13	12		AN ACT to amend Tennessee Code Annotated, Title 70,
14	13		relative to wildlife resources.

16	15		BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
17	16		SECTION 1. Tennessee Code Annotated, Section 70-1-310, is amended by deleting
18	17		subsection (c) and substituting:
19	18		(c)
20	19		(1) This section is not applicable to a person arrested for a violation of:
21	20		(A) This title, or an offense for which an arrest is authorized
22	21		pursuant to this title, that is punishable by a fine of more than five
23	22		hundred dollars ($500) or by imprisonment for more than thirty (30) days;
24	23		or
25	24		(B) Title 69, chapter 9, that is punishable by a fine not to exceed
26	25		fifty dollars ($50.00) or by imprisonment for more than thirty (30) days.
27	26		(2) This section does not supersede § 40-7-118 and does not require the
28	27		use of a citation in lieu of continued custody of an arrested person in any of the
29	28		circumstances specified in § 40-7-118(d).
30	29		SECTION 2. Tennessee Code Annotated, Section 70-2-101, is amended by deleting
31	30		subsection (e) and substituting:
32	31		(e) A violation of this section is a Class C misdemeanor and punishable by a fine
33	32		not to exceed five hundred dollars ($500). A person who violates the revocation order of
34	33		the court is subject to a fine not to exceed five hundred dollars ($500) and must be
35	34		confined in the county jail or workhouse for not less than ten (10) days but not more than

40	39		eleven (11) months and twenty-nine (29) days. Notwithstanding another law to the
41	40		contrary, the minimum sentence of ten (10) days must not be suspended.
42	41		SECTION 3. Tennessee Code Annotated, Section 70-2-205(e)(1), is amended by
43	42		deleting "by a fine of not less than fifty dollars ($50.00) nor more than one thousand dollars
44	43		($1,000)" and substituting "by a fine not to exceed five hundred dollars ($500)".
45	44		SECTION 4. Tennessee Code Annotated, Section 70-2-213(c), is amended by deleting
46	45		"shall be, upon conviction, fined not less than twenty-five dollars ($25.00) nor more than one
47	46		hundred dollars ($100)" and substituting "must be, upon conviction, fined not more than five
48	47		hundred dollars ($500)".
49	48		SECTION 5. Tennessee Code Annotated, Section 70-2-214(c), is amended by deleting
50	49		"shall be punishable by a fine of not less than twenty-five dollars ($25.00) nor more than fifty
51	50		dollars ($50.00)" and substituting "is punishable by a fine not to exceed five hundred dollars
52	51		($500)".
53	52		SECTION 6. Tennessee Code Annotated, Section 70-2-215(d), is amended by deleting
54	53		"shall be fined not less than ten dollars ($10.00) nor more than twenty-five dollars ($25.00)" and
55	54		substituting "must be fined not more than five hundred dollars ($500)".
56	55		SECTION 7. Tennessee Code Annotated, Section 70-2-221(e), is amended by deleting
57	56		"by a fine of not less than twenty-five dollars ($25.00) nor more than fifty dollars ($50.00)" and
58	57		substituting "by a fine not to exceed five hundred dollars ($500)".
59	58		SECTION 8. Tennessee Code Annotated, Section 70-4-106(a), is amended by deleting
60	59		subdivision (2) and substituting:
61	60		(2) If the wild animal, wild bird, wild fowl, or fish is not removed from the land of
62	61		another, then a violation of subdivision (a)(1) is a Class C misdemeanor. If the wild
63	62		animal, wild bird, wild fowl, or fish is removed from the land of another, then a violation of
64	63		subdivision (a)(1) is a Class B misdemeanor. Upon conviction for a violation of

69	68		subdivision (a)(1), the court may revoke the license of the person convicted. A revoked
70	69		license must be surrendered to the court and transmitted to the arresting officer, to be
71	70		made a part of the prosecution record.
72	71		SECTION 9. Tennessee Code Annotated, Section 70-5-112(c), is amended by deleting
73	72		"by a fine of not less than twenty-five dollars ($25.00) nor more than fifty dollars ($50.00)" and
74	73		substituting "by a fine not to exceed five hundred dollars ($500)".
75	74		SECTION 10. Tennessee Code Annotated, Section 70-6-101(b)(2), is amended by
76	75		deleting "by a fine of not less than twenty-five dollars ($25.00) nor more than fifty dollars
77	76		($50.00)" and substituting "by a fine not to exceed five hundred dollars ($500)".
78	77		SECTION 11. Tennessee Code Annotated, Section 70-6-102, is amended by deleting
79	78		"by a fine of not less than twenty-five dollars ($25.00) nor more than fifty dollars ($50.00) for
80	79		each offense" and substituting "by a fine not to exceed five hundred dollars ($500) for each
81	80		offense".
82	81		SECTION 12. Tennessee Code Annotated, Section 70-6-104, is amended by deleting
83	82		subsection (a) and substituting:
84	83		(a) When a person is arrested for a violation of the wildlife laws, it is the duty of
85	84		the arresting officer to take the person arrested before a court of general sessions for
86	85		trial, in the county where the offense was committed. If, before the court of general
87	86		sessions, the accused is found guilty of an offense, then the person has the right to
88	87		appeal to the circuit or criminal court having jurisdiction of such appeals, upon giving
89	88		bond with good security in accordance with § 27-5-103.
90	89		SECTION 13. Tennessee Code Annotated, Section 70-6-107(a), is amended by
91	90		deleting "by a fine of more than fifty dollars ($50.00)" and substituting "by a fine of more than
92	91		five hundred dollars ($500)".

97	96		SECTION 14. This act takes effect July 1, 2025, the public welfare requiring it, and
98	97		applies to offenses committed on or after that date.
