42	43		Sections 1272, 1277, 1280.1, and 1290.24, as amended
43	44		by Section 5, Chapter 160, O.S.L. 2023 (21 O.S. Supp.

45	46		carry, possession of firearms on school property, and
46	47		immunity; authorizing concealed carry by certain
47	48		persons in certain locations; prohibiting cert ain
48	49		liability; updating statutory language and

55	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56	57		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1272, is
57	58		amended to read as fol lows:
58	59		Section 1272.
59	60		UNLAWFUL CARRY
60	61		A. Notwithstanding any other provision of law, it shall be
61	62		unlawful for any person to carry upon or about his or her person, or
62	63		in a purse or other container belonging to the person, any pistol,
63	64		revolver, shotgun, or rifle, whether loaded or unloaded , or any
64	65		blackjack, loaded cane, hand chain, metal knuckles, or any other
65	66

92	92		offensive weapon, whether such weapon be is concealed or
93	93		unconcealed,; except this section shall not prohibit:
94	94		1. The proper use of guns and knives for self-defense, hunting,
95	95		fishing, educational , or recreational purposes;
96	96		2. The carrying or use of weapons in a manner otherwise
97	97		permitted by statute or authorized by the Oklahoma Self -Defense Act;
98	98		3. The carrying, possession , and use of any weapon by a peace
99	99		officer or other person authorized by law to carry a weapon in the
100	100		performance of official duties a nd in compliance with the rules of
101	101		the employing agency;
102	102		4. The carrying or use of weapons in a courthouse by a district
103	103		judge, associate district judg e, or special district judge within
104	104		this state, who is in possession of a valid handgun license issued
105	105		pursuant to the provisions of the Oklahoma Self -Defense Act and
106	106		whose name appears on a list maintained by the Administrative
107	107		Director of the Courts;
108	108		5. The carrying and use of firearms and other weapons provided
109	109		in this subsection when used for the purpos e of living history
110	110		reenactment. For purposes of this paragraph, “living history
111	111		reenactment” means depiction of historical characters, scenes,
112	112		historical life, or events for entertainment, education, or
113	113		historical documentation through the wearing or use of period,
114	114		historical, antique, or vintage clothing, accessories, firearms,
115	115		weapons, and other implements of the historical period; or

143	142		6. The transporting by vehicle on a public roadway or the
144	143		carrying of a firearm, concealed or unconcealed, loaded or un loaded,
145	144		by a person who is twenty -one (21) years of age or older or by a
146	145		person who is eighteen (18) years of age but not yet twenty -one (21)
147	146		years of age and the person is a member or veteran of the United
148	147		States Armed Forces, Reserves , or National Guard or was discharged
149	148		under honorable conditions from the United States Armed Forces,
150	149		Reserves, or National Guard, and the person is otherwise not
151	150		disqualified from the possession or purchase of a firearm under
152	151		state or federal law and is not carrying the fire arm in furtherance
153	152		of a crime; or
154	153		7. The concealed carrying of a handgun, by a person described
155	154		in paragraph 6 of this subsection, at an election day p olling place
156	155		as provided for in Section 3 -120 of Title 26 of the Oklahoma
157	156		Statutes or an in-person absentee voting location during an election
158	157		being conducted by a state or county election board. Such polling
159	158		place or voting location shall not include a school unless the
160	159		person possesses a valid license p ursuant to the Oklahoma Self-
161	160		Defense Act, nor shall it include a courthouse in any instance.
162	161		Except as provided in subsection B of Section 1283 of this
163	162		title, a person who has been convicted of any one of the following
164	163		offenses in this state or a violation of the equivalent law of
165	164		another state:

193	191		a. assault and battery pursuant to the provisions of
194	192		Section 644 of this title which caused serious
195	193		physical injury to the victim,
196	194		b. aggravated assault and battery pursuant to the
197	195		provisions of Section 646 of this title,
198	196		c. assault and battery that qualifies as domes tic abuse
199	197		as defined in Section 644 of this title,
200	198		d. stalking pursuant to the provisions of Section 1173 of
201	199		this title,
202	200		e. a violation of an order issu ed under the Protection
203	201		from Domestic Abuse Act or a domestic abuse protection
204	202		order issued by another state, or
205	203		f. a violation relating to illegal drug use or possession
206	204		under the provisions of the Uniform Controlled
207	205		Dangerous Substances Act,
208	206		shall be prohibited from carrying a firearm under the provisions of
209	207		this paragraph. Any person who carries a firear m in the manner
210	208		provided for in this p aragraph shall be prohibited from carrying the
211	209		firearm into any of the places prohibited in subsection A of Sectio n
212	210		1277 of this title or any other place currently prohibited by law.
213	211		Nothing in this section shall modify or otherwise change where a
214	212		person may legally carry a firearm.

