An Act to require that a high school health curriculum include human sexuality and 1
human development within the womb. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
Section 1. That a NEW SECTION be added to chapter 13-33: 4
The board of each school district shall ensure that the health curriculum offered to 5
students in grades nine through twelve incorporates, by means of oral, written, or digital 6
lessons, or by means of lectures or presentations, information about human sexuality as 7
it relates to sexual activity and pregnancy in the context of student health and healthy 8
relationships, and human biology as it relates to pregnancy and human development 9
inside the womb. The information must include at least two of the following: 10
(1) A video presentation that uses a high-quality, computer-generated rendering or 11
animation to demonstrate the process of a chemical abortion in the first trimester; 12
(2) A video presentation that uses a high-quality, computer-generated rendering or 13
animation to demonstrate the process of a surgical abortion in the first trimester; 14
or 15
(3) A video presentation that uses a high-quality, computer-generated rendering or 16
animation to demonstrate the process of a surgical abortion in the second 17
trimester. 18
Section 2. That a NEW SECTION be added to chapter 13-33: 19
Nothing in section 1 of this Act authorizes any individual employed by or under 20
contract with a school district to refer a student for abortion services. 21

The curricular material and information referenced in section 1 of this Act may not 1
be offered, furnished, or sponsored by an individual who performs or by an entity that 2
provides elective abortion services. 3
Section 4. That a NEW SECTION be added to chapter 13-33: 4
The attorney general may petition the circuit court to enforce compliance under 5
this Act. 6
