59	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	53		SECTION 1. AMENDATORY 63 O.S. 2021, Section 3204, is
61	54		amended to read as follows:
62	55		Section 3204. A. Until July 1, 1993, the University Hospitals
63	56		shall be under the jurisdiction, supervision, management and control
64	57		of the Department of Human Services and the Commission for Human
65	58		Services.
	59	+	B. Effective July 1, 1993, the University Hospitals are hereby
	60	+	transferred from the De partment of Human Services and the Commission
	61	+	for Human Services to the University Hospitals Authority.
	62	+	C. The transfer shall include:

93		-	B. Effective July 1, 1993, the University Hospitals are hereby
94		-	transferred from the Department of Human Services and the Commission
95		-	for Human Services to the University Hospitals Authority.
96		-	C. The transfer shall include:
97	89		1. All powers, duties, responsibilities, properties, assets,
98	90		fund balances, encumbrances, obligations, records, personn el and
99	91		liabilities including, but not limited to, liability for all
100	92		University Hospital employees ’ sick leave, annual leave, holidays,
101	93		unemployment benefits and workers ’ compensation benefits accruing to
102	94		employees prior to July 1, 1993, which are attributa ble to the
103	95		University Hospitals; provided, however, that any claims arising
104	96		under the Governmental Tort Claims Act and filed prior to July 1,
105	97		1993, and from any other actions filed prior to July 1, 1993, shall
106	98		remain the responsibility of the Department of Human Services and
107	99		the Commission for Human Services . All claims arising prior to July
108	100		1, 1993 and for which no action has been filed shall be paid by the
109	101		Risk Management Program;
110	102		2. Oklahoma Children ’s Hospital and all buildings and
111	103		appurtenances located on land which is described as follows: Blocks
112	104		B, 3, 4, 12 and 13, and the North 30 feet of Block 14; and Lots 6
113	105		through 15, Block 21, CULBERTSON HEIGHTS ADDITION less and except
114	106		the West 7 feet of Lot 5 and all of Lots 6 through 19, and the East
115	107		5 feet of Lot 20 and the North 59.5 feet of Lots 21 through 26, and
116	108		the North 59.5 feet of the West 49.5 feet of Lot 27, all in Block
	109	+	13, CULBERTSON HEIGHTS ADDITION to the City of Oklahoma City,
	110	+	Oklahoma, and also less and except the West 106 feet of the vacate d

314	302		encompassed or abutting portions of vacated Everest Avenue and
315	303		Northeast 9th Street. (219,300 sq. ft., 5.03 acres) ; and
316	304		2. The Management Information Division Building and land
317	305		located on: The West 7 feet of Lot 5 and all o f Lots 6 through 19,
318	306		and the East 5 feet of Lot 20 and the North 59.5 feet of Lots 21
319	307		through 26, and the North 59.5 feet of the West 49.5 feet of Lot 27,
320	308		all in Block 13, Culbertson Heights Addition to the City of Oklahoma

351	338		E. Appropriate conveyances shall be executed to effectuate the
352	339		transfers specified by subsections B, C and D of this section.
353	340		SECTION 2. AMENDATORY 63 O.S. 2021, Secti on 3205, is
354	341		amended to read as follows:
355	342		Section 3205. A. The transfer of the University Hospitals from
356	343		the Commission for Human Services and the Department of Human
357	344		Services shall not require a Certifica te of Need pursuant to the
358	345		provisions of Sections 2651 through 2656.2 of Title 63 of the
359	346		Oklahoma Statutes; provided, however, that Notwithstanding any other
360	347		law, any expansion, addition, or change to the University Hospitals
361	348		requiring a Certificate of Nee d after such transfer shall be subject
362	349		to the provisions of Sections 2651 through 2656.2 of Title 63 of the
363	350		Oklahoma Statutes in furtherance of the University Hospitals
364	351		Authority Act shall not require a certificate of need .
365	352		B. 1. University Hospitals sha ll be operated as general
366	353		hospitals and shall be licensed by the State Commissioner of Health,
367	354		and shall, as far as possible, meet the standards, requirements and
368	355		essentials of the Joint Commission on Accreditation of Health Care
369	356		Organizations, the American Medical Association ’s Council on Medical
370	357		Education, the American Specialty Boards and the Association of
371	358		American Medical Colleges.
	359	+	2. The University Hospitals shall operate a public Level I
	360	+	Trauma Center and shall meet the standards and requirements of the
	361	+	American College of Surgeons to attain such designation. The

399		-	2. The University Hospitals shall operate a public Level I
400		-	Trauma Center and shall meet the standards and requirements of the
401		-	American College of Surgeons to attain such designation. The
402	388		University Hospitals Authority shall annually certify to the
403	389		Oklahoma Health Care Authority that the University Hospitals meet
404	390		such standards and requirements with respect to any Medicaid
405	391		supplemental payments to be received from the Oklaho ma Health Care
406	392		Authority for the public Level I Trauma Center.
407	393		3. The University Hospitals may provide services and receive
408	394		payments therefor under Titles XVIII and XIX of the federal Social
409	395		Security Act, and may participate in other federal medical programs.
410	396		3. 4. University Hospitals shall be available as teaching and
411	397		training hospitals for the colleges of the University of Oklahoma
412	398		Health Sciences Center, for the College of Medicine of the
413	399		University of Oklahoma College of Medicine, and for other health and
414	400		educational facilities and shall provide indigent patient care.
415	401		SECTION 3. This act shall become effective November 1, 2025.
