98 | 98 | | 3. The carrying, possession , and use of any weapon by a peace |
---|
99 | 99 | | officer or other person authorized by law to carry a weapon in the |
---|
100 | 100 | | performance of official duties a nd in compliance with the rules of |
---|
101 | 101 | | the employing agency; |
---|
102 | 102 | | 4. The carrying or use of weapons in a courthouse by a district |
---|
103 | 103 | | judge, associate district judg e, or special district judge within |
---|
104 | 104 | | this state, who is in possession of a valid handgun license issued |
---|
105 | 105 | | pursuant to the provisions of the Oklahoma Self -Defense Act and |
---|
106 | 106 | | whose name appears on a list maintained by the Administrative |
---|
107 | 107 | | Director of the Courts; |
---|
108 | 108 | | 5. The carrying and use of firearms and other weapons provided |
---|
109 | 109 | | in this subsection when used for the purpos e of living history |
---|
110 | 110 | | reenactment. For purposes of this paragraph, “living history |
---|
111 | 111 | | reenactment” means depiction of historical characters, scenes, |
---|
112 | 112 | | historical life, or events for entertainment, education, or |
---|
113 | 113 | | historical documentation through the wearing or use of period, |
---|
114 | 114 | | historical, antique, or vintage clothing, accessories, firearms, |
---|
115 | 115 | | weapons, and other implements of the historical period; or |
---|

154 | 153 | | 7. The concealed carrying of a handgun, by a person described |
---|
155 | 154 | | in paragraph 6 of this subsection, at an election day p olling place |
---|
156 | 155 | | as provided for in Section 3 -120 of Title 26 of the Oklahoma |
---|
157 | 156 | | Statutes or an in-person absentee voting location during an election |
---|
158 | 157 | | being conducted by a state or county election board. Such polling |
---|
159 | 158 | | place or voting location shall not include a school unless the |
---|
160 | 159 | | person possesses a valid license p ursuant to the Oklahoma Self- |
---|
161 | 160 | | Defense Act, nor shall it include a courthouse in any instance. |
---|

202 | 200 | | e. a violation of an order issu ed under the Protection |

203 | 201 | | from Domestic Abuse Act or a domestic abuse protection |
---|
204 | 202 | | order issued by another state, or |
---|
205 | 203 | | f. a violation relating to illegal drug use or possession |
---|
206 | 204 | | under the provisions of the Uniform Controlled |
---|
207 | 205 | | Dangerous Substances Act, |
---|
208 | 206 | | shall be prohibited from carrying a firearm under the provisions of |
---|
209 | 207 | | this paragraph. Any person who carries a firear m in the manner |
---|
210 | 208 | | provided for in this p aragraph shall be prohibited from carrying the |
---|
211 | 209 | | firearm into any of the places prohibited in subsection A of Sectio n |
---|
212 | 210 | | 1277 of this title or any other place currently prohibited by law. |
---|
213 | 211 | | Nothing in this section shall modify or otherwise change where a |
---|
214 | 212 | | person may legally carry a firearm. |

254 | 251 | | leased by a city, town, county, state , or federal governmental |
---|
255 | 252 | | authority for the purpo se of conducting business with the pub lic; |
---|
256 | 253 | | 2. Any courthouse, courtroom, prison, jail, detention facility , |
---|
257 | 254 | | or any facility used to process, hold , or house arrested persons, |
---|
258 | 255 | | prisoners, or persons alleged delinquent or adjudicated delinquent, |
---|
259 | 256 | | except as provided in Section 21 of Title 57 of the Oklahoma |
---|
260 | 257 | | Statutes; |
---|
261 | 258 | | 3. Any public or private elementary or public or private |
---|
262 | 259 | | secondary school, except as provided in subsections C and D of this |

---|
300 | 296 | | security minimum security provision consists of a location that is |
---|
301 | 297 | | secured utilizing the following: |
---|
302 | 298 | | a. a metallic-style security fence that is at least eight |
---|
303 | 299 | | (8) feet in height that enc ompasses the property and |
---|
304 | 300 | | is secured in such a way as to deter unauthorized |
---|
305 | 301 | | entry, |
---|
306 | 302 | | b. controlled access points staffed by a uniformed, |
---|
307 | 303 | | commissioned peace officer, and |
---|
308 | 304 | | c. a metal detector whereby persons walk or otherwise |
---|
309 | 305 | | travel with their property through or by the metal |
---|
310 | 306 | | detector. |
---|
311 | 307 | | B. It shall be lawful for a person to carry a concealed or |
---|
312 | 308 | | unconcealed firearm on the following properties: |
---|
313 | 309 | | 1. Any property set aside for the use or parking of any |
---|
314 | 310 | | vehicle, whether attended or unattended, by a city, town, county , |
---|
315 | 311 | | state, or federal governmental authority; |

