6271 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6372 SECTION 1. NEW LAW A new section of law to be codified
64-in the Oklahoma Statutes as Section 51.1b of Title 74, unless there
65-is created a duplication in numbering, reads as follows:
66-A. This act shall be known and may be cited as the “Targeted
67-Violence Prevention Act”.
73+in the Oklahoma Statutes as Section 49 -143.8 of Title 11, unless
74+there is created a duplication in numbering, reads as follows:
75+A. Except as provided in subsection B of this section, and
76+persons receiving benefits pursuant to Section 49 -101 of Title 11 of
77+the Oklahoma Statutes, any member of the Oklahoma Firefighters
78+Pension and Retirement System receiving benefits from the System as
79+of June 30, 2025, who continues to receive benefits on or after the
80+effective date of this act shall receive a five percent (5%)
81+increase in benefits.
82+B. 1. For any member of the System who joined prior to January
83+1, 1981, who shall have his or her pension or the p ension of his or
84+her surviving spouse increased or decreased by one -half (1/2) of all
85+increases or decreases which shall occur in the salary of a regular

94-B. The Office of Homeland Security is authorized to collect,
95-analyze, and disseminate information concerning the activity and
96-identity of individuals that, with probable cause, are suspected of
97-involvement in terrorism, targeted violence, th reats to public
98-safety, or any other threats of organized or violent crime to law
99-enforcement and public saf ety agencies.
100-C. Any information disseminated pursuant to the provisions of
101-this section shall be confidential, and the recipients of such
102-information shall comply with the handling terms associated with the
103-disclosure. Unauthorized release or unauthorized use of information
104-disseminated pursuant to this section shall be a felony punishable
105-by imprisonment in the custody of the Department of Correct ions for
106-a term not to exceed three (3) years, by a fine not more than Fifty
107-Thousand Dollars ($50,000.00), or by both such imprisonment and
108-fine. Such offense shall also be punishable by termination of
109-employment and revocation of the individual ’s certification as a
110-peace officer in this state. As used in this subsection,
111-“unauthorized release ” or “unauthorized use” shall include, but not
112-be limited to, disseminating or disclosing confidential information
113-in a manner which exceeds the scope of the handli ng terms associated
114-with the disclosure or is in violation of any rules promulgated
115-pursuant to this act. Provided, however, the following shall not
116-constitute an unauthorized release or unauthorized use of
117-confidential information disseminated by the Office:
137+firefighter in the municip ality from which the member is receiving a
138+pension, any increase in benefits shall be used to offset the
139+increase provided in subsection A of this section.
140+2. For the purposes of this section, “regular firefighter”
141+means a salaried firefighter who has rea ched his or her maximum
142+salary as a private in his or her department and has not been
143+promoted to a position of rank.
144+C. Effective July 1, 2026, any persons receiving benefits
145+pursuant to Section 49 -101 of Title 11 of the Oklahoma Statutes
146+shall receive an increase of five percent (5%) of the amount
147+prescribed in Section 49 -143.7 of Title 11 of the Oklahoma Statutes .

144-1. Sharing the confidential information with a law enforcement
145-officer or prosecutorial authority for use in a criminal
146-investigation or prosecution; or
147-2. Sharing the confidential information with the express
148-authority of the Homeland Security Advi sor or the Advisor’s
149-designee.
150-D. Information collected or disseminated pursuant to the
151-provisions of this section shall be privileged and not discoverable
152-nor subject to subpoena or order for production issued by any court,
153-other than production in a district court criminal proceeding for
154-the prosecution of crimes which are the subject of the information
155-sought.
156-E. The Commissioner of Public Safety is authorized to
157-promulgate rules to effectuate the provisions of this section.
158-SECTION 2. AMENDATORY 74 O.S. 2021, Section 51.1, as
159-last amended by Section 1, Chapter 257, O.S.L. 2024 (74 O.S. Supp.
160-2024, Section 51.1), is amended to read as follows:
161-Section 51.1. A. There is hereby created within the Department
162-of Public Safety, the Offi ce of Homeland Security. The Commissioner
163-of Public Safety shall be the Homeland Security Advisor and shall
164-possess or obtain federally recognized clearances as appropriate to
165-perform the duties of the position. The Commissioner of Public
166-Safety, as Homeland Security Advisor, shall be responsible for the
167-operation and administration of the Office. The C ommissioner shall