242	239		B. Any person convicted of violating the foregoing provision
243	240		shall be guilty of a mi sdemeanor punishable as provided in Section
244	241		1276 of this title.
245	242		SECTION 2. AMENDATORY 21 O.S. 2021, Section 1277, is
246	243		amended to read as follows:
247	244		Section 1277.
248	245		UNLAWFUL CARRY IN CERTAIN PLACES
249	246		A. It shall be unlawful for any perso n, including a person in
250	247		possession of a valid handgun license issued pursuant to the
251	248		provisions of the Oklahoma Self -Defense Act, to carry any concealed
252	249		or unconcealed firearm into any of the following places:
253	250		1. Any structure, building, or office space which is owned or
254	251		leased by a city, town, county, state , or federal governmental
255	252		authority for the purpo se of conducting business with the pub lic;
256	253		2. Any courthouse, courtroom, prison, jail, detention facility ,
257	254		or any facility used to process, hold , or house arrested persons,
258	255		prisoners, or persons alleged delinquent or adjudicated delinquent,
259	256		except as provided in Section 21 of Title 57 of the Oklahoma
260	257		Statutes;
261	258		3. Any public or private elementary or public or private
262	259		secondary school, except as provided in subsections C and D of this
263	260		section;
264	261		4. Any publicly owned or operated sports arena or venue during
265	262		a professional sporting event, unless allowed by the event holder;

293	289		5. Any place where gambling is authorized by law, unless
294	290		allowed by the property own er;
295	291		6. Any other place specifically prohibited by law; and
296	292		7. Any property set aside by a county, city, town, public trust
297	293		with a county, city, or town as a beneficiary, or state governmental
298	294		authority for an event that is secured with minimum-security minimum
299	295		security provisions. For purposes of this paragraph, a minimum-
300	296		security minimum security provision consists of a location that is
301	297		secured utilizing the following:
302	298		a. a metallic-style security fence that is at least eight
303	299		(8) feet in height that enc ompasses the property and
304	300		is secured in such a way as to deter unauthorized
305	301		entry,
306	302		b. controlled access points staffed by a uniformed,
307	303		commissioned peace officer, and
308	304		c. a metal detector whereby persons walk or otherwise
309	305		travel with their property through or by the metal
310	306		detector.
311	307		B. It shall be lawful for a person to carry a concealed or
312	308		unconcealed firearm on the following properties:
313	309		1. Any property set aside for the use or parking of any
314	310		vehicle, whether attended or unattended, by a city, town, county ,
315	311		state, or federal governmental authority;

343	338		2. Any property set aside for the use or parking of any
344	339		vehicle, whether attended or unattended, which is open to the
345	340		public, or by any entity engaged in gambling authorized by law;
346	341		3. Any property adjacent to a structure, building , or office
347	342		space in which concealed or unconcealed weapons are prohibited by
348	343		the provisions of this section;
349	344		4. Any property designated by a city, town, county , or state
350	345		governmental authority as a park, recreational area, wildlife
351	346		refuge, wildlife management area , or fairgrounds; provided, nothing
352	347		in this paragraph shall be construed to authorize any entry by a
353	348		person in possession of a concealed or unconcealed firearm into any
354	349		structure, building, office space , or event which is spe cifically
355	350		prohibited by the provisions of subsection A of this section;
356	351		5. Any property set aside by a public or private elementary or
357	352		secondary school for the use or parking of any vehicle, whether
358	353		attended or unattended; provided, however, the firearm s hall be
359	354		stored and hidden from view in a locked motor vehicle when the motor
360	355		vehicle is left unattended on school property; and
361	356		6. Any public property set aside temporarily by a county, city,
362	357		town, public trust with a county, city , or town as a beneficiar y, or
363	358		state governmental authority for the holder of an event permit that
364	359		is without minimum-security minimum security provisions, as such
365	360		term is defined in paragraph 7 of subsection A of this section;
366	361		provided, the carry of firearms within said the permitted event area