351 | 346 | | refuge, wildlife management area , or fairgrounds; provided, nothing |
---|
352 | 347 | | in this paragraph shall be construed to authorize any entry by a |
---|
353 | 348 | | person in possession of a concealed or unconcealed firearm into any |
---|
354 | 349 | | structure, building, office space , or event which is spe cifically |
---|
355 | 350 | | prohibited by the provisions of subsection A of this section; |
---|
356 | 351 | | 5. Any property set aside by a public or private elementary or |
---|
357 | 352 | | secondary school for the use or parking of any vehicle, whether |
---|
358 | 353 | | attended or unattended; provided, however, the firearm s hall be |
---|
359 | 354 | | stored and hidden from view in a locked motor vehicle when the motor |
---|
360 | 355 | | vehicle is left unattended on school property; and |
---|
361 | 356 | | 6. Any public property set aside temporarily by a county, city, |
---|
362 | 357 | | town, public trust with a county, city , or town as a beneficiar y, or |
---|
363 | 358 | | state governmental authority for the holder of an event permit that |
---|
364 | 359 | | is without minimum-security minimum security provisions, as such |
---|
365 | 360 | | term is defined in paragraph 7 of subsection A of this section; |
---|
366 | 361 | | provided, the carry of firearms within said the permitted event area |

402 | 396 | | a school unless the person posses ses a valid license p ursuant to the |
---|
403 | 397 | | Oklahoma Self-Defense Act, nor shall it include a courthouse in any |
---|
404 | 398 | | instance. |
---|
405 | 399 | | Nothing contained in any provision of this subsection or |
---|
406 | 400 | | subsection C of this section shall be construed to authorize or |
---|
407 | 401 | | allow any person in control of any place described in subsection A |
---|
408 | 402 | | of this section to establish any policy or rule that has the effect |
---|
409 | 403 | | of prohibiting any person in lawful possession of a handgun license |
---|
410 | 404 | | or otherwise in lawful poss ession of a firearm from carrying or |
---|
411 | 405 | | possessing the firearm on the property described in this subsection. |
---|
412 | 406 | | C. A concealed or unconcealed weapon may be carried onto |
---|
413 | 407 | | private school property or in any school bus or vehicle used by any |
---|
414 | 408 | | private school for trans portation of students or teachers by a |
---|
415 | 409 | | person who is licensed pursuant to the Oklahoma Self -Defense Act, |
---|
416 | 410 | | provided a policy has been adopted by the governing entity of the |
---|
417 | 411 | | private school that authorizes the carrying and possession of a |
---|

450 | 443 | | private school shall not be subject to liability for any injuries |
---|
451 | 444 | | arising from the adoption of the policy. The provisions of this |
---|
452 | 445 | | subsection shall not apply to claims pursuant to the Administrative |
---|
453 | 446 | | Workers’ Compensation Act. |
---|
454 | 447 | | D. Notwithstanding paragraph 3 of subsection A of this section, |
---|
455 | 448 | | a A board of education of a school district may adopt a policy |
---|
456 | 449 | | pursuant to Section 5-149.2 of Title 70 of the Oklahoma Statutes to |
---|
457 | 450 | | authorize the carrying of a handgu n onto school property by school |
---|
458 | 451 | | personnel specifically designated by the board of education, |
---|
459 | 452 | | provided such personnel either: |
---|
460 | 453 | | 1. Possess a valid armed security guard license as provided for |
---|
461 | 454 | | in Section 1750.1 et seq. of Title 59 of the Oklahoma Statutes the |
---|
462 | 455 | | Oklahoma Security Guard and Private Investigator Act ; or |
---|
463 | 456 | | 2. Hold a valid reserve peace officer certification as provided |
---|
464 | 457 | | for in Section 3311 of Title 70 of the Oklahoma Statutes. |
---|
465 | 458 | | Nothing in this subsection shall be construed to restrict authority |
---|
466 | 459 | | granted elsewhere in law to carry firearms. |

606 | 596 | | the effect of prohibiting any person in lawful pos session of a |
---|
607 | 597 | | handgun license or any person in lawful possession of a firearm, |
---|
608 | 598 | | machete, blackjack, loaded cane, hand chain, or metal knuckles from |
---|
609 | 599 | | possession of a firearm, machete, blackjack, loaded cane, hand |
---|
610 | 600 | | chain, or metal knuckles in places described in paragraphs 1, 2, and |

611 | 601 | | 3 of this subsection. Nothing contained in any provision of this |

612 | 602 | | subsection shall be construed to limit the authority of any college, |
---|

---|

659 | 648 | | performance of his or her duties within the courth ouses of the |

660 | 649 | | county in which he or she was elected. The provisions of this |

661 | 650 | | paragraph shall not allow th e elected county official to carry the |
---|
662 | 651 | | handgun into a courtroom; |

663 | 652 | | 5. The sheriff of any county may authorize certain employees of |

664 | 653 | | the county, who posses s a valid handgun license issued pursuant to |