194-appoint subordinates and employees and may make such expenditures
195-with appropriated funds, or from such other available funds as may
196-be necessary to carry out the purposes of the Oklahoma Homeland
197-Security Act and other programs specified by law.
198-B. The Commissioner may commission any employees appointed to
199-the Office as peace officers. Any member of the Office who receives
200-a commission pursuant to the provisions of this subsection shall
201-exercise the powers and authority of an officer of the Department of
202-Public Safety, as provided for in Section 2 -117 of Title 47 of the
203-Oklahoma Statutes, provided such commissions commission shall be
204-subject to all requirements set forth by the Commissioner, and the
205-Commissioner may set forth any limitations on the power and scope of
206-the commission. All commissioned staff must shall obtain and
207-maintain certification as full -time peace officers in accorda nce
208-with the provisions of Section 3311 of Title 70 of the Oklahoma
209-Statutes.
210-C. The Office of Homela nd Security shall consist of at least
211-three functions:
212-1. Prevention and Intelligence;
213-2. Response and Recovery Planning; and
214-3. Awareness and Prepared ness.
215-D. Other federal, state, and local personnel may be assigned to
216-the Office of Homeland Security pursuant to an interagency
217-agreement. All positions and personnel of the Office of Homeland

244-Security shall be exempt from the full -time employee limit o f the
245-Department of Public Safety.
246-E. The Office of Homeland Security shall have the duty and
247-responsibility to develop and coordinate the implementation and
248-administration of a comprehensive statewide strategy that is
249-integrated into the emergency operat ions plan to secure this state
250-from the results of acts of terrorism, from a public health
251-emergency, from cyberterrorism, and from weapons of mass destruction
252-as that term is defined in 18 U.S.C., Section 2332a, and to perform
253-other duties assigned by the Commissioner. These duties shall
254-include, but not be limited to:
255-1. Representing this state with fe deral agencies as the state
256-Homeland Security Advisor for purposes of accessing federal funds
257-and cooperating with federal agencies in the development and
258-implementation of a nationwide homeland security plan of response;
259-and
260-2. Coordinating the Homeland Security homeland security efforts
261-within this state including working with the G overnor and
262-Legislature, state agencies, and local elected officials and local
263-governments, emergency responder groups, private -sector businesses,
264-educational institutions, vo lunteer organizations, and the general
265-public. State agencies receiving federal funding for homeland
266-security purposes shall report the amount and intend ed use of those

293-funds to the Office of Homeland Security to ensure efficient use of
294-funds and to avoid duplication of efforts.
295-F. Included in the comprehensive statewide strategy and
296-consistent with the National Strategy for Homeland Security, as
297-promulgated by the Executive Office of the President of the United
298-States, or its successor plan or plans, the Office of Homeland
299-Security shall establish the following strategic objectives for this
300-state:
301-1. To prevent terrorist attacks;
302-2. To reduce vulnerabil ity to terrorism;
303-3. To minimize the damage from and to recover from terrorist
304-attacks; and
305-4. Such other duties as the Governor may prescribe.
306-G. The Office of Homeland Security s hall have the following
307-duties:
308-1. Establish a plan for the effective im plementation of a
309-statewide emergency all -hazards response system including the duties
310-and responsibilities of regional emergency response teams;
311-2. Create, implement, and administer an advisory system;
312-3. Coordinate and prepare applications for federal funds
313-related to homeland security and accessing access and distributing
314-the federal distribute such funds; and
315-4. Cooperate with federal agencies in the development and
316-implementation of a nationwide homeland security plan or response.

343-H. The Office of Homeland Security may enter into contracts,
344-agreements, and memoranda of understanding with any public agency,
345-as defined in Section 1003 of this title, for equipment and
346-personnel, or both, to carry out the requirements of the Oklahoma
347-Homeland Security Act. Such agreements may include any provisions
348-agreed upon by the parties and as required by any fe deral or state
349-grant, if applicable.
350-I. All state agencies and political subdivisions of this state
351-and all officers and employees of those agencies and po litical
352-subdivisions are hereby directed to cooperate with and lend
353-assistance to the Office of Homela nd Security.
354-J. All personnel, motor vehicles, computer and communications
355-equipment, training equipment, records, furniture, and other
356-property and equipment allocated to the Office of Homeland Security
357-shall remain with the Office of Homeland Security upon its transfer
358-from the Oklahoma Department of Emergency Management to the
359-Department of Public Safety as of the effective date of this act May
360-1, 2024.
361-K. The Commissioner is authorized to promulgate rules to
362-effectuate the provisions of this section.
363-SECTION 3. It being immediately necessary for the preservation
364-of the public peace, health or safety, an emergency is hereby
