| 21 | 21 | | It is enacted by the General Assembly as follows: |

| 22 | 22 | | SECTION 1. Section 31-38-1 of the General Laws in Chapter 31-38 entitled "Inspection 1 |

| 23 | 23 | | of Motor Vehicles" is hereby amended to read as follows: 2 |

| 24 | 24 | | 31-38-1. Vehicles without required equipment or in unsafe condition — Inspection 3 |
|---|
| 25 | 25 | | sticker for used cars for sale required. 4 |
|---|
| 26 | 26 | | (a) No person shall sell at retail, drive, or move on any highway any motor vehicle, trailer, 5 |
|---|
| 27 | 27 | | semitrailer, or pole trailer or any combination of them unless the equipment upon the vehicle is in 6 |
|---|
| 28 | 28 | | good working order and adjustment as required in this title, and the vehicle is in such safe 7 |
|---|
| 29 | 29 | | mechanical condition as not to endanger the driver or other occupant or any person upon the 8 |
|---|
| 30 | 30 | | highway. 9 |

| 31 | 31 | | (b) No dealer of used vehicles, as defined by § 31-1-19(b), shall sell at retail a used motor 10 |

| 32 | 32 | | vehicle unless a new inspection of the vehicle conforming to the standards set pursuant to this 11 |

| 33 | 33 | | chapter and chapter 47.1 of this title has been conducted and the vehicle has a new certificate of 12 |

| 34 | 34 | | inspection affixed to the windshield at the time of sale, except used cars sold: 13 |

| 35 | 35 | | (1) Sold “for parts only” and clearly identified accordingly on the bill of sale: or 14 |

| 36 | 36 | | (2) Purchased at the end of the lease term by the current lessee with a valid certificate of 15 |
|---|
| 37 | 37 | | inspection affixed to the windshield at the time of sale that is issued by the state where the vehicle 16 |

| 38 | 38 | | is currently registered, provided a certificate of inspection is not required if there is not a vehicle 17 |
