55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a peace officer to stop, detain, or
88 arrest a person for a violation of certain traffic offenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 543.001, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 543.001. ARREST WITHOUT WARRANT AUTHORIZED. (a)
1313 Except as provided by Subsection (b), any [Any] peace officer may
1414 arrest without warrant a person found committing a violation of
1515 this subtitle.
1616 (b) A peace officer operating a vehicle may not stop,
1717 detain, or arrest the operator or occupant of a vehicle for a
1818 violation of this subtitle that is a misdemeanor punishable by a
1919 fine only unless:
2020 (1) the officer's vehicle is clearly marked as a police
2121 vehicle, as defined by Section 541.201; and
2222 (2) the officer is wearing a uniform on which is
2323 displayed the officer's badge of office.
2424 SECTION 2. This Act takes effect September 1, 2009.
