4365 An Act relating to crimes and punishments; defining

5173 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5274 SECTION 1. NEW LAW A new section of law to be codified
5375 in the Oklahoma Statutes as Section 1040.58 of Ti tle 21, unless
5476 there is created a duplication in numbering, reads as follows:
5577 A. As used in this section:
5678 1. “Adult cabaret performance ” means a performance in a
5779 location, other than an adult cabaret, that features topless
5880 dancers, go-go dancers, exotic dancers, strippers, drag performers,
5981 or similar entertainers, whose performance is harmful to minors,
6082 regardless of whether or not the performance is for consideration;
6183 2. “Drag performer” means a male or female performer who adopts
6284 a flamboyant or parodi c feminine or masculine persona with glamorous
6385 or exaggerated costumes and mak eup;

91137 3. “Harmful to minors” shall have the same meaning as such term
92138 is defined in paragraph 2 of Section 1040.75 of Title 21 of the
93139 Oklahoma Statutes;
94140 4. “Minor” means an individual under eighteen (18) years of
95141 age; and
96142 5. “Story hour” means an event hosted by a drag performer who
97143 reads children’s books and engages in other learning activities with
98144 minor children present.
99145 B. 1. It shall be unlawful for a person to engage in an adult
100146 cabaret performance which is harmful to minors or to organize or
101147 authorize the viewing of an adult cabaret performance which is
102148 harmful to minors on public property or in a location where the
103149 adult cabaret performance could be viewed by a minor.
104150 2. Any person who violates the provisions of this subsection
105151 shall, upon conviction, be guilty of a felony punishable by
106152 imprisonment in the custody of the Department of Corrections for a
107153 term not less than one (1) year nor more than five (5) years, or by
108154 a fine not less than Five Thousand Dollars ($5,000.00) nor more than
109155 Twenty Thousand Dollars ($20,000.00), or by both such imprisonment
110156 and fine.
111157 C. 1. It shall be unlawful for a person to organize or
112158 authorize on public property a story hour for minors that is hosted
113159 by a drag performer whose performance is harmful to minors.

141211 2. Any person who violates the provisions of this subsection
142212 shall, upon conviction, be guilty of a misdemeanor punishable by
143213 imprisonment in a county jail for a term not more than (1) year, or
144214 by a fine not less than Five Hundred Dollars ($500.00) nor more than
145215 One Thousand Dollars ($1,000.00), or by both such imprisonment and
146216 fine.
147217 D. The provisions of this section shall preempt any ordinance,
148218 regulation, or restriction that was lawfully adopted or license that
149219 was issued by a political subdivision of this state prior to the
150220 effective date of this act that is in conflict with the provisions
151221 of this section.
152222 SECTION 2. It being immediately necessary for the preserv ation
153223 of the public peace, health or safety, an emergency is hereby
154224 declared to exist, by reason whereof this act shall take effect and
155225 be in full force from and after its passage and approval.