394	388		shall be limited to concealed carry of a handgun unless otherwise
395	389		authorized by the holder of the event permit ; and
396	390		7. An election day polling place as provided for in Section 3 -
397	391		120 of Title 26 of the Oklahoma Statutes or an in -person absentee
398	392		voting location during an election being conducted by a state or
399	393		county election board by any person described in paragraph 6 of
400	394		subsection A of Section 1272 of this title , provided the firearm is
401	395		concealed. Such polling place or voting location shall not include
402	396		a school unless the person posses ses a valid license p ursuant to the
403	397		Oklahoma Self-Defense Act, nor shall it include a courthouse in any
404	398		instance.
405	399		Nothing contained in any provision of this subsection or
406	400		subsection C of this section shall be construed to authorize or
407	401		allow any person in control of any place described in subsection A
408	402		of this section to establish any policy or rule that has the effect
409	403		of prohibiting any person in lawful possession of a handgun license
410	404		or otherwise in lawful poss ession of a firearm from carrying or
411	405		possessing the firearm on the property described in this subsection.
412	406		C. A concealed or unconcealed weapon may be carried onto
413	407		private school property or in any school bus or vehicle used by any
414	408		private school for trans portation of students or teachers by a
415	409		person who is licensed pursuant to the Oklahoma Self -Defense Act,
416	410		provided a policy has been adopted by the governing entity of the
417	411		private school that authorizes the carrying and possession of a

445	438		weapon on private sch ool property or in any school bus or vehicle
446	439		used by a private school. Except for acts of gross negligence or
447	440		willful or wanton misconduct, a governing entity of a private school
448	441		that adopts a policy which authorizes the possession of a weapon on
449	442		private school property, a school bus , or a vehicle used by the
450	443		private school shall not be subject to liability for any injuries
451	444		arising from the adoption of the policy. The provisions of this
452	445		subsection shall not apply to claims pursuant to the Administrative
453	446		Workers’ Compensation Act.
454	447		D. Notwithstanding paragraph 3 of subsection A of this section,
455	448		a A board of education of a school district may adopt a policy
456	449		pursuant to Section 5-149.2 of Title 70 of the Oklahoma Statutes to
457	450		authorize the carrying of a handgu n onto school property by school
458	451		personnel specifically designated by the board of education,
459	452		provided such personnel either:
460	453		1. Possess a valid armed security guard license as provided for
461	454		in Section 1750.1 et seq. of Title 59 of the Oklahoma Statutes the
462	455		Oklahoma Security Guard and Private Investigator Act ; or
463	456		2. Hold a valid reserve peace officer certification as provided
464	457		for in Section 3311 of Title 70 of the Oklahoma Statutes.
465	458		Nothing in this subsection shall be construed to restrict authority
466	459		granted elsewhere in law to carry firearms.

494	486		E. Notwithstanding the provisions of subsection A of this
495	487		section, on any property designated as a municipal zoo or park of
496	488		any size that is owned, leased, operated , or managed by:
497	489		1. A public trust created pursuant to the provisions of Section
498	490		176 of Title 60 of the Oklahoma Statutes; or
499	491		2. A nonprofit entity,
500	492		an individual shall be allowed to carry a concealed handgun b ut not
501	493		openly carry a handgun on the property.
502	494		F. Any person violating the provisions of paragra ph 2 or 3 of
503	495		subsection A of this section shall, upon conviction, be guilty of a
504	496		misdemeanor punishable by a fine not to exceed Two Hundred Fifty
505	497		Dollars ($250.00). A person violating any other provision of
506	498		subsection A of this section may be denied entra nce onto the
507	499		property or removed from the property. If the person refuses to
508	500		leave the property and a peace officer is summoned, the person may
509	501		be issued a citation for an amount not to exceed Two Hundred Fifty
510	502		Dollars ($250.00).
511	503		G. No person in possessi on of a valid handgun license issued
512	504		pursuant to the provisions of the Oklahoma Self -Defense Act or who
513	505		is carrying or in possession of a firearm as otherwise permitted by
514	506		law or who is carrying or in possession of a machete, blackjack,
515	507		loaded cane, hand chain, or metal knuckles shall be authorized to
516	508		carry the firearm, machete, blackjack, loaded cane, hand chain , or
517	509		metal knuckles into or upon any college, univ ersity, or technology

