
18051805 L. This section shall apply to all actions or proceedings that
18061806 commence on or after August 22, 2014.
