| 7 | 7 | | relating to the use of certain state property transferred from the |
|---|
| 8 | 8 | | state to Spindletop MHMR Services. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1, Chapter 1036 (H.B. 1759), Acts of the |
|---|
| 11 | 11 | | 80th Legislature, Regular Session, 2007, is amended by amending |
|---|
| 12 | 12 | | Subsection (c) and adding Subsections (c-1) and (f-1) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (c) Consideration for the transfer authorized by Subsection |
|---|
| 15 | 15 | | (a) of this section shall be in the form of an agreement between the |
|---|
| 16 | 16 | | parties that requires Spindletop MHMR Services to use the property |
|---|
| 17 | 17 | | in a manner that primarily promotes a public purpose of the state by |
|---|
| 18 | 18 | | using the property to provide community-based mental health or |
|---|
| 19 | 19 | | mental retardation services. An agreement under this subsection |
|---|
| 20 | 20 | | that is amended or supplemented by addendum under Subsection (f-1) |
|---|
| 21 | 21 | | of this section to require Spindletop MHMR Services to use the |
|---|
| 22 | 22 | | property in a manner that primarily promotes a public purpose of the |
|---|
| 23 | 23 | | state by using the property to provide community-based physical |
|---|
| 24 | 24 | | health, health-related, mental health, or mental retardation |
|---|
| 25 | 25 | | services must be: |
|---|
| 26 | 26 | | (1) executed by the parties; and |
|---|
| 27 | 27 | | (2) recorded in the real property records of Jefferson |
|---|
| 28 | 28 | | County, Texas. |
|---|
| 29 | 29 | | (c-1) If Spindletop MHMR Services fails to use the property |
|---|
| 30 | 30 | | in the [that] manner described by an agreement under Subsection (c) |
|---|
| 31 | 31 | | of this section or an amendment or addendum to an agreement under |
|---|
| 32 | 32 | | Subsection (f-1) of this section for more than 180 continuous days, |
|---|
| 33 | 33 | | ownership of the property automatically reverts to the entity that |
|---|
| 34 | 34 | | transferred the property to Spindletop MHMR Services. |
|---|
| 35 | 35 | | (f-1) After a transfer of real property under Subsection (a) |
|---|
| 36 | 36 | | of this section takes effect, the parties may amend or supplement by |
|---|
| 37 | 37 | | addendum the agreement under Subsection (c) to require Spindletop |
|---|
| 38 | 38 | | MHMR Services to use the property in a manner that primarily |
|---|
| 39 | 39 | | promotes a public purpose of the state by using the property to |
|---|
| 40 | 40 | | provide community-based physical health, health-related, mental |
|---|
| 41 | 41 | | health, or mental retardation services. |
|---|
| 42 | 42 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2009. |
|---|
