17 | 16 | | SECTION 1. Tennessee Code Annotated, Section 70-1-310, is amended by deleting |
---|
18 | 17 | | subsection (c) and substituting: |

---|
20 | 19 | | (1) This section is not applicable to a person arrested for a violation of: |
---|
21 | 20 | | (A) This title, or an offense for which an arrest is authorized |
---|
22 | 21 | | pursuant to this title, that is punishable by a fine of more than five |
---|
23 | 22 | | hundred dollars ($500) or by imprisonment for more than thirty (30) days; |
---|

---|
25 | 24 | | (B) Title 69, chapter 9, that is punishable by a fine not to exceed |
---|
26 | 25 | | fifty dollars ($50.00) or by imprisonment for more than thirty (30) days. |
---|
27 | 26 | | (2) This section does not supersede § 40-7-118 and does not require the |
---|
28 | 27 | | use of a citation in lieu of continued custody of an arrested person in any of the |
---|
29 | 28 | | circumstances specified in § 40-7-118(d). |

30 | 29 | | SECTION 2. Tennessee Code Annotated, Section 70-2-101, is amended by deleting |
---|
31 | 30 | | subsection (e) and substituting: |

32 | 31 | | (e) A violation of this section is a Class C misdemeanor and punishable by a fine |

33 | 32 | | not to exceed five hundred dollars ($500). A person who violates the revocation order of |
