 A BILL TO BE ENTITLED
 AN ACT
 relating to the authority of a peace officer to stop, detain, or
 arrest a person for a violation of certain traffic offenses.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 543.001, Transportation Code, is amended
 to read as follows:
 Sec. 543.001. ARREST WITHOUT WARRANT AUTHORIZED. (a)
 Except as provided by Subsection (b), any [Any] peace officer may
 arrest without warrant a person found committing a violation of
 this subtitle.
 (b)  A peace officer operating a vehicle may not stop,
 detain, or arrest the operator or occupant of a vehicle for a
 violation of this subtitle that is a misdemeanor punishable by a
 fine only unless:
 (1)  the officer's vehicle is clearly marked as a police
 vehicle, as defined by Section 541.201; and
 (2)  the officer is wearing a uniform on which is
 displayed the officer's badge of office.
 SECTION 2. This Act takes effect September 1, 2009.