546	537		purposes of this subsection, the following property shall not be
547	538		construed to be college, university , or technology center school
548	539		property:
549	540		1. Any property set aside for the use or parking of any motor
550	541		vehicle, whether attended or unattended, provided the firear m,
551	542		machete, blackjack, loaded cane, hand chain , or metal knuckles are
552	543		carried or stored as required by law and the firearm, machete,
553	544		blackjack, loaded cane, ha nd chain, or metal knuckles are not
554	545		removed from the motor vehicle without the prior consent of t he
555	546		college or university president or technology center school
556	547		administrator while the vehicle is on any college, university, or
557	548		technology center school property;
558	549		2. Any property authorized for possession or use of firearms,
559	550		machetes, blackjacks, loaded canes, hand chains, or metal knuckles
560	551		by college, university , or technology center school policy; and
561	552		3. Any property authorized by the written consent of the
562	553		college or university president or technology center school
563	554		administrator, provided the written consent is carried with the
564	555		firearm, machete, blackjack, loaded cane, hand chain , or metal
565	556		knuckles and the valid handgun license while on college, university ,
566	557		or technology center school property.
567	558		The college, university , or technology center school may n otify
568	559		the Oklahoma State Bureau of Investigation within ten (10) days of a

596	586		violation of any provision of this subsection by a licensee. Upon
597	587		receipt of a written notification of violation, the Bureau shall
598	588		give a reasonable notice to the licensee and hold a hearing. At the
599	589		hearing, upon a determination that the licensee has violated any
600	590		provision of this subsection, the licensee may be subject to an
601	591		administrative fine of Two Hundred Fifty Dollars ($250.00) and may
602	592		have the handgun license suspended for t hree (3) months.
603	593		Nothing contained in any provision of this subsection shall be
604	594		construed to authorize or allow any college, university , or
605	595		technology center school to establish any policy or rule that has
606	596		the effect of prohibiting any person in lawful pos session of a
607	597		handgun license or any person in lawful possession of a firearm,
608	598		machete, blackjack, loaded cane, hand chain, or metal knuckles from
609	599		possession of a firearm, machete, blackjack, loaded cane, hand
610	600		chain, or metal knuckles in places described in paragraphs 1, 2, and
611	601		3 of this subsection. Nothing contained in any provision of this
612	602		subsection shall be construed to limit the authority of any college,
613	603		university, or technology center school in this state from taking
614	604		administrative action against any student for any violation of any
615	605		provision of this subsection.
616	606		H. The provisions of this section shall not apply to the
617	607		following:
618	608		1. Any peace officer or any person authorized by law to carry a
619	609		firearm in the course of employment;

647	636		2. District judges, associate district judges , and special
648	637		district judges, who are in possession of a valid handgun license
649	638		issued pursuant to the provisions of the Oklahoma Self -Defense Act
650	639		and whose names appear on a list maintained by the Administrative
651	640		Director of the Courts, when acting in the course and scope of
652	641		employment within the courthouses of this state;
653	642		3. Private investigators with a firearms authorization when
654	643		acting in the course and scope of employment;
655	644		4. Elected officials An elected official of a county or a
656	645		county election board secretary , who are is in possession of a valid
657	646		handgun license issued pursuant to the provisions of the Oklahoma
658	647		Self-Defense Act, may carry a concealed handgun when acting in the
659	648		performance of his or her duties within the courth ouses of the
660	649		county in which he or she was elected. The provisions of this
661	650		paragraph shall not allow th e elected county official to carry the
662	651		handgun into a courtroom;
663	652		5. The sheriff of any county may authorize certain employees of
664	653		the county, who posses s a valid handgun license issued pursuant to
665	654		the provisions of the Oklahoma Self -Defense Act, to carry a
666	655		concealed handgun when acting in the course and scope of employment
667	656		within the courthouse in the county in which the person is employed.
668	657		Nothing in the Oklahoma Self-Defense Act shall prohibit the sheriff
669	658		from requiring additional instruction or training before granting
670	659		authorization to carry a concealed handgun within the courthouse.

