| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 543.001, Transportation Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | Sec. 543.001. ARREST WITHOUT WARRANT AUTHORIZED. (a) | |
| 13 | 13 | Except as provided by Subsection (b), any [Any] peace officer may | |
| 14 | 14 | arrest without warrant a person found committing a violation of | |
| 15 | 15 | this subtitle. | |
| 16 | 16 | (b) A peace officer operating a vehicle may not stop, | |
| 17 | 17 | detain, or arrest the operator or occupant of a vehicle for a | |
| 18 | 18 | violation of this subtitle that is a misdemeanor punishable by a | |
| 19 | 19 | fine only unless: | |
| 20 | 20 | (1) the officer's vehicle is clearly marked as a police | |
| 21 | 21 | vehicle, as defined by Section 541.201; and | |
| 22 | 22 | (2) the officer is wearing a uniform on which is | |
| 23 | 23 | displayed the officer's badge of office. | |
| 24 | 24 | SECTION 2. This Act takes effect September 1, 2009. |
