An Act to update and repeal provisions related to the reporting of hospital charge 1 
information. 2 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 
Section 1. That § 34-12E-11 be AMENDED: 4 
34-12E-11. Any hospital licensed pursuant to chapter 34-12 shall annually report 5 
annually charge information to the South Dakota Association of Healthcare Organizations 6 
the charge information as described in § 34-12E-13 for that hospital's All Patient Refined 7 
Diagnosis-Related Groups for which that hospital had at least ten cases during the twelve 8 
months preceding the report, using the hospital's All Patient Refined Diagnosis-Related 9 
Groups or the Medicare Severity Diagnosis Related Groups.  10 
The Department of Health shall promulgate rules pursuant to chapter 1-26 to 11 
provide for the reporting of the charge information by hospitals. The rules shall must 12 
include: 13 
(1) The the method for hospitals to report charges;, and 14 
(2) Standards that provide standards for the validity and comparability of charge 15 
reports reported charges. 16 
For the purposes of this section, "charge information" means: 17 
(1) The number of discharges; 18 
(2) The average length of stay; 19 
(3) The average charge; 20 
(4) The median charge; 21 
(5) Demographic information; 22 
(6) Payer mix; 23 
(7) Charges not paid; 24 
(8) Charges paid by medicare, medicaid, other governmental programs, and private 25 
insurance; and 26  25.877.9 	2 	1225

Section 2. That § 34-12E-11.1 be REPEALED. 2 
The South Dakota Association of Healthcare Organizations shall develop a web -3 
based system, available to the public at no cost, for reporting the charge information of 4 
hospitals. The charge information shall include disclaimers regarding factors, including 5 
case severity ratings and individual patient variations, which may affect actual charges to 6 
a patient for services rendered. The website shall provide information that compares 7 
hospital-specific data to hospital statewide data. The website shall be established by June 8 
1, 2009, and shall be updated no less than annually. 9 
Section 3. That § 34-12E-12 be REPEALED. 10 
The Department of Health shall provide a link to the web-based system developed 11 
pursuant to § 34-12E-11.1 on its website. 12 
Section 4. That § 34-12E-13 be REPEALED. 13 
For the purposes of §§ 34-12E-11 and 34-12E-11.1, the term, charge information, 14 
includes the number of discharges; average length of stay; average charge; median 15 
charge; demographic information; payer mix; charges not paid and charges paid by 16 
medicare, medicaid, and other government programs, and private insurance; and 17 
uncompensated care. 18