699	687		subsection shall not allow the county employee to carry the handgun
700	688		into a courtroom, sheriff ’s office, adult or juvenile jail , or any
701	689		other prisoner detention area; a nd
702	690		6. The board of county commissioners of any county may
703	691		authorize certain employees of the cou nty, who possess a valid
704	692		handgun license issued pursuant to the provisions of the Oklahoma
705	693		Self-Defense Act, to carry a concealed handgun when acting in the
706	694		course and scope of employment on county annex facilities or grounds
707	695		surrounding the county courtho use.
708	696		I. For the purposes of this section, “motor vehicle” means any
709	697		automobile, truck, minivan, sports sport utility vehicle, or
710	698		motorcycle, as defined in Sec tion 1-135 of Title 47 of the Oklahoma
711	699		Statutes, equipped with a locked accessory container withi n or
712	700		affixed to the motorcycle.
713	701		SECTION 3. AMENDATORY 21 O.S. 2021, Section 12 80.1, is
714	702		amended to read as follows:

716	704		POSSESSION OF FIREARM ON SCHOOL PROPERTY
717	705		A. It shall be unlawful for any person to have in his or her
718	706		possession on any public or private school property or while in any
719	707		school bus or vehicle used by any school for transportation of
720	708		students or teachers any firearm or weapon designated in Section

750	737		B. For purposes of this section:
751	738		1. “School property” means any publicly owned property held for
752	739		purposes of elementary, secondary , or vocational-technical
753	740		education, and shall not include property owned by public school
754	741		districts or where such property is leased or rented to an
755	742		individual or corporation and used for purposes other than
756	743		educational;
757	744		2. “Private school” means a school that offers a course of
758	745		instruction for students in one or more grades f rom prekindergarten
759	746		through grade twelve and is not operated by a governmental entity;
760	747		and
761	748		3. “Motor vehicle” means any automobile, truck, minivan , or
762	749		sports sport utility vehicle.
763	750		C. Firearms and weapons are allowed on school property and
764	751		deemed not in violation of subsection A of this section as follows:
765	752		1. A gun or knife designed for hunting or fishing purposes kept
766	753		in a privately owned vehicle and properl y displayed or stored as
767	754		required by law, provided such vehicle containing said the gun or
768	755		knife is driven onto school property only to transport a student to
769	756		and from school and such vehicle does not remain unattended on
770	757		school property;

799	785		Oklahoma Department of Wildlife Conservation cert ified hunter
800	786		training education course or any other hunting, fishing, safety , or
801	787		firearms training courses, or a recognized firearms sports event,
802	788		team shooting program, or competition, or living history
803	789		reenactment, provided the course or event is approve d by the
804	790		principal or chief administrator of the school where the course or
805	791		event is offered, and provid ed the weapon is properly displayed or
806	792		stored as required by law pending participation in the course,
807	793		event, program, or competition;
808	794		3. Weapons in the possession of any peace officer or other
809	795		person authorized by law to possess a weapon in the performance of
810	796		his or her duties and responsibilities;
811	797		4. A concealed or unconcealed weapon carried onto private
812	798		school property or in any school bus or vehicle used by any private
813	799		school for transportation of students or teachers by a person who is
814	800		licensed pursuant to the Oklahoma Self -Defense Act, provided a
815	801		policy has been adopted by the governing entity of the private
816	802		school that authorizes the possession of a weapon on private school
817	803		property or in any school bus or vehicle used by a private school.
818	804		Except for acts of gross negligence or willful or wanton miscond uct,
819	805		a governing entity of a private school that adopts a policy which
820	806		authorizes the possession of a weapon on private school property, a
821	807		school bus, or a vehicle used by the private school shall be i mmune

