52 | 74 | | SECTION 1. NEW LAW A new section of law to be codified |

53 | 75 | | in the Oklahoma Statutes as Section 1040.58 of Ti tle 21, unless |
---|
54 | 76 | | there is created a duplication in numbering, reads as follows: |

55 | 77 | | A. As used in this section: |
---|
56 | 78 | | 1. “Adult cabaret performance ” means a performance in a |
---|
57 | 79 | | location, other than an adult cabaret, that features topless |
---|
58 | 80 | | dancers, go-go dancers, exotic dancers, strippers, drag performers, |
---|
59 | 81 | | or similar entertainers, whose performance is harmful to minors, |
---|
60 | 82 | | regardless of whether or not the performance is for consideration; |
---|
61 | 83 | | 2. “Drag performer” means a male or female performer who adopts |
---|
62 | 84 | | a flamboyant or parodi c feminine or masculine persona with glamorous |
---|
63 | 85 | | or exaggerated costumes and mak eup; |

96 | 142 | | 5. “Story hour” means an event hosted by a drag performer who |

97 | 143 | | reads children’s books and engages in other learning activities with |
---|
98 | 144 | | minor children present. |

99 | 145 | | B. 1. It shall be unlawful for a person to engage in an adult |
---|
100 | 146 | | cabaret performance which is harmful to minors or to organize or |
---|
101 | 147 | | authorize the viewing of an adult cabaret performance which is |
---|
102 | 148 | | harmful to minors on public property or in a location where the |
---|
103 | 149 | | adult cabaret performance could be viewed by a minor. |
---|
104 | 150 | | 2. Any person who violates the provisions of this subsection |
---|
105 | 151 | | shall, upon conviction, be guilty of a felony punishable by |
---|
106 | 152 | | imprisonment in the custody of the Department of Corrections for a |
---|
107 | 153 | | term not less than one (1) year nor more than five (5) years, or by |
---|
108 | 154 | | a fine not less than Five Thousand Dollars ($5,000.00) nor more than |
---|
109 | 155 | | Twenty Thousand Dollars ($20,000.00), or by both such imprisonment |
---|
110 | 156 | | and fine. |

111 | 157 | | C. 1. It shall be unlawful for a person to organize or |
---|
112 | 158 | | authorize on public property a story hour for minors that is hosted |
---|
113 | 159 | | by a drag performer whose performance is harmful to minors. |

145 | 215 | | One Thousand Dollars ($1,000.00), or by both such imprisonment and |

147 | 217 | | D. The provisions of this section shall preempt any ordinance, |
---|
148 | 218 | | regulation, or restriction that was lawfully adopted or license that |
---|
149 | 219 | | was issued by a political subdivision of this state prior to the |
---|
150 | 220 | | effective date of this act that is in conflict with the provisions |
---|
151 | 221 | | of this section. |
---|
152 | 222 | | SECTION 2. It being immediately necessary for the preserv ation |
---|
153 | 223 | | of the public peace, health or safety, an emergency is hereby |
---|
154 | 224 | | declared to exist, by reason whereof this act shall take effect and |
---|
155 | 225 | | be in full force from and after its passage and approval. |
