14 | 14 | | amended by Chapter 313 of the Private Acts of 1982; |

15 | 15 | | and any other acts amendatory thereto, relative to |
---|
16 | 16 | | Lauderdale County. |

18 | 18 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |
---|
19 | 19 | | SECTION 1. Chapter 313 of the Private Acts of 1982, and any other acts amendatory |
---|
20 | 20 | | thereto, is amended by deleting SECTIONS 17 and 18 and substituting: |

21 | 21 | | SECTION 17. Notwithstanding this act to the contrary, the County Commission |
---|
22 | 22 | | of Lauderdale County shall take such steps as necessary and appropriate for the |
---|
23 | 23 | | immediate and orderly relocation of the Probate and Juvenile Court of |
---|
24 | 24 | | Lauderdale County to the Justice Complex, including judges, personnel, staff, |
---|
25 | 25 | | court files, records, and any and all items necessary for the operation of the |
---|
26 | 26 | | Probate and Juvenile Court. |
---|
27 | 27 | | SECTION 18. Notwithstanding this act to the contrary, upon expiration of the full |
---|
28 | 28 | | term of the judge presiding over the Probate and Juvenile Court in Lauderdale |
---|
29 | 29 | | County, the Probate and Juvenile Court of Lauderdale County shall be dissolved |
---|
30 | 30 | | immediately and its jurisdiction and duties transferred, as follows: |
---|
31 | 31 | | (a) In accordance with Tennessee Code Annotated, Section 16-16-201, |
---|
32 | 32 | | jurisdiction of probate court matters shall be transferred to the Chancery Court of |
---|
33 | 33 | | Lauderdale County, and probate-related clerk duties shall be transferred to the |
---|
34 | 34 | | Chancery Court clerk. The County Commission may transfer clerk-related duties |
---|
35 | 35 | | under this subdivision (a) at any time after approval and certification of this act in |
---|
36 | 36 | | accordance with Section 2; and |
---|
37 | 37 | | (b) In accordance with Tennessee Code Annotated, Section 37-1-210, |
---|
38 | 38 | | jurisdiction of juvenile court matters shall be transferred to the General Sessions |
---|

46 | 46 | | certification of this act in accordance with Section 2. |

47 | 47 | | SECTION 2. This act shall have no effect unless it is approved by a two-thirds (2/3) vote |
---|
48 | 48 | | of the legislative body of Lauderdale County. Its approval or nonapproval shall be proclaimed |
---|
49 | 49 | | by the presiding officer of the legislative body and certified to the secretary of state. |
---|
50 | 50 | | SECTION 3. For the purpose of approving or rejecting the provisions of this act, it shall |
---|
51 | 51 | | be effective upon becoming a law, the public welfare requiring it. For all other purposes, it shall |
---|
52 | 52 | | become effective as provided in Section 2. |
