AN ACT to revise and codify the general and public statutes of the State of Tennessee, to the extent incorporated herein, as a part of Tennessee Code Annotated; to provide in case of any conflict between Acts of the regular or any extraordinary 2025 Session of the General Assembly and this Act, the former shall be controlling, regardless of the respective dates of passage or approval; and to repeal all acts or parts of acts codified in this Act.

Impact

This annual codification process is routine in Tennessee, enabling the integration of new laws into existing legal structures without altering their content. SB0112 does not introduce substantive legal changes; rather, it consolidates previously enacted laws into a singular, updated volume. This process is crucial for maintaining an organized and accessible legal framework for both the public and members of the legislature, facilitating a more efficient legal referencing system.

Summary

Senate Bill 112 (SB0112) is an act designed to revise and codify the general and public statutes of the State of Tennessee. The bill aims to incorporate various acts passed by the previous General Assembly into the Tennessee Code Annotated, serving as the official compilation of the laws in the state. It provides that in the case of any conflict between this act and any latter acts passed by the General Assembly, the latter shall govern, thereby ensuring legal clarity and continuity in the state’s legislative framework.

Sentiment

The sentiment surrounding SB0112 has been largely positive, as the bill is part of a longstanding legislative tradition that enhances the clarity and organization of state law. While the bill is not controversial in nature, its passage reflects a consensus on the necessity to keep legal documents relevant and comprehensible. Lawmakers typically support such codification measures, recognizing their importance in the overall legislative process.

Contention

Although SB0112 is not expected to spark significant contention, legislative discussions surrounding such codification bills often highlight the importance of periodic review and integration of existing laws. Some may raise concerns about the sheer volume of legislation being codified, as SB0112 represents two volumes totaling over 2,540 pages of state laws. Nonetheless, the overall view tends to favor the necessity of these efforts to prevent legal ambiguity and promote effective governance.