850	835		policy. The provisions of this paragraph shall not apply to claims
851	836		pursuant to the Administrative Workers’ Compensation Code Act;
852	837		5. A gun, knife, bayonet , or other weapon in the possession of
853	838		a member of a veterans group, the national guard National Guard,
854	839		active military, the Reserve Officers ’ Training Corps (ROTC) , or
855	840		Junior ROTC, in order to participate in a ceremony, assembly , or
856	841		educational program approved by the principal or ch ief administrator
857	842		of a school or school district where the ceremony, assembly , or
858	843		educational program is being held; provided, however, the gun or
859	844		other weapon that uses projectiles is not loaded and is inoperable
860	845		at all times while on school property;
861	846		6. A handgun carried in a motor vehicle pursuant to a val id
862	847		handgun license authorized by the Oklahoma Self -Defense Act onto
863	848		property set aside by a publi c or private elementary or secondary
864	849		school for the use or parking of any vehicle; provided, however,
865	850		said the handgun shall be stored and hidden from view in a locked
866	851		motor vehicle when the motor vehicle is left unattended on school
867	852		property; and
868	853		7. A handgun carried onto public school property by school
869	854		personnel who have been designated by the board of education,
870	855		provided such personnel either:
871	856		a. possess a valid armed security guard license as
872	857		provided for in Section 1750.1 et seq. of Title 59 of

901	885		Private Investigator Act , or
902	886		b. hold a valid reserve pe ace officer certification as
903	887		provided for in Section 3311 of Title 70 of the
904	888		Oklahoma Statutes,
905	889		if a policy has been adopted by the board of education o f the school
906	890		district that authorizes the carrying of a handgun onto public
907	891		school property by such personnel ; and
908	892		8. The carry of a concealed handgun by a pe rson described in
909	893		paragraph 6 of subsection A of Section 1272 of this title who
910	894		possesses a valid license pursuant to the Oklahoma S elf-Defense Act
911	895		at an election day polling place as provided for in S ection 3-120 of
912	896		Title 26 of the Oklahoma Statutes or an in -person absentee voting
913	897		location during an election being conducted by a state or county
914	898		election board.
915	899		Nothing in this subsection shall be construed to restrict
916	900		authority granted elsewhere in law to carry firearms.
917	901		D. Any person violating the provisions of this section shall,
918	902		upon conviction, be guilty of a misdemeanor punishable by a fine of
919	903		not to exceed Two Hundred Fifty Dollars ($250.00).
920	904		SECTION 4. AMENDATORY 21 O.S. 2021, Section 1290.24, as
921	905		amended by Section 5, Chapter 160, O.S.L. 2023 (21 O.S. Supp. 2024,
922	906		Section 1290.24), is amended to read as follows:

952	935		A. The state or any political subdivision of the state this
953	936		state, as defined in Section 152 of Title 51 of the Oklahoma
954	937		Statutes, and its officers, agents , and employees shall be immune
955	938		from and not subject to liability resulting or ari sing from:
956	939		1. Failure to prevent the licensing of an individual for whom
957	940		the receipt of the license is unlawful pursuant to the provisions of
958	941		the Oklahoma Self-Defense Act or any other provision of law of this
959	942		state;
960	943		2. Any action or misconduct with a fi rearm committed by a
961	944		person pursuant to the provisions of the Oklahoma Self -Defense Act
962	945		or by any person who obtains a firearm;
963	946		3. Any injury to any person during a firearm training course
964	947		conducted by a firearms instructor certified by the Council on Law
965	948		Enforcement Education and Training to conduct training under the
966	949		Oklahoma Self-Defense Act, or injury f rom any misfire or malfunction
967	950		of any firearm on a training course firing range supervised by a
968	951		certified firearms instructor under the provisions of th e Oklahoma
969	952		Self-Defense Act, or any injury resulting from carrying a concealed
970	953		or unconcealed firearm pursuant to any firearms training; and
971	954		4. Any action or finding pursuant to a hearing conducted in
972	955		accordance with the Administrative Procedures Act as r equired in the
973	956		Oklahoma Self-Defense Act; and

1011	993		C. The provisions of this subsection shall not apply to claims
1012	994		pursuant to the Administrative Workers ’ Compensation Act.
1013	995		SECTION 5. This act shall become effective November 1, 2025.
