1818 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
1919 Section 1. That § 40-36-9 be AMENDED: 4
2020 40-36-9. TheExcept as otherwise provided for in this section, the Department of 5
2121 Game, Fish and Parks may direct or employ personnel and conduct programs and the 6
2222 Game, Fish and Parks Commission may adopt , pursuant to chapter 1-26 necessary, rules 7
2323 to control foxes, coyotes, feral dogs, prairie dogs, and other wild animals. The expense 8
2424 thereof shall must be paid out of the Department of Game, Fish and Parks department of 9
2525 game, fish and parks fund or the state animal damage control fund. 10
2626 Nothing in this section authorizes the expenditure of moneys as a bounty for the 11
2727 taking of any badger, opossum, racoon, striped skunk, or red fox, or other animal 12
2828 identified by the department as a nest predator. 13
2929 Section 2. That § 41-2-35 be AMENDED: 14
3030 41-2-35. AllExcept as otherwise provided for in this section, all moneys in the 15
3131 Department of Game, Fish and Parks fund are hereby annually appropriated to be used 16
3232 with any moneys otherwise appropriated to pay the necessary expenses of effectuating 17
3333 the purposes of this title. 18
