11-ENTITLED An Act to update and repeal provisions related to the reporting of hospital
12-charge information.
13-BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
14-Section 1. That § 34-12E-11 be AMENDED:
15-34-12E-11. Any hospital licensed pursuant to chapter 34-12 shall annually report
16-charge information to the South Dakota Association of Healthcare Organizations for which
17-that hospital had at least ten cases during the twelve months preceding the report, using
18-the hospital's All Patient Refined Diagnosis-Related Groups or the Medicare Severity
19-Diagnosis Related Groups.
20-The Department of Health shall promulgate rules pursuant to chapter 1-26 to
21-provide for the reporting of charge information by hospitals. The rules must include the
22-method for hospitals to report charges, and standards for the validity and comparability
23-of reported charges.
24-For the purposes of this section, "charge information" means:
25-(1) The number of discharges;
26-(2) The average length of stay;
27-(3) The average charge;
28-(4) The median charge;
29-(5) Demographic information;
30-(6) Payer mix;
31-(7) Charges not paid;
32-(8) Charges paid by medicare, medicaid, other governmental programs, and private
33-insurance; and
34-(9) Uncompensated care.

18+BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
19+Section 1. That § 34-12E-11 be AMENDED: 4
20+34-12E-11. Any hospital licensed pursuant to chapter 34-12 shall annually report 5

22+the charge information as described in § 34-12E-13 for that hospital's All Patient Refined 7
23+Diagnosis-Related Groups for which that hospital had at least ten cases during the twelve 8
24+months preceding the report, using the hospital's All Patient Refined Diagnosis-Related 9
25+Groups or the Medicare Severity Diagnosis Related Groups. 10

46+The South Dakota Association of Healthcare Organizations shall develop a web -3
47+based system, available to the public at no cost, for reporting the charge information of 4
48+hospitals. The charge information shall include disclaimers regarding factors, including 5
49+case severity ratings and individual patient variations, which may affect actual charges to 6
50+a patient for services rendered. The website shall provide information that compares 7
51+hospital-specific data to hospital statewide data. The website shall be established by June 8
52+1, 2009, and shall be updated no less than annually. 9
53+Section 3. That § 34-12E-12 be REPEALED. 10
54+The Department of Health shall provide a link to the web-based system developed 11
55+pursuant to § 34-12E-11.1 on its website. 12
56+Section 4. That § 34-12E-13 be REPEALED. 13
57+For the purposes of §§ 34-12E-11 and 34-12E-11.1, the term, charge information, 14
58+includes the number of discharges; average length of stay; average charge; median 15
59+charge; demographic information; payer mix; charges not paid and charges paid by 16
60+medicare, medicaid, and other government programs, and private insurance; and 17
