7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new section of law to be codified
7777 in the Oklahoma Statutes as Section 1 -725.11 of Title 63, unless
7878 there is created a duplication in numbering, reads as follows:
7979 As used in this act:
8080 1. “Collection action” means any of the following actions taken
8181 with respect to a debt for items and services that were purchased
8282 from, or provided to a patient by, a hospital on a date during which
8383 the hospital was not in material compliance with hospital price
8484 transparency laws:
8585 a. attempting to collect a debt from a patient or patient
8686 guarantor by referring the debt, directly or
8787 indirectly, to a debt collector, collection agency, or

139139 other third party retained by or on behal f of the
140140 hospital,
141141 b. suing the patient or patient guarantor or enforcing an
142142 arbitration or mediation clause in any hospital
143143 documents, including contracts, agreements,
144144 statements, or bills, or
145145 c. directly or indirectly causing a report to be made to
146146 a consumer reporting agency;
147147 2. a. “Collection agency” means any:
148148 (1) person who engages in a business, the principal
149149 purpose of which is the collection of debts, or
150150 (2) person who:
151151 (a) regularly collects or attempts to collect,
152152 directly or indirectly, debts ow ed or due or
153153 asserted to be owed or due to another,
154154 (b) takes assignment of debts for collection
155155 purposes, or
156156 (c) directly or indirectly solicits for
157157 collection debts owed or due or asserted to
158158 be owed or due to another.
159159 b. Collection agency does not include:
160160 (1) any officer or employee of a creditor while, in
161161 the name of the creditor, collect ing debts for
162162 such creditor,

214214 (2) any person while acting as a collection agency
215215 for another person, both of whom are related by
216216 common ownership or affiliated by corpo rate
217217 control, if the person acting as a collection
218218 agency does so only for creditors to whom it is
219219 so related or affiliated and if the principal
220220 business of the person is not the collection of
221221 debts,
222222 (3) any officer or employee of the United States or
223223 any state to the extent that collecting or
224224 attempting to collect any debt is in the
225225 performance of the officer ’s or employee’s
226226 official duties,
227227 (4) any person while serving or attemp ting to serve
228228 legal process on any other person in connection
229229 with the judicial enforcement of any debt,
230230 (5) any person collecting or attempting to collect
231231 any debt owed or due or asserted to be owed or
232232 due to another to the extent that:
233233 (a) the activity is incidental to a bona fide
234234 fiduciary obligation or a bona fide escrow
235235 arrangement,
236236 (b) the activity concerns a debt that was
237237 extended by the person,

289289 (c) the activity concerns a debt that was not in
290290 default at the time it was obtained by the
291291 person, or
292292 (d) the activity concerns a debt obtained by the
293293 person as a secured party in a c ommercial
294294 credit transaction involving the creditor,
295295 or
296296 (6) any person whose principal business is the making
297297 of loans or the servicing of debt not in default
298298 and who acts as a loan correspondent, seller and
299299 servicer for the owner, or holder of a debt that
300300 is secured by a deed of trust on real property,
301301 whether or not the debt is also secured by an
302302 interest in personal property.
303303 c. Notwithstanding the provisions of subparagraph b of
304304 this paragraph, collection agency includes any person
305305 who, in the process o f collecting the person ’s own
306306 debts, uses another name that would indicate that a
307307 third person is collecting or attempting to collect
308308 such debts;
309309 3. a. “Debt” means any obligation or alleged obligation of a
310310 consumer to pay money arising out of a transaction,
311311 whether or not the obligation has been reduced to
312312 judgment.

364364 b. Debt does not include a debt for business, investment,
365365 commercial, or agricultural purposes or a debt
366366 incurred by a business;
367367 4. “Debt collector” means any person employed or engaged by a
368368 collection agency to perform the collection of debts owed or due or
369369 asserted to be owed or due to another;
370370 5. “Hospital” means, consistent with 45 C.F.R., Section 180.20,
371371 a hospital licensed by the State Department of Health under Section
372372 1-702 of Title 63 of the Oklahoma Statutes; and
373373 6. “Items and services” or “items or services” means items and
374374 services as defined in 45 C.F.R., Section 180.20.
375375 SECTION 2. NEW LAW A new section of law to be codified
376376 in the Oklahoma Statutes as Sect ion 1-725.12 of Title 63, unless
377377 there is created a duplication in numbering, reads as follows:
378378 A. On and after the effective date of this act, no debt
379379 collector shall initiate or pursue a collection action against the
380380 patient or patient guarantor for a debt owed for the items or
381381 services purchased from , or provided to a patient by , the hospital
382382 to a collection agency.
383383 B. Nothing in this act:
384384 1. Prohibits a hospital from billin g a patient, patient
385385 guarantor, or third-party payer, including a health insur er, for
386386 items or services provided to the patient; or

438438 2. Requires a hospital to refund any payment made to the
439439 hospital for items or services provided to the patient, so long as
440440 no collection action is taken in violation of this act.
441441 SECTION 3. This act shall become effective November 1, 2025 .
