An Act to terminate bounty payments for nest predators, transfer moneys to the 1 
general fund, and declare an emergency. 2 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 
Section 1. That § 40-36-9 be AMENDED: 4 
40-36-9. TheExcept as otherwise provided for in this section, the Department of 5 
Game, Fish and Parks may direct or employ personnel and conduct programs and the 6 
Game, Fish and Parks Commission may adopt , pursuant to chapter 1-26 necessary, rules 7 
to control foxes, coyotes, feral dogs, prairie dogs, and other wild animals. The expense 8 
thereof shall must be paid out of the Department of Game, Fish and Parks department of 9 
game, fish and parks fund or the state animal damage control fund. 10 
Nothing in this section authorizes the expenditure of moneys as a bounty for the 11 
taking of any badger, opossum, racoon, striped skunk, or red fox, or other animal 12 
identified by the department as a nest predator. 13 
Section 2. That § 41-2-35 be AMENDED: 14 
41-2-35. AllExcept as otherwise provided for in this section, all moneys in the 15 
Department of Game, Fish and Parks fund are hereby annually appropriated to be used 16 
with any moneys otherwise appropriated to pay the necessary expenses of effectuating 17 
the purposes of this title. 18 
Nothing in this section authorizes the expenditure of moneys as a bounty for the 19

Section 3. The state treasurer shall transfer $500,000 from the department of game, fish 22

Section 4. Whereas, this Act is necessary for the immediate preservation of the public peace, 1 
health, or safety, an emergency is hereby declared to exist, and this Act shall be in full force 2 
and effect from and after its passage and approval. 3
